Questions about your own case?
How a malpractice claim usually moves in Texas
  1. 1.Something went wrong

Write down dates and names while they're fresh.

  2. 2.Get your records

Ask for your full chart and test results.

  3. 3.Free case review

A lawyer looks at what happened, free.

  4. 4.Medical opinion

A doctor checks whether the care fell short.

  5. 5.Notice before suing

Some places need a notice before a claim.

  6. 6.File before the deadline

Your lawyer starts the claim before the deadline.

  7. 7.Settlement or trial

Many claims settle. Some go to a judge or jury.

Your deadline: 2 years from the treatmentRead the Texas law guide

Each step in more detail
  1. Review the dates

When you talk to the lawyer, give your treatment dates and when you learned of the concern. Because Texas has no general discovery rule, its usual filing deadline is 2-year. Which deadline applies to your claim? Have the lawyer identify it.

  2. Assess the medical records

If your records show the injury, share them along with your chart. Before deciding whether to pursue the claim, how will the lawyer get a medical opinion to help assess it? Confirm which legal process applies if your treatment involved military or VA care.

  3. File the claim

Discuss filing the complaint (the document that starts the lawsuit) if the lawyer agrees to take your case. A child under 12 has until the fourteenth birthday under the Texas rule; for anyone else, the 2-year rule applies regardless of age.

  4. Serve the expert report

Once a defendant files an answer, Texas requires an expert report and CV for that defendant within 120 days. If that requirement is missed, fees and dismissal with prejudice follow. You can't bring the claim again after that dismissal.

  5. Consider resolution

When you discuss settlement or trial, ask how the firm would proceed and what the damages rules mean for you. Alongside Texas's cap on non-economic damages, death cases have a separate inflation-indexed cap on total damages. Don't expect the firm's published results to predict your outcome.

What a malpractice lawyer costs in San Antonio

  1. The first callOften free. Ask before you book.
  2. A written agreementThe share the lawyer takes, set out before work starts.
  3. If you recover moneyThe agreed share and the case costs come out of it.
  4. If the claim failsNo legal fee on a contingency agreement. Ask about costs.
According to Wayne Wright, Snapka Law Firm, JRE INJURY LAW and Military Medical Malpractice, they take cases on contingency. If there's a recovery, the lawyer gets a share; you don't pay a lawyer's fee if the claim fails. That excludes case costs. Getting medical records or medical opinions can cost money, and so can court fees. Before you sign, find out whether the firm advances those costs and when they're deducted. If there's no recovery, would you still owe those costs? Ask. You won't find a common expense arrangement or fee percentage established by the listed firms. Because all offer a free consultation, you can ask for written terms during that first conversation.

According to all five firms on this list, their initial consultation is free. Contingency work is listed by four of them.

What to bring to your first call

  • Your chart and any delivery or surgical notes, among the records you already have
  • When you were treated or hospitalized, plus the dates you noticed the injury
  • Which doctors and hospitals were involved, by name
  • Medical expenses tied to the injury, documented in bills and receipts
  • What the hospital or insurer sent you in letters or messages
  • If you have photos showing visible injuries, those photos
  • In your own words, a short written timeline
  • If relevant, notes about your child's age or the death of a loved one

Questions to ask a lawyer

  1. 1With this treatment error, have you handled similar cases?
  2. 2Would the person reviewing my records also handle my file?
  3. 3In my situation, when must I file?
  4. 4To get the required expert report, what would you do?
  5. 5If there's a recovery, what share would you charge?
  6. 6If there's no recovery, who pays the case costs?
  7. 7To keep me informed, what would you do?
  8. 8For my claim, would another firm or co-counsel be involved?

Choose for your treatment error, not the firm's size

Which treatment concerns you? Start there. If you're asking about a missed cancer diagnosis, your questions will differ from those about an injury during delivery. Alongside Miller Medical Malpractice's published surgical-error results, Snapka Law Firm shows work involving hospital negligence. For VA and military claims, Military Medical Malpractice lists that work. When you ask about cases involving the same treatment, remember that an injury result doesn't necessarily involve malpractice.

Before you call, have the hospital's name handy. Tell the lawyer when and where you received treatment if it was at Methodist Hospital or Baptist Medical Center. If your care was at San Antonio VA Medical Center, ask whether the federal claim process applies. Don't rely on a hospital's CMS star rating to tell you whether a lawyer can take your claim.

Make the first conversation useful
  1. Describe the concern plainly

When you describe your treatment, explain what you believe went wrong with it. If you have the chart or delivery notes, bring them and explain what changed after treatment. Before calling, you don't need to decide on a legal theory.

  2. Find out who does the work

Who will review your records, and who will you talk to? Have the lawyer explain each person's role if another firm or co-counsel will be involved in your claim. To understand how they'll assess your claim, ask how the team gets the medical opinion it needs.

  3. Get the financial terms in writing

If a consultation is free, you won't pay for that first conversation. That doesn't mean they'll agree to take your case. Before agreeing to a fee contingent on recovery, ask how much the lawyer receives and whether you pay case expenses if the claim fails.

Ask early about the expert-report requirement. After each defendant files an answer, Texas requires an expert report and CV for that defendant within 120 days. If you miss the requirement, dismissal with prejudice and fees follow. Before proceeding, ask who will arrange the report and how you'll pay for it.

  • If no one's reviewed the records, be wary of recovery promises or a quoted case value.
  • When reading reviews, don't skip the negative ones for the positive ones. How will they communicate? Ask directly.
  • Before signing, ask for a plain-language explanation if the fee terms don't make sense to you.
  • Ask about the age rule if your child was injured. The filing clock doesn't necessarily wait until adulthood.

Questions people ask

How soon should I contact a San Antonio malpractice lawyer?
Even if you're still missing some medical records, don't wait to call. Because these claims have no general discovery rule, Texas generally requires you to file within 2 years of the breach or the completion of treatment or hospitalization. When you share your dates with a Texas lawyer, ask which deadline applies.
Which firm leads this San Antonio list?
With published settlements involving surgical errors and failure to diagnose a stroke, Miller Medical Malpractice takes the top place in this ranking. When clients give feedback, they emphasize the firm's explanations and communication. Your family may not find it the right fit. Before choosing it, ask who would handle your file and about the treatment in your case.
Can I speak with a lawyer without paying a consultation fee?
According to all five listed firms, you can have a free consultation. When you talk, explain your treatment and find out whether the firm handles claims like the one you're describing. Even after the consultation, the firm hasn't committed to taking your case, nor have later case expenses been waived. Before you hire anyone, request the fee agreement.
What does a contingency fee mean for my family?
If you agree to a contingency fee, the lawyer gets a share of any recovery. If the claim fails, you don't pay a lawyer's fee. Although four listed firms say they work this way, expenses for records and medical opinions aren't included in that fee. Before agreeing, ask who advances those costs and whether you'll owe them if there's no recovery.
What expert report does Texas require?
Once each defendant files an answer, Texas requires an expert report and CV for that defendant within 120 days. You'll find the medical professional's qualifications in the CV. Because missing the requirement leads to dismissal with prejudice and fees, ask how the lawyer will get the report and who will cover its cost.
Does my child have more time to file?
If a child is under 12, Texas's rule allows filing until the fourteenth birthday. For anyone else, age doesn't change the 2-year rule. Don't assume you can put off a claim until your child reaches adulthood. When you give a Texas lawyer your child's birth date and treatment dates, ask them to explain how the rule applies.
What if my loved one died after medical treatment?
To find out whether a death claim is possible, have a lawyer review the treatment records and explain. In death cases, total damages face a separate inflation-indexed cap set by Texas. Alongside JRE INJURY LAW's published confidential medical-negligence death settlement, Military Medical Malpractice publishes a death result that involved a delayed breast-cancer diagnosis. You can't tell from either result what might happen in your family's case.
How long will a malpractice claim take?
You won't find a dependable estimate from the firms of how long a claim takes. Before the lawyer can assess your case, what needs to happen, and what could slow it down? Ask. When each defendant answers, Texas's 120-day expert-report deadline begins; it doesn't start when you first call. Rather than a promised finish date, request a clear plan for updates.
Who handles claims involving San Antonio VA Medical Center?
Along with its office in San Antonio, Military Medical Malpractice lists a practice that includes VA hospital malpractice as well as federal tort claims. Given the facility and circumstances in your case, ask whether the firm can handle your claim. Which filing process applies? Confirm that, too. If care took place at a federal facility, the ordinary Texas deadline isn't necessarily the only rule governing it.
Is there a limit on malpractice compensation in Texas?
For health care liability claims, Texas limits non-economic damages. Because death cases also have a separate inflation-indexed cap on total damages, these rules can change what a claim is worth. To understand which limits apply, speak with a Texas lawyer. When you see a firm's published settlement amount, don't treat it as a reliable estimate of what you could recover.
