Questions about your own case?
How a malpractice claim usually moves in Ontario
  1. 1.Something went wrong

Write down dates and names while they're fresh.

  2. 2.Get your records

Ask for your full chart and test results.

  3. 3.Free case review

A lawyer looks at what happened, free.

  4. 4.Medical opinion

A doctor checks whether the care fell short.

  5. 5.Start the claim in time

Your lawyer starts the claim before the deadline.

  6. 6.Settlement or trial

Many claims settle. Some go to a judge or jury.

Your deadline: 2 years from when you found outRead the Ontario law guide

Each step in more detail
  1. Check the limitation period

Ontario's basic limitation period is 2 years, starting when you've discovered the claim and know a lawsuit was appropriate. The lawyer needs to know when you learned about the injury and its possible cause. You'll need an Ontario lawyer to check your claim's deadline.

  2. Review the records and fees

Bring your written account of what happened, with the chart and relevant dates alongside it. Before hiring the firm, go over its fee agreement. Tell the lawyer if a litigation guardian has been appointed for a child, because that appointment affects the limitation period.

  3. Start the claim

You don't need pre-suit notice in Ontario to sue doctors, nurses or hospitals. You can start a claim without an affidavit or certificate of merit. Before your limitation period expires, ask the lawyer what you need to file.

  4. Serve medical reports

The court's rules require you to serve expert reports that address the standard of care and causation. Those reports explain what care the provider should've given, then address whether the care caused the injury. What's involved in arranging those opinions? Ask the firm.

  5. Assess losses and possible resolution

How will the lawyer document your lost income and future care needs when trying to resolve your claim? Ask the lawyer, since Ontario has no statutory cap on economic losses. A judge-made national cap limits non-pecuniary damages, the money paid for losses such as pain and suffering.

What a malpractice lawyer costs in Oakville

  1. The first callOften free. Ask before you book.
  2. A written agreementThe share the lawyer takes, set out before work starts.
  3. If you recover moneyThe agreed share and the case costs come out of it.
  4. If the claim failsNo legal fee on a contingency agreement. Ask about costs.
Four firms on this list offer contingency arrangements: if your claim fails, there's no legal fee, otherwise the lawyer takes a share of any recovery. That excludes case costs. Don't assume the contingency agreement covers medical records or medical opinions, which can cost money, along with court fees. If nothing is recovered, who pays those costs, and who advances them? Before signing, have the lawyer explain their share and any other charges, including what costs will leave you with from a recovery. Who usually pays those expenses isn't clear from the list.

Seven of the eight firms offer consultations they say are free. Four list contingency fees as an option.

What to bring to your first call

  • The chart and other medical records you have, with delivery notes if they're relevant
  • The treatment dates and the date you first realised the injury might be connected to the care
  • The doctors' and nurses' names, with the hospitals where they treated you
  • Bills and receipts for expenses caused by the injury
  • Letters or emails you've received from the hospital or insurer
  • Photos showing the injury (add dates if you can)
  • A brief timeline you've written of what happened
  • Details of any litigation guardian appointed for the child's claim

Questions to ask a lawyer

  1. 1Which claims has your firm handled where the care was similar?
  2. 2Who would handle my file and answer questions from my family?
  3. 3How does Ontario's limitation period work with these dates?
  4. 4Before deciding whether to take my claim, which records would you need?
  5. 5What would you do to get the medical opinions my claim needs?
  6. 6How would you work out my contingency fee?
  7. 7If my claim fails, what would I owe, and who covers case costs upfront?
  8. 8When we speak for free, what's covered?

Choosing a malpractice lawyer for an Oakville claim

Don't rely on rankings alone; start with the medical issue. You'd ask different questions about birth injury than about delayed diagnosis. Ask what the lawyer needs to assess your claim and which comparable claims they've handled. You get some background from published results. You can't judge how strong your case is or its worth from that.

Make the first conversation useful
  1. Explain what happened

Note when you learned something might have gone wrong in your short treatment timeline. Before the lawyer reviews it, ask which chart records or delivery notes they'd want. Say if you're unsure about a detail; don't fill the gap from memory.

  2. Identify the person responsible

If the firm takes your claim, ask who'll assess it and who would manage the file. Ask how you'd receive updates from the firm. Although several listed firms get praise for communication, complaints about intake or delays appear too.

  3. Discuss medical review

You can start a claim in Ontario without an affidavit or certificate of merit. Court rules require you to serve expert reports on the standard of care and causation once it proceeds. Ask what the lawyer would do to get those opinions.

Get the fee terms in writing

Use a free consultation to find out whether the firm might take your case. The lawsuit still isn't free, though. Ask how a recovery affects the fee if the firm offers contingency billing, then check what expenses you could owe separately. Before signing, get the firm's fee explanation in writing. Don't assume a firm with undisclosed fee terms offers the same deal as firms that advertise contingency billing.

If anyone promises an outcome, that's a warning sign. If nobody identifies who's reviewing your file or answers fee questions, be cautious too. You won't find an Oakville office among those identified on this list. Where would you meet? Ask whether the firm checked the limitation period if it declines your case (the clock may still be running).

You're reading general information, not legal advice. Although our Ontario guide explains regional rules, it can't replace having a lawyer check your own dates and circumstances.

Questions people ask

Do these medical malpractice lawyers have offices in Oakville?
You won't find any of the listed offices in Oakville. Most have Toronto addresses. If you look outside Toronto, there's Bergel Magence LLP ⚖️ Personal Injury Lawyers in North York, plus Ross & McBride - Personal Injury Lawyers in Hamilton. Confirm where you'll meet before booking, then ask how the firm stays in touch between appointments.
How long do I have to start a medical malpractice claim in Ontario?
The basic limitation period is 2 years from discovery, so treatment doesn't automatically start the clock. When you know, or reasonably ought to know, of the injury and the provider's contribution, you've discovered a claim. The test also includes whether you knew a lawsuit was appropriate. A 15-year ultimate limitation period applies in Ontario too. Have an Ontario lawyer check your dates and explain what any exceptions mean for your claim.
Does the filing deadline work differently for a child's birth injury?
While a claimant is under 18 without a litigation guardian for the claim, Ontario's 2-year period doesn't run. If a claim arises while the claimant is a minor without a litigation guardian, the 15-year ultimate period doesn't run either; Wong v. Lui, 2023 ONCA 272 addresses that rule. Have an Ontario lawyer explain these rules for your child's circumstances.
Do I need a medical expert's certificate before starting a claim?
Starting a medical malpractice claim in Ontario doesn't require an affidavit or certificate of merit. Expert evidence is still necessary. To follow court rules in practice, you must serve reports on the standard of care and causation. Use the consultation to ask how the lawyer would arrange the medical review and what you'd pay for the reports.
Is there a cap on medical malpractice compensation in Ontario?
Lost income and future care costs are economic losses, and Ontario doesn't set a statutory cap on them. A judge-made national trilogy cap limits non-pecuniary damages instead. Because these categories differ, a firm's published multimillion-dollar result won't show what another claim may be worth. Ask an Ontario lawyer how damages rules apply to the injuries and losses you've had.
Do I have to notify the hospital before starting a lawsuit?
If you're suing a hospital, doctor or nurse for malpractice in Ontario, pre-suit notice isn't required. You still face a filing deadline. Keep any letters you've sent or received, because the lawyer needs to see them. This isn't legal advice, just general information. Ask an Ontario lawyer what has to happen in your situation.
Does a contingency agreement mean I won't pay any case costs?
You shouldn't assume so. The contingency fee is what you pay the lawyer from a recovery. Discuss court fees separately, along with the cost of medical records and medical opinions. According to Neinstein Personal Injury Lawyers, Howie, Sacks & Henry LLP, Bergel Magence LLP and Bogoroch & Associates LLP, they work on contingency. Ask for a written explanation of who pays if the claim fails, including who advances the expenses.
How can I compare firms for the kind of injury my family is dealing with?
The care involved comes first. Paul Cahill lists practice areas that include surgical error and medication error; nursing home neglect is listed by Howie, Sacks & Henry LLP. Birth injury appears on several firms' lists. A listing can get you started, but it won't answer questions about your claim. Ask which claims involving similar care they've handled, then who would take your file.
