Choosing a Toronto wrongful death lawyer

Start with the care involved. If medical treatment was connected to the death, find out whether the lawyer handles claims about the alleged error in that care. Wrongful death appears on these firms' practice lists. Their published medical negligence results may concern other claims. Your family's claim can't be valued by looking at a large award in someone else's brain injury case.

Use the first conversation to check the fit
  1. Describe what happened

A short timeline can help you explain the care; ask which records the lawyer wants. Ask how to send the chart or correspondence about the care, if you have those records. Explain when you first suspected that a provider's act or omission contributed to the death.

  2. Identify the person responsible

Find out who'll assess your claim. If the firm accepts it, who would manage the file? Have the firm explain how it'll send you updates. Several firms have positive communication reviews, but some also have reports of slow intake or delays.

  3. Ask about medical proof

You don't need an affidavit or certificate of merit to start a claim in Ontario. The court's rules still require service of expert reports addressing the standard of care and whether the care caused harm. Ask how the lawyer would assess those issues and arrange the necessary reports.

Clarify costs before agreeing

Find out what the free consultation covers. Does it include a records review, or only an initial discussion? Later work isn't necessarily free as well. Contingency fees are listed by Neinstein Personal Injury Lawyers and Howie, Sacks & Henry LLP, as well as Bogoroch & Associates LLP. Find out whether legal fees depend on a recovery and how they're calculated. Ask separately who pays expenses, including expert reports. Ask for written fee terms. For the other firms, confirm the arrangement rather than assuming it.

A promised outcome should raise a concern. Also pause if you can't get a clear answer about fees or who owns the file. A published dollar figure isn't enough: have the firm explain how that result relates to your claim. This is general information, not legal advice.

Questions people ask

Which firm leads this Toronto wrongful death list?
Published medical negligence results help put Neinstein Personal Injury Lawyers first, along with reviews that describe regular communication. Wrongful death appears on its site. The reported awards concern injuries, however, and aren't identified as wrongful death results. Find out who would assess your family's loss before you choose the firm. Ask whether that lawyer handles claims about the care involved.
How long do I have to start an Ontario medical negligence claim?
The basic limitation period runs for two years from discovery. That means knowing, or reasonably being expected to know, about the injury and the health care provider's contribution, including that a lawsuit was appropriate. Ontario also has a 15-year ultimate limitation period. Working out the dates can be difficult. For an assessment of how these rules affect you, speak with an Ontario lawyer.
Do limitation periods apply differently to children?
Yes. The two-year period doesn't run while a claimant is under 18 and has no litigation guardian for the claim. For a claim arising while a claimant is a minor without a litigation guardian, the 15-year ultimate period is also suspended. Wong v. Lui, 2023 ONCA 272 addresses this rule. Family members may have different deadlines. An Ontario lawyer can explain how the rule affects the particular person bringing the claim.
Do I need a medical report before starting a claim?
To start a claim in Ontario, you don't need an affidavit or certificate of merit. The court's rules do require service of expert reports addressing the standard of care and whether negligent care caused harm. Find out what medical review the lawyer needs. Ask how the cost of that review would be handled. Starting a claim and proving that negligent care caused harm are different stages.
Which listed firms offer free consultations and contingency fees?
Both are listed by Neinstein Personal Injury Lawyers and Howie, Sacks & Henry LLP, along with Bogoroch & Associates LLP. Gluckstein Lawyers and Thomson Rogers LLP list free consultations. You'll need to confirm their contingency arrangements. Ask Blackburn Lawyers about both consultation costs and fees. Have the firm explain what the consultation covers before you agree. Ask how it calculates legal fees and who pays expenses.
Does Ontario cap damages in medical negligence claims?
Economic losses, including lost income or future care, aren't subject to a statutory cap. A judge-made trilogy cap limits non-pecuniary damages nationally. These rules can't tell you what a particular wrongful death claim is worth. Nor can the firms' published injury awards tell you what your family might recover. An Ontario lawyer can explain which losses may apply.
