The rules in Nevada

Filing deadline

3 years

Counted from the injury. For injuries on or after October 1, 2023: file within 3 years of the injury or 2 years of when it was or should have been discovered, whichever comes first. (Earlier injuries: 3 years or 1 year from discovery.)

Nev. Rev. Stat. § 41A.097

Discovery rule

Applies

Yes, but the discovery period can only shorten the 3-year limit, not extend it. The time is tolled while a provider conceals the error.

Outer limit

3 years

3 years from the injury is the outer limit, tolled during concealment.

Nev. Rev. Stat. § 41A.097

Damage caps

$590,000 for 2026. The cap was $430,000 from January 1, 2024, rises $80,000 each January 1 to $750,000 in 2028, then 2.1 percent a year.

Nevada caps non-economic damages in professional negligence cases regardless of the number of defendants; economic damages are not capped.

Nev. Rev. Stat. § 41A.035

Children

Different clock

A parent or guardian must sue within the normal period. If they do not, the child cannot sue later, except that brain damage or birth defect claims are extended until age 10, and sterility claims until 2 years after the child discovers it.

Affidavit of merit

Required

File an affidavit from a medical expert in a substantially similar practice area with the complaint, naming each provider and the specific negligent acts. Without it the case is dismissed without prejudice.

Nev. Rev. Stat. § 41A.071

Notice before suing

Not required

No pre-suit notice requirement.

Shared fault

Modified comparative (51% bar)

Modified comparative fault: barred above 50% of the fault

Experts

Expert evidence

The expert must practice or have practiced in an area substantially similar to the defendant's practice at the time (Nev. Rev. Stat. §§ 41A.071, 41A.100).

Nevada AB 404 (2023) lengthened the discovery period, raised the cap and limited contingency fees to 35 percent. The Nevada Legislature's statute site blocks automated access, so the text was checked against the enacted bill summaries and secondary sources.
