The rules in Idaho
Filing deadline
2 years
Counted from the treatment. File within 2 years of the act or omission. Idaho does not delay the start for later-discovered injuries, except for foreign objects and fraudulent concealment.
Discovery rule
Does not apply
Only for a foreign object left in the body or a fraudulently concealed injury: then the later of 1 year from discovery or 2 years from the act.
Outer limit
None found
We found no statute of repose for Idaho.
Damage caps
$538,425 for judgments from July 1, 2026 (the $250,000 base cap is adjusted every July 1 by the Idaho Industrial Commission's average wage index). The cap does not apply to willful or reckless misconduct or acts that would be a felony.
Idaho's general non-economic damages cap applies to medical malpractice and adjusts each July 1.
- Punitive
- The greater of $250,000 or 3 times compensatory damages (Idaho Code § 6-1604).
- Wrongful death
- The same non-economic cap applies to wrongful death claims.
Children
Different clock
The deadline is paused while the patient is a minor, but the pause cannot exceed 6 years.
Affidavit of merit
Not required
No affidavit of merit, but see the mandatory prelitigation screening panel.
Notice before suing
Required
Claims against physicians and acute care hospitals must first go to a prelitigation screening panel run with the Idaho State Board of Medicine. The panel is informal and nonbinding but compulsory before suing.
Idaho Code § 6-1001
Shared fault
Modified comparative (50% bar)
Modified comparative fault: barred at 50% or more of the fault
Experts
Expert evidence
The expert must show actual knowledge of the community standard of care where the care was given; an out-of-area expert may qualify by familiarizing themselves with that local standard (Idaho Code §§ 6-1012, 6-1013).
Idaho measures the standard of care against the local community standard, which makes expert selection important.
