Choosing a Toronto-area nursing home neglect lawyer

Check what long-term care work the firm does before looking at its overall rating. Every firm here lists nursing home neglect on its site. Several handle other kinds of files too; Nanda & Associate Lawyers, for example, gets praise for real estate transactions. Even when reviews tell you about service, they may not show whether a lawyer has handled a claim like your family's.

Make the consultation specific
  1. Describe what happened

Note when you learned about the resident's injury as you write a short account. Before asking how they'd assess whether an act or omission contributed to the injury, find out which care records the lawyer wants to review. Before you make contact, there's no need to diagnose the legal problem.

  2. Identify the person handling the claim

Find out who would be responsible for your file and how you'd reach them. Ask that lawyer to explain their long-term care negligence work. Singer Katz LLP's published surgical result is relevant medical litigation history, for instance. It isn't evidence of a nursing home result.

  3. Discuss proof and costs

You can start a claim in Ontario without an affidavit or certificate of merit. Under the court's rules, though, expert reports on the standard of care and causation must be served in practice. Ask where the firm would get those reports. Ask who'd cover the expenses that come with them.

Although it's free, a consultation is only a first discussion; the firm hasn't promised to take your case. Check what's included. If a contingency arrangement interests you, find out how recovery affects the fee, including which expenses you'd pay separately. If the claim doesn't succeed, ask what you could still owe. Ask for written terms. Because Iacobelli Law Firm's contingency terms and Nanda & Associate Lawyers' consultation charge aren't confirmed, you'll need to ask those firms directly.

Treat a promised outcome as a warning sign. If a firm won't explain its fees or identify who'll answer your questions, be cautious. Before signing, discuss what you expect, because several firms have received complaints about communication. Ask how meetings would work if the office is outside central Toronto. Don't treat this general information as legal advice.

Questions people ask

Which firm leads this Toronto nursing home neglect list?
Howie, Sacks & Henry LLP takes first place here, with nursing home negligence listed as a practice area. It dates back to its founding in 2000. Clients praise compassionate service and clear explanations in its substantial feedback; the firm also lists recognition from Lexpert and Best Lawyers. There aren't any published case results to assess. Ask about the proposed lawyer's long-term care work before you decide to retain the firm.
How long do I have to start a nursing home neglect claim in Ontario?
Discovery starts the basic limitation period of 2 years. You discover the claim when you know, or reasonably ought to know, about the injury and that a health care provider's act or omission caused or contributed to it. You must also know, or reasonably ought to know, that a lawsuit was appropriate for discovery to occur. There's a 15-year ultimate limitation period in Ontario as well. Speaking to a lawyer for the first time doesn't necessarily start the clock. Ask an Ontario lawyer to assess those dates.
Do I need an expert report before starting the claim?
Starting an Ontario claim doesn't require an affidavit or certificate of merit. You'll still need medical evidence, though: under the court's rules, expert reports on the standard of care and causation must be served in practice. How would the lawyer get the necessary reports once they've reviewed the care records? Ask about costs, too. Ask an Ontario lawyer what's needed for your particular claim.
Are all the listed firms located in Toronto?
No. Nanda & Associate Lawyers has an office in Mississauga, 24 km from Toronto; Iacobelli Law Firm is in Richmond Hill, 21 km away. Diamond & Diamond Lawyers LLP's listed office is in North York, 14 km from Toronto. Howie, Sacks & Henry LLP and Bogoroch & Associates LLP have Toronto offices. So does Singer Katz LLP. Before choosing by location, ask how the firm would arrange meetings.
Can a nursing home neglect claim cover future care costs?
Economic losses, including future care costs or lost income, have no statutory cap in Ontario. The national judge-made trilogy cap limits non-pecuniary damages instead. You can't work out a particular resident's recovery from either rule. Don't mistake the list's published surgical negligence result for one about nursing home care. Ask an Ontario lawyer what evidence you'd need for the losses that may form part of the claim.
Do these firms offer free consultations or contingency fees?
Howie, Sacks & Henry LLP lists free consultations and contingency fees, as does Bogoroch & Associates LLP. Both appear on Diamond & Diamond Lawyers LLP's list. While Iacobelli Law Firm lists a free consultation, contingency fees appear in the listings for Nanda & Associate Lawyers and Singer Katz LLP. Other terms still need confirming. When asking what the consultation covers, request a written explanation of fees and expenses. Even under either arrangement, there's no promise the firm will accept your claim or obtain a recovery.
