Choosing a malpractice lawyer in Mississauga

Make the medical issue your starting point, not the size of a past recovery. A delivery injury and a delayed cancer diagnosis call for different questions about the care given. Ask about the lawyer's experience handling claims like yours. Check who would actually be reviewing the chart, too. Because several listed firms have offices outside Mississauga, confirm where you'd meet.

Ask how the firm would assess your claim

  • Before you decide whether to take my case, what do you need from me, and who will review my medical records?
  • To assess whether the treatment caused my injury and met the standard of care, which expert reports might you need?
  • Who will I contact regularly? How will you keep me updated and deal with unanswered messages?
  • Does the published result you're discussing involve a medical issue like mine? Which differences are important?

To start a claim in Ontario, you don't need an affidavit or certificate of merit. You'll still need medical opinion evidence. The court's rules require you, in practice, to serve expert reports on the standard of care and causation. Find out how the firm would get those reports and deal with the cost.

Get the fee arrangement in writing

You'll find free consultations and contingency fees at several firms on this list. A consultation starts the discussion. Even after that discussion, the firm hasn't promised to take your claim or cover every expense that comes later. If you're considering a contingency arrangement, ask how payment depends on a recovery, including what you could owe without one. Have the lawyer explain the percentage and expert-report costs, and make sure the written agreement covers both. The terms can differ, so don't assume every firm uses the same ones.

If someone promises a particular recovery, be wary. You can't predict outcomes from published results. Even positive reviews can't show you whether the firm can prove your claim. If you leave the intake conversation unsure about fees or who handles the file, ask them to clarify. Because this is general information rather than legal advice, ask an Ontario lawyer to assess your circumstances.

Questions people ask

Do I need a lawyer with an office in Mississauga?
You'll find firms in Toronto and Brampton on this list, as well as Mississauga offices. Sommers Roth & Elmaleh and Gluckstein Lawyers have offices in Mississauga; Chorney Sidhu Injury Lawyers works from Brampton, 20 km away. Ask where you'll meet before choosing, and find out who'll handle the file. You can't tell how a firm would assess your medical claim just from its location.
How long do I have to start a medical malpractice claim in Ontario?
The basic limitation period runs for two years from discovery. Discovery depends on when you knew, or reasonably ought to have known, about the injury and a health care provider's contribution to it. You must also have known, or reasonably ought to have known, that a lawsuit was appropriate. There's a 15-year ultimate limitation period in Ontario, too. Ask an Ontario lawyer to check your dates against these rules, including any relevant suspension.
Does the same deadline apply to a child's birth injury claim?
Until the claimant turns 18, Ontario's two-year period doesn't run if there's no litigation guardian for the claim. If a claim arises while the claimant is a minor without a litigation guardian, the 15-year ultimate period is suspended too. That suspension features in Wong v. Lui, 2023 ONCA 272. The child's circumstances can affect the deadline, so ask an Ontario lawyer.
Do I need an expert report before starting a claim?
You can start a medical malpractice claim in Ontario without an affidavit or certificate of merit. In practice, you still need expert reports on the standard of care and causation, which must be served under the court's rules. Ask when the reports would be needed, as well as how the lawyer would assess the chart. Also ask who's expected to pay for the reports. Ask an Ontario lawyer what your case requires.
Is there a cap on medical malpractice compensation in Ontario?
Ontario doesn't impose a statutory cap on economic losses, which include lost income or future care. The judge-made national trilogy cap puts a limit on non-pecuniary damages. Although some firms listed here publish large results, those can't tell you what another claim is worth. Ask an Ontario lawyer which categories of loss may apply to your circumstances, including how the cap affects them.
