Questions about your own case?
How a malpractice claim usually moves in Ontario
  1. 1.Something went wrong

Write down dates and names while they're fresh.

  2. 2.Get your records

Ask for your full chart and test results.

  3. 3.Free case review

A lawyer looks at what happened, free.

  4. 4.Medical opinion

A doctor checks whether the care fell short.

  5. 5.Start the claim in time

Your lawyer starts the claim before the deadline.

  6. 6.Settlement or trial

Many claims settle. Some go to a judge or jury.

Your deadline: 2 years from when you found outRead the Ontario law guide

Each step in more detail
  1. First call and deadline check

When you tell the lawyer what happened, explain when you first suspected the care contributed to the injury or death. Once you discover the claim, Ontario's basic limitation period runs for two years; discovery includes knowing a lawsuit was appropriate. Ask an Ontario lawyer to assess your family's discovery date.

  2. Review the care records

Bring a written timeline with your chart. To assess the care and its connection to the harm, which records does the lawyer need to see? Ask who would cover the cost of medical opinions, too.

  3. Start the claim

If your claim is against doctors, nurses or hospitals, Ontario doesn't require you to give pre-suit notice. You can also start a claim without an affidavit or certificate of merit. Before your limitation period expires, ask the lawyer how the filing rules apply to you.

  4. Serve medical reports

In practice, you'll need to serve expert reports under the court's rules. Those reports explain whether the care met the standard of care (the care expected), and address causation: did the care cause or contribute to the harm? Ask who arranges the reports, including who pays for them.

  5. Discuss possible recovery

Which losses could your claim address? Although Ontario has no statutory cap on economic losses, such as lost income or future care, non-pecuniary damages have a judge-made national cap. Non-financial harm is what those damages cover. You can't tell from either rule what your family might recover.

What a malpractice lawyer costs in Vaughan

  1. The first callOften free. Ask before you book.
  2. A written agreementThe share the lawyer takes, set out before work starts.
  3. If you recover moneyThe agreed share and the case costs come out of it.
  4. If the claim failsNo legal fee on a contingency agreement. Ask about costs.
Seven firms on this list say they work on contingency: if the claim fails, there's no legal fee, but the lawyer takes a share of any recovery. Case costs come separately. When you ask about costs, include charges for medical records and medical opinions, along with court fees. Find out who pays those costs during the claim before you sign, including whether you'd owe them if it fails. Ask how much the lawyer proposes to take and what would be left for your family after case costs. Those questions aren't settled by a free consultation.

You can consult all eight firms free, they say. Seven say they also take cases on contingency.

What to bring to your first call

  • Your hospital chart and any other medical records you have
  • Dates of treatment, along with when you first suspected something had gone wrong
  • The hospitals involved, along with the names of the doctors and nurses
  • A short account in writing of the care and what happened afterward
  • Bills or receipts you have for the injury or death
  • Any hospital or insurer letters sent to you
  • Photos that could help you show what happened

Questions to ask a lawyer

  1. 1What's your experience handling deaths linked to care like this, if you've handled them?
  2. 2Who handles our file, including calls from us?
  3. 3How long is the limitation period for our family?
  4. 4To assess our claim, which medical records will you need?
  5. 5While the claim is underway, who covers medical opinions and the other case costs?
  6. 6How do you work out the contingency fee?
  7. 7Would we have to pay costs if the claim failed?
  8. 8What would you need to decide whether the care contributed to the death?

Choosing a lawyer after a death in Vaughan

What happened comes first. Although these firms cover wrongful death, the medical negligence work they handle differs. If a published recovery concerns brain injury, it doesn't establish a result in a fatal-care claim. Find out whether the lawyer has handled deaths involving the same kind of alleged error your family is concerned about, such as misdiagnosis or nursing home negligence.

Make the first conversation useful
  1. Describe the care and timing

When you tell the lawyer what happened, include when your family first suspected the care contributed to the death. Find out which parts of the medical chart they'd want to review. To assess your concerns, would they need an expert report?

  2. Identify the lawyer responsible

Before asking how you'd reach them, find out who would manage your file and explain developments. Although several firms on this list have positive communication reviews, they also have complaints about delays or missed follow-ups. Rather than accepting a general statement about attentive service, look for a clear answer.

  3. Check meeting arrangements

Unlike the other offices on this list, which are in North York or Toronto, Campisi Law Injury Lawyers lists an office in Woodbridge. Before you arrange travel, find out whether you need to attend in person and where you'd have your consultation.

Get the fee terms before agreeing

Although most firms on this list list contingency fees, every one offers a free consultation. First, check the terms. Before assuming a meeting is free, check whether every expense falls within the fee arrangement too. Consultation charges are a concern raised in a VC Lawyers review. This list doesn't confirm Thomson Rogers LLP's contingency terms.

  • Before paid work starts, find out when it begins and what the free consultation covers.
  • Ask for the firm's contingency fee calculation in writing, including an explanation of when you'd pay it.
  • If the claim doesn't succeed, what costs could you owe, and who pays for expert reports? Find that out.

If someone promises recoveries or gives vague answers about deadlines, be wary. To start a claim in Ontario, you don't need an affidavit or certificate of merit. Under the court's rules, though, expert reports on standard of care and causation must be served. Find out how the firm would handle that work. This gives general information, not legal advice.

Questions people ask

Which firm leads this Vaughan wrongful death lawyer list?
Because it publishes medical negligence results and covers wrongful death, Neinstein Personal Injury Lawyers ranks first, with its substantial client review history also supporting that position. Although the published recoveries include injury claims, they aren't identified as wrongful death results. You'll find its office in Toronto, about 20 km from Vaughan. Before you decide, find out what experience it has with the particular care involved in your family's situation.
How long do I have to start a medical negligence claim in Ontario?
From discovery, Ontario's basic limitation period runs for two years. When you knew, or reasonably ought to have known, about the injury and the health care provider's contribution is part of discovery. Whether you knew a lawsuit was appropriate matters too. Although the ultimate limitation period is 15 years, suspension rules apply, including rules for certain minor claimants. To assess which dates apply to your claim, speak with an Ontario lawyer.
Do I need an expert report before starting a claim?
To start a claim in Ontario, you don't need an affidavit or certificate of merit. Under the court's rules, though, expert reports on standard of care and causation must be served in practice. Proving a claim differs from starting one. When you have your consultation, ask how the lawyer would review the medical chart and arrange the necessary reports. Ask them to explain the cost too.
Are consultations free with the firms on this list?
A free consultation is advertised by every firm on this list. Although most also list contingency fees, this list doesn't confirm that arrangement for Thomson Rogers LLP. Before booking, check what the free meeting covers: review feedback for VC Lawyers mentions an unexpected consultation charge. Along with requesting written fee terms, ask the firm to explain who would pay the costs of expert reports.
Does Ontario cap damages in medical negligence cases?
For economic losses, such as lost income or future care, Ontario has no statutory cap. Nationally, a judge-made trilogy cap limits non-pecuniary damages. What a particular wrongful death claim could recover isn't answered by either rule. To understand which losses may apply to your family's circumstances, ask an Ontario lawyer how the damages rules would affect those losses.
Does a child's claim have the same two-year clock?
While the claimant is under 18 and has no litigation guardian for the claim, the two-year clock doesn't run. If a claim arises while the claimant is a minor without a litigation guardian, the 15-year ultimate period is also suspended, as addressed in Wong v. Lui, 2023 ONCA 272. To understand how those rules apply to each family member's claim, ask an Ontario lawyer.
Do we have to notify the hospital before starting a claim?
You can bring an Ontario claim against doctors, nurses or hospitals without pre-suit notice. You still have a filing deadline. Before you wait for a hospital response, ask an Ontario lawyer how the limitation period applies to the circumstances you're dealing with. Our Ontario guide has more information, though it's general information rather than legal advice.
Do all the firms on this list say they work on contingency?
Seven of the eight firms say they work on contingency. Thomson Rogers LLP's contingency terms aren't confirmed here, so ask the firm directly. With contingency fees, the lawyer receives a share of a recovery and no legal fee if the claim fails. Ask separately about responsibility for case costs before signing.
Which listed firms include nursing home neglect among their practice areas?
You'll find Nursing Home Neglect and Wrongful Death among the practice areas of Howie, Sacks & Henry LLP and Bogoroch & Associates LLP. Free consultations and contingency fees are also offered, both firms say. When you call, use those listings as a starting point and ask what experience the firm has with the care involved in your family's situation.
Which listed firms handle claims involving misdiagnosis or surgical errors?
You'll find Misdiagnosis and Surgical Error listed alongside Wrongful Death in the practice areas of Thomson Rogers LLP, Bergel Magence LLP and Bogoroch & Associates LLP. Misdiagnosis also appears in Howie, Sacks & Henry LLP's list. What experience does the lawyer have with the treatment involved in your relative's death? To assess it, which records would they need from you?
