Choosing a Toronto misdiagnosis lawyer

The diagnosis problem comes first. Reputation alone is a secondary consideration. Neinstein Medical Malpractice Lawyers handles medical malpractice exclusively. Several other firms here include that work within a broader injury practice. Find out who would assess your claim. Then ask what experience that lawyer has with the condition involved. A birth injury verdict doesn't establish a record in delayed diagnosis.

Make the first conversation useful
  1. Describe the timeline

Give the lawyer your care dates and the diagnosis you received. Follow with the diagnosis change's timing. Find out which medical records the lawyer wants to review. Be clear about anything you can't remember. If you don't remember a date, say so.

  2. Ask about the medical assessment

To start a claim in Ontario, you don't need an affidavit or certificate of merit. You'll still need expert reports. Reports addressing the standard of care and causation must be served under the court's rules, so ask how the firm would assess those issues in your case.

  3. Set communication expectations

Find out who'll take your calls. You'll also want to ask how you'll get updates. Good communication comes up often in reviews across this list. Some reviewers, however, report intake delays or missed follow-up. Ask what happens if the firm declines your case.

Clarify costs before signing

You'll start with a free consultation discussion. The firm hasn't committed to taking your case by meeting you. With contingency fees, the legal fee depends on the outcome. Other possible expenses aren't fully explained by that label. Ask for the written agreement and an explanation of when payment would be due. Ask who would pay for expert reports if your claim doesn't succeed, as well as how those costs are handled.

  • A promised outcome is a red flag. Your claim's outcome can't be predicted from published verdicts. They describe what happened in earlier cases.
  • A deadline calculation needs an explanation before you accept it. Find out why the lawyer chose that discovery date.
  • Look for patterns in reviews. Review feedback isn't proof of results in diagnosis cases; treat it separately.

This general information isn't legal advice for you. An Ontario lawyer can assess your circumstances before you make a decision about proceeding.

Questions people ask

Who leads this Toronto misdiagnosis lawyer list?
The list starts with Paul Cahill - Medical Malpractice Lawyer. Of its practice, 80% is medical negligence. Misdiagnosis and delayed diagnosis are both listed among the areas it handles. Its published trial results cover birth injury as well as negligence in the emergency room. Those are earlier cases. Ask what experience the firm has with your particular diagnosis before you decide to hire it.
How long do I have to start a misdiagnosis claim in Ontario?
The basic limitation period is two years from discovery. The treatment date isn't automatically the start of that clock. Discovery involves knowing, or reasonably being expected to know, that you were injured and that a health care provider contributed to it, as well as that a lawsuit was appropriate. There's also an ultimate limitation period in Ontario: 15 years. For an assessment of your dates and the rules, consult an Ontario lawyer.
Does the limitation period work differently for a child?
Yes. While the claimant is under 18 without a litigation guardian for the claim, the two-year period doesn't run. For a claim arising when the claimant is a minor without a litigation guardian, the 15-year ultimate period is suspended too. The rule is addressed in Wong v. Lui, 2023 ONCA 272. For advice on how the rule affects your child, consult an Ontario lawyer.
Do I need an expert report before starting an Ontario malpractice claim?
Ontario doesn't require an affidavit or certificate of merit to start the claim. Under the court's rules, you'll still have to serve expert reports addressing the standard of care and causation. Find out how the lawyer would assess those medical issues. Report costs need discussion, too. Although there's no initial certificate requirement, you'll still need expert reports.
Are damages capped in an Ontario misdiagnosis case?
Economic losses, including lost income or future care, aren't subject to a statutory cap. Non-pecuniary damages have a different rule, the national judge-made trilogy cap. Your claim's value isn't established by a firm's verdict or negotiated resolution in an earlier case. An Ontario lawyer can explain which losses may apply to your circumstances and how the cap affects the assessment.
