Choosing a malpractice lawyer in Brampton

Start with your particular injury. A dental malpractice listing may make a firm a more relevant first call for a dental treatment injury than one whose site mainly discusses birth injury. Find out who would handle your file. Ask whether they've handled a file involving the same medical issue. You won't learn that from a practice-area label.

Make the first conversation useful
  1. Prepare a treatment timeline

For each treatment, make a note of the date. When did you first suspect something had gone wrong? Note that date, too. Ask the lawyer which records you'll need to bring, whether that's the chart or the delivery notes. Your provider's explanation at the time is something to share with the lawyer. Working out the legal cause isn't something you have to do alone.

  2. Ask how the claim would be assessed

Starting a claim in Ontario doesn't require you to have an affidavit or certificate of merit. The court's rules still require service of expert reports. Those reports must address the standard of care and, in practice, causation. The firm should explain how it would arrange that review. Who would pay?

  3. Agree on communication

When the lawyer's unavailable, you'll want to know who answers your questions. Ask about updates. Clear explanations earn praise for several firms here. Still, clients of Gluckstein Lawyers and Thomson Rogers LLP have also complained about delays. Agree on response timing before you sign.

Clarify the cost before retaining anyone

Several firms on this list offer a free consultation. A consultation doesn't mean the firm is taking your claim. Ask what the initial assessment covers. Ask how recovery affects payment under the contingency fee arrangement.

You'll want those terms in writing. If the claim doesn't succeed, what expenses might you owe? Ask the firm to explain those costs.

For children, the rules differ. While a claimant is under 18 without a litigation guardian for the claim, the 2-year period doesn't run. For a claim arising while the claimant is a minor without a litigation guardian, the ultimate period is also suspended. A lawyer should check your filing date.

  • Treat any promise of an outcome cautiously. Someone else's claim led to that published result.
  • Get the fees clear before you proceed. Find out who'll be responsible for your file, too. Ask if you're unsure.
  • A good intake conversation doesn't necessarily mean the firm has accepted your claim. That doesn't confirm the firm's acceptance.

You'll find general information on this page, not legal advice. For advice about your circumstances, speak with an Ontario lawyer who can explain how the rules apply to you.

Questions people ask

How long do I have to start a medical malpractice claim in Brampton?
Ontario's usual limitation period is 2 years from discovery of your claim. Discovery depends on when you knew about the injury and the provider's role in causing or contributing to it, or when you reasonably should have known. Knowing that a lawsuit was appropriate is part of discovery, too.

There's also a 15-year ultimate period. To check the dates for your claim, speak with an Ontario lawyer.
Are the filing rules different for an injured child?
Yes. The 2-year period doesn't run for a person under 18 who has no litigation guardian for the claim. The 15-year ultimate period is likewise suspended for a claim arising while the claimant is a minor without a litigation guardian, as addressed in Wong v. Lui, 2023 ONCA 272. An Ontario lawyer can tell you how this applies to your child.
Do I need an expert report before starting a claim?
Ontario doesn't require an affidavit or certificate of merit when you start a medical malpractice claim. The court's rules do require service of expert reports on the standard of care and causation in practice. Your consultation is a time to discuss that. How would the lawyer assess those issues, and what costs could the review involve?
Which listed firms have offices in Brampton?
You'll find a Brampton office listed by Chorney Sidhu Injury Lawyers. Its language support includes Punjabi, Hindi and Tamil. Gluckstein Lawyers' listed offices are in Toronto, Ottawa, Niagara and Barrie. For Thomson Rogers LLP, the listed location is Toronto. Singer Katz LLP lists Toronto and North York.

Before choosing a firm based on location, ask how you'd meet and share documents.
Can I get a free consultation or use contingency fees?
You can get a free consultation with Gluckstein Lawyers, Thomson Rogers LLP, Chorney Sidhu Injury Lawyers, Anushika Anthony Prof. Corp. (AAPC Lawyers) or Hillier & Hillier Personal Injury Lawyers.

Contingency fees appear among the payment arrangements listed by Chorney Sidhu Injury Lawyers and Anushika Anthony Prof. Corp. (AAPC Lawyers). Singer Katz LLP and Hillier & Hillier Personal Injury Lawyers also list contingency fees. Ask each firm for written fee terms. You'll also want to know how it handles expenses.
Does Ontario cap medical malpractice compensation?
Economic losses, such as lost income or future care, have no statutory cap. The judge-made trilogy cap limits non-pecuniary damages nationally.

A published settlement or judgment from another case can't establish the value of your claim. For your injury and claimed losses, an Ontario lawyer can explain which damages rules apply and what they mean.
