When you tell the lawyer what happened, explain why you think the care contributed to the death. If you have the chart, bring it. Does the firm handle wrongful death claims involving this kind of medical care? Ask them.
Check the limitation period
When you discover the claim, Ontario's basic two-year limitation period starts running; the date of death isn't necessarily the starting point. Have a lawyer assess when the claim was discoverable. Until a minor has a litigation guardian, the two-year period doesn't run; the ultimate period is suspended during that time too.
Start the claim
If you're claiming against a doctor, nurse or hospital in Ontario, you don't have to give pre-suit notice. You can also start the claim without an affidavit or certificate of merit. Before filing, ask what the lawyer needs and how they'll deal with the limitation period.
Medical opinions and reports
Under the court's rules, expert reports covering the standard of care and causation must be served. You'll find explanations of the expected care in these reports, and whether the care caused or contributed to harm. Who arranges these reports, and who pays? Ask.
Review the next steps
Once the medical opinions are available, have the lawyer walk you through what they mean for your claim, then explain the next steps under the court's rules. Before you agree to proceed, ask about further expenses. Treat this as general information, not legal advice.

If the claim failsNo legal fee on a contingency agreement. Ask about costs.
Four firms on this list say they work on contingency: if the claim fails, there's no legal fee; otherwise, the lawyer takes a share of the recovery. Case costs aren't included. Along with court fees, you may face charges for medical records and medical opinions. Who pays those expenses isn't explained in the firms' fee information. If the claim fails, will you owe anything, and who advances the money? Before signing, have the lawyer walk you through their share and the way they deduct expenses. If you end the agreement, have them explain what happens then.
Seven of the eight firms offer consultations they say are free. Four say they charge a contingency fee.

Questions to ask a lawyer
1Does your past work include wrongful death claims involving medical care like this?
2Who should we expect to handle our file and questions?
3What's the limitation period for our family's claim?
4What do you need us to gather for medical records?
5How will you work out whether the medical care played a part in the death?
6If the claim fails, who pays case costs, and how do you work out your legal fees?
7What happens to fees and expenses if we end the agreement?
Choosing counsel after a death in Richmond Hill
Tell the firm what happened. For a death involving concerns about medical care, ask what claims the firm's handled involving the same alleged failure (a missed diagnosis or surgical error, for example). Every firm on this list identifies wrongful death among its practice areas. That doesn't mean each firm has the same experience with deaths linked to treatment. Ask for concrete descriptions of relevant work. The firm shouldn't have to reveal another client's private details to answer.
Which lawyer would manage our claim each day? If that lawyer isn't available, who can we turn to with questions?
What would you need from us to assess whether the health care provider's care caused or contributed to the death?
How do you arrange expert reports addressing the standard of care and causation?
Have you handled a claim like ours? Can you describe any publicly available result?
When a claim is delayed, how would you explain that and keep our family informed?
Read what each result covers. Substantial injury recoveries appear on Campisi Law Injury Lawyers' own site. Those examples aren't identified by the firm as wrongful death cases. Thomson Rogers LLP reports a medical malpractice judgment that was upheld on appeal. Ask the firm whether those results have any bearing on your circumstances. Reviews may show how a firm communicates. Reviews can't tell you how likely your claim is to succeed, even when they describe other clients' experiences.
Get the fee terms in writing
You'll find free consultations and contingency fees offered by several listed firms. Use the consultation to ask how the arrangement works. Read the terms before you agree. Ask what the free meeting actually covers. Ask whether reviewing records would cost anything. Ask how the contingency fee is calculated. You'll also need to know what payment depends on. If the claim doesn't succeed, ask which expenses your family might still have to pay. If you can't find the fee terms, ask the firm directly.
Watch for promises of a particular recovery or reluctance to explain charges. Complaints about slow intake are a reason to ask how soon the firm would decide whether to represent you. You can start an Ontario claim without an affidavit or certificate of merit. Expert reports addressing the standard of care and causation must still be served under the court's rules. You'll need to know how the firm handles those reports. This is general information rather than legal advice.
Questions people ask
Which firm leads this Richmond Hill wrongful death lawyer list?
Campisi Law Injury Lawyers takes first place partly because of its published injury recoveries. A substantial client review record also supports its position. Its site identifies wrongful death work, too. Those published results aren't from wrongful death cases. This ranking can't tell you how a claim will turn out. Before choosing the firm, ask what claims it's handled involving circumstances similar to your family's loss. Find out who would handle your file, too.
How long do I have to start a medical negligence claim after a death in Ontario?
From discovery, the basic limitation period runs for 2 years. Discovery includes knowing, or reasonably being expected to know, of the injury and the health care provider's contribution. It also includes knowing that a lawsuit was appropriate. Ontario also has a 15-year ultimate limitation period. The date of death alone doesn't determine your deadline. For your family's claim, ask an Ontario lawyer which rules apply.
Does a child have the same filing deadline as an adult?
For someone under 18 with no litigation guardian for the claim, Ontario's 2-year period doesn't run. The 15-year ultimate period is also suspended for a claim arising while the claimant is a minor without a litigation guardian, as addressed in Wong v. Lui, 2023 ONCA 272. An Ontario lawyer can explain how these rules apply to the child's claim.
Do I need an expert report before starting a medical malpractice claim?
Starting a claim in Ontario doesn't require you to have an affidavit or certificate of merit. The court's rules do require service of expert reports addressing the standard of care and causation. At the consultation, you'll want to know how the lawyer would assess those issues. Ask about the possible costs, too. An Ontario lawyer can explain the requirements for your particular case.
Are damages capped in Ontario medical negligence claims?
There's no statutory cap on economic losses, including lost income or future care. For non-pecuniary damages, a judge-made trilogy cap applies nationally. What your family can claim after a death isn't settled by either rule. Neither establishes the claim's value. Rather than using another client's published recovery as an estimate, ask an Ontario lawyer which losses apply to your circumstances.
Can I find a firm that offers a consultation in another language?
For Tagalog and Pangasinan, Reyes Tam Law lists both languages. Farsi appears in the listing for Kamyab Law Professional Corporation. You can book a free consultation with either; both list contingency fees. You'll want to know who would speak with your family in that language. Confirm whether that support continues through the claim, too. Before agreeing to representation, ask for a clear explanation of the written fee terms.
Do we have to notify the hospital before starting a claim?
If you're bringing a claim against a doctor, nurse or hospital in Ontario, you don't need to give pre-suit notice. You still face a filing deadline. Before you wait for the hospital to respond, have an Ontario lawyer explain how the limitation period applies to your family's circumstances. If you've received correspondence, bring it along.
Which firms on this list offer a free consultation?
You can get a free consultation, according to Campisi Law Injury Lawyers, Gluckstein Lawyers, Thomson Rogers LLP, Bergel Magence LLP, Reyes Tam Law, Iacobelli Law Firm and Kamyab Law Professional Corporation. You won't find consultation terms listed for Blackburn Lawyers. When you call, ask what you'll get in the consultation and whether reviewing records comes with a charge.
Does a free consultation mean the firm will take the claim on contingency?
Even if the consultation is free, the fee arrangements may differ. According to Campisi Law Injury Lawyers, Bergel Magence LLP, Reyes Tam Law and Kamyab Law Professional Corporation, they work on contingency. You won't find the other firms' contingency terms stated. When you ask to see the proposed fee agreement, have the lawyer explain who'll pay for medical opinions and the other case expenses.
Is there a firm on this list that handles nursing-home neglect?
Among the practice areas listed by Iacobelli Law Firm are nursing-home neglect and wrongful death. If the death involved nursing-home care, that gives you a reason to ask. You can't tell from that listing whether the firm will accept your family's claim. When you describe the care involved, ask what records the lawyer needs to assess it.
