Choosing a wrongful death lawyer in Brampton

Start with what happened to your family, rather than the ranking. Every firm here lists wrongful death work. Their broader practices differ. Look at the published results side by side. Ask about claims involving the same treatment if you suspect medical care contributed to your family member's death. Don't read a surgical negligence judgment as proof that the firm has handled a claim involving a fatal medication error.

Prepare for the first conversation
  1. Write down what happened

Put the treatment into a timeline. Record the point when your family first suspected the care and the death were connected. Add the medical chart to your records list if you've got it. The lawyer can then use those records to explain what else the claim assessment needs.

  2. Ask who will handle the file

Ask who'll be the lawyer responsible for your claim. If you can't reach that lawyer, ask what happens next. Ask how you'll hear about progress on your claim. In reviews of Gluckstein Lawyers and Thomson Rogers LLP, some clients say they've faced delays. Other clients have positive accounts. Be direct about communication.

  3. Test the relevance of past work

Ask what the lawyer actually did in a claim comparable to yours. Chorney Sidhu Injury Lawyers reports a recovery in a case involving an anaesthesia death. Neither an amount nor a date is given. Ask for context. You can't tell how your family's claim might turn out from a brief account of another result.

Clarify consultation and fee terms

Most firms here offer you a consultation at no charge. Singer Katz LLP's consultation terms aren't stated. Find out what the consultation covers before you meet. Ask whether you'd pay if the claim needs further assessment. You can use the consultation to discuss whether the firm suits what you need. It might decide not to take your claim.

  • If the firm offers a contingency fee arrangement, find out how the result affects what you'd pay. Get written terms for payment.
  • Ask who pays expenses such as the expert reports. Have them explain how they'll calculate the fee, too. You might face costs outside that arrangement.
  • The contingency arrangements aren't stated for Gluckstein Lawyers or Thomson Rogers LLP. Contact the firms to find out about fees.

An outcome promise should make you wary. Be wary, too, if you're pressed to sign before you've had answers to your fee questions. Starting a claim in Ontario doesn't require you to have an affidavit of merit. Expert reports on care and causation are generally required by the court's rules for medical negligence claims. Find out how the firm would handle those reports for your claim. Treat this as general information, not legal advice for your claim.

Questions people ask

How long do I have to start a medical negligence claim after a death in Brampton?
Discovery starts Ontario's basic limitation period: 2 years. For discovery, you must know that a health care provider's act or omission caused or contributed to the injury. You must also know a lawsuit was appropriate. You don't have to have known those things yet: the rules also consider when you reasonably ought to have known them. There's also a separate ultimate period of 15 years. Bring the dates your family has recorded to an Ontario lawyer, who can assess which ones matter for the claim. You can't calculate the deadline from the date of death alone.
Which firms on this list publish results involving a death?
Chorney Sidhu Injury Lawyers reports a recovery for the family of an anaesthesia death victim in one of its published results. It gives no amount or date. A medical malpractice success reported by Thomson Rogers LLP survived an appeal in 2024. A separate published result, Singer Katz LLP's surgical negligence judgment, dates from 2013. Neither result is described as a wrongful death case by those two firms. Find out what each firm's lawyers did in fatality claims involving circumstances like your family's.
Can I get a free consultation or use contingency fees?
Consultations are free at Gluckstein Lawyers and Thomson Rogers LLP. Chorney Sidhu Injury Lawyers, Anushika Anthony Prof. Corp. (AAPC Lawyers) and Hillier & Hillier Personal Injury Lawyers also offer them. Singer Katz LLP's consultation terms aren't stated. Contingency fees are an option listed by the latter four firms. Gluckstein Lawyers and Thomson Rogers LLP's arrangements aren't stated, so ask for written fee terms and an explanation of expenses before agreeing to representation.
Do I need an expert report before starting an Ontario medical negligence claim?
To start an Ontario claim, you don't have to file an affidavit or certificate of merit. The court's rules still require expert reports to be served. Those reports must address the standard of care. They must cover causation, too. Ask how the lawyer would use the medical chart and those reports to assess your claim. Get a clear explanation. The medical issues remain, even when you start without a certificate. Your claim will still need to address those medical issues.
Does Ontario cap damages in a wrongful death claim?
There's no statutory cap on economic losses in Ontario. Lost income and the cost of future care are economic losses. The judge-made trilogy cap applies nationally to non-pecuniary damages. What you can claim after the death depends on an assessment of the losses your family has suffered. Ask an Ontario lawyer which losses your family might claim. They can explain how any relevant limit would affect those losses.
What if a claimant is a child?
For a claimant under 18 without a litigation guardian for the claim, the 2-year limitation period doesn't run. If a claim arises while the claimant is a minor without a litigation guardian, the 15-year ultimate period is also suspended, as addressed in Wong v. Lui, 2023 ONCA 272. Each claimant needs a separate assessment of their circumstances by an Ontario lawyer. Don't assume one deadline covers everyone in your family. Different family members might have different deadlines.
