Your deadline: 2 years from when you found outRead the Ontario law guide

Each step in more detail
  1. Review the care and concerns

When you first consult the lawyer, explain what happened and which care concerns your family. If you have the chart, bring it along. A general wrongful death practice listing isn't enough; ask whether the lawyer handles medical negligence claims involving a death.

  2. Check the limitation period

Ontario's basic limitation period gives you two years from discovery, including knowing that a lawsuit was appropriate. Ask an Ontario lawyer to explain how that rule fits your dates. If a claimant is under 18 and has no litigation guardian, the period doesn't run.

  3. Start the lawsuit

You have until the applicable limitation period expires to start the claim. You don't need an affidavit or certificate of merit to start the claim in Ontario, nor pre-suit notice for claims against doctors, nurses or hospitals.

  4. Address the medical evidence

The court's rules mean you'll need to serve expert reports in practice. They cover the care expected (the standard of care), as well as whether the care caused or contributed to the injury. Ask how the lawyer will arrange that review.

  5. Assess the claimed losses

Ask what documents support the losses that could be included in the claim. Economic losses, including lost income, have no statutory cap in Ontario. A judge-made national cap does apply to non-pecuniary damages, which cover losses that aren't financial.

What a malpractice lawyer costs in Markham

  1. The first callOften free. Ask before you book.
  2. A written agreementThe share the lawyer takes, set out before work starts.
  3. If you recover moneyThe agreed share and the case costs come out of it.
  4. If the claim failsNo legal fee on a contingency agreement. Ask about costs.
Eight firms on this list say they'll take a case on contingency. If the claim fails, you pay no legal fees; otherwise, the lawyer takes a share of any recovery. Medical records and medical opinions cost money, and court fees are separate case costs too. You can't assume the firm pays. Ask who covers expenses while the claim proceeds and whether you'll owe them back, including what happens if there's no recovery. Ask for a written explanation of the lawyer's share and other deductions before signing. Knowing the firms' stated fee options won't tell you who carries case costs.

All ten firms say you can consult them free. Eight say they'll also take claims on contingency.

What to bring to your first call

  • Your hospital chart, along with any other medical records you have
  • The date of death, alongside the treatment dates
  • Names of the doctors and nurses involved, along with the hospitals
  • What happened, written out as a brief timeline
  • Receipts and bills for the care
  • Letters or emails you've received from the hospital or insurer
  • Photos that could help show what concerns you
  • Your notes on when you first suspected that the care contributed to the death

Questions to ask a lawyer

  1. 1Does your past work include medical negligence claims involving a death?
  2. 2Who'll our family speak with, and who'll handle our file?
  3. 3Given the dates in our case, how does Ontario's limitation period apply?
  4. 4To assess the claim, what records will you need?
  5. 5How will you arrange for medical opinions that connect the care to the death?
  6. 6If we recover money, what's your fee share?
  7. 7As the claim proceeds, who pays case costs, including if it fails?
  8. 8How will we get updates?

Choosing a wrongful death lawyer in Markham

First, consider what happened around the death. Although every firm here includes wrongful death work, they differ in the results they publish and the medical negligence they cover. A brain injury recovery shows it's handled that kind of case. That isn't a result for wrongful death. Ask whether it's handled claims involving the treatment your family member received. This isn't legal advice, just general information; ask an Ontario lawyer how the rules apply to your family.

Use the first conversation to test the fit
  1. Discuss the records

First, describe what happened. Once you've explained, ask which records the lawyer needs to see (perhaps the chart or delivery notes). Ask how it'd assess whether something a health care provider did, or failed to do, contributed to the death.

  2. Identify the responsible lawyer

Ask who'd manage your file, and find out who you could turn to with questions. Reviews may show how firms communicate. Because reviews can't tell you how the firm would handle your file, ask it to explain clearly how you'd get updates.

  3. Confirm the location

You'll find Reyes Tam Law's office in Markham. The remaining offices listed here aren't in the city; they include locations in Toronto and Richmond Hill. Before arranging a visit, check where you'd meet, especially if your family finds it difficult to travel.

You can get a free consultation with every listed firm. Although you can ask about your claim there, a consultation doesn't confirm that the firm will take it. Although most list contingency fees, Thomson Rogers LLP and Iacobelli Law Firm don't have those arrangements confirmed. Have the lawyer explain whether a recovery determines the fee and what percentage would apply. Before signing, get the terms in writing, and ask separately about any expenses you might have to pay.

  • Have the firm explain how it'd get expert reports addressing the standard of care and causation. Although Ontario doesn't require an affidavit or certificate of merit to start a claim, expert reports must be served under the court's rules.
  • If anyone promises a particular payout, be wary. Published recoveries come from cases with different facts, and several firms here haven't published results.
  • Don't ignore intake questions left unanswered or fees that aren't clearly explained. If reviews describe communication problems, make sure you get clarification before committing.

Questions people ask

Do I need a lawyer with an office in Markham?
Consider where the office is, but also its experience with relevant cases. Reyes Tam Law's office is located in Markham. The other listed offices aren't in the city: Iacobelli Law Firm is in Richmond Hill, and several firms have offices in North York or Toronto. Before you book, find out where you'd meet and which lawyer would take your family's claim.
How long do I have to start a medical negligence claim involving a death in Ontario?
Ontario's basic limitation period runs for two years from discovery, once you knew or reasonably ought to have known about the injury and the health care provider's contribution. You also must have known that a lawsuit was appropriate, or reasonably ought to have known it. A 15-year ultimate limitation period also applies. Before treating these rules as a date calculation, get advice; an Ontario lawyer can explain how they apply to your family's claim.
What if a claimant is a child?
If a claimant in Ontario is under 18 without a litigation guardian for the claim, the two-year period doesn't run. If a claim arose while the claimant was a minor without a litigation guardian, the 15-year ultimate period is suspended too, as addressed in Wong v. Lui, 2023 ONCA 272. Have an Ontario lawyer identify whose claim is involved and check whether these rules apply.
Do we need a medical expert before starting the lawsuit?
To start a medical negligence claim in Ontario, you don't need an affidavit or certificate of merit. You still need expert reports: in practice, the court's rules require reports on the standard of care and causation to be served. When you consult the firm, ask how it'd review the chart and get those reports. Also ask how the costs would be handled. Filing doesn't mean you've established the claim.
Are consultations free, and do all these firms charge contingency fees?
You can consult any listed firm for free, and most also list contingency fees. Because that arrangement isn't confirmed for Thomson Rogers LLP or Iacobelli Law Firm, ask each firm to walk you through its proposed agreement. Have the firm explain whether a recovery determines its fees and how it handles expenses. Although that first conversation is free, it won't tell you what you'll pay for the later work.
Is compensation capped in Ontario medical negligence cases?
Although Ontario has no statutory cap on economic losses such as lost income or future care, the judge-made trilogy cap limits non-pecuniary damages across Canada. That doesn't tell you which losses you can claim in a particular wrongful death case. Have an Ontario lawyer explain which categories apply. Don't read firms' published large injury results as estimates of what your family might recover.
Do we have to notify the hospital before starting a lawsuit?
You don't have to give pre-suit notice in Ontario for claims against doctors, nurses or hospitals. You still need to consider the deadline for starting a claim. Writing to the hospital doesn't take the place of filing. Ask an Ontario lawyer to explain what your family needs to do in its circumstances.
Are medical records and medical opinions included in a contingency fee?
With a contingency fee, you know how the lawyer gets paid. Who pays case expenses isn't necessarily clear from that. Ask what records and medical opinions cost, separately from the fee, and about court fees. Eight firms on this list say they work on contingency; you still need to ask who advances expenses and who owes them if the claim fails. Get those terms in writing before you sign.
How can we compare firms for a death involving medical care?
Look first at what kinds of claims each firm lists. If it lists similar care, ask about work involving care like your family member's. Campisi Law Injury Lawyers and Reyes Tam Law both list medical malpractice alongside wrongful death, while Bogoroch & Associates LLP lists wrongful death and nursing home neglect. Those listings give you something to discuss with the firm, not proof of a likely outcome.
What should we explain about when we first suspected something went wrong?
When you speak with the lawyer, explain when you learned of the injury and first suspected a health care provider's act or omission caused or contributed to it. Ontario's discovery rule also asks when you knew that a lawsuit was appropriate, or when you reasonably ought to have known. When you write those dates down, don't mix them with the treatment dates. Because this is general information, ask an Ontario lawyer to explain how the rule applies to you.
