How a malpractice claim usually moves in California

  7. 7.Settlement or trial

Many claims settle. Some go to a judge or jury.

Your deadline: 3 years from the injuryRead the California law guide

Each step in more detail
  1. Initial review

When explaining what happened, give the lawyer the dates of treatment. Under California's general rule, filing is due within 3 years of injury or 1 year of discovery, whichever comes first. Ask early for the lawyer's deadline assessment.

  2. Records and medical assessment

Before the review, ask how the lawyer will obtain medical opinions and which charts and treatment notes they need. What must that review resolve before the firm can decide whether to pursue your claim?

  3. Filing the complaint

To start the lawsuit, you file a document called a complaint. Although California doesn't require a certificate of merit for a health care negligence suit, you need court permission under Cal. Civ. Proc. Code § 425.13 before claiming punitive damages.

  4. Developing the claim

How will the lawyer document your losses and connect the care you received to the injury? Before discussing how you'll get updates as the claim proceeds, find out who pays for any further medical opinions.

  5. Resolution

Either a settlement or a court decision may end the claim. Neither comes with promises. Although California's MICRA doesn't cap economic damages, it caps non-economic damages at the amount in force when the judgment, award or settlement occurs.

What a malpractice lawyer costs in San Diego

  1. The first callOften free. Ask before you book.
  2. A written agreementThe share the lawyer takes, set out before work starts.
  3. If you recover moneyThe agreed share and the case costs come out of it.
  4. If the claim failsNo legal fee on a contingency agreement. Ask about costs.
According to most firms listed here, they work on contingency. If money is recovered, the lawyer gets a share; if the claim fails, there's no lawyer's fee. Separate case costs cover medical records and medical opinions, along with the fees charged by the court. Who advances those expenses, and who owes them without a recovery, isn't explained in the firms' listed terms. Before signing, ask about this. Have the firm explain in writing when it deducts costs and how it calculates the fee. Because a free consultation doesn't settle the question, also ask whether you could still owe expenses if your claim is unsuccessful.

According to Six of the seven firms on this list, they work on contingency and offer free consultations.

What to bring to your first call

  • Discharge instructions, plus any medical charts and test results you have
  • When you received treatment and first suspected that the care caused an injury
  • The facilities involved and the names of the doctors and nurses
  • Records of lost income, plus your medical bills
  • Messages or letters you've received from the hospital or insurer
  • If you have injury photos, those photos
  • What happened, written as a brief timeline
  • For a child's claim, your child's birth date and any relevant delivery notes

Questions to ask a lawyer

  1. 1What cases involving this treatment or injury have you handled?
  2. 2Who is the attorney responsible for my file?
  3. 3To determine my filing deadline, what will you do?
  4. 4What would you need for medical records and opinions?
  5. 5What's your method for calculating the contingency fee?
  6. 6If there's no recovery, who pays case costs, and what if there is?
  7. 7When I need answers or updates, how will I get them?
  8. 8What might concern you enough to decline my case?

Choosing a malpractice lawyer in San Diego

Let the care that worries you guide you. Even if both firms list medical malpractice, a delayed diagnosis may require different experience from a nursing home injury. Has the lawyer handled cases involving that treatment or injury? Although published recoveries give you context, they can't predict how much your own claim might be worth.

When you speak with the lawyer about your child's claim, give their age right away. Although California generally allows 3 years from the wrongful act, a child under 6 has until the later of 3 years or the eighth birthday. This short description isn't enough to work out the deadline yourself. Treat this as general information, not legal advice.

Use the first conversation to test the fit
  1. Ask who will handle the file

Who is the attorney who will evaluate your claim? Get their name. When you have routine questions, who answers them, and how will progress updates reach you? Although several firms here receive positive feedback, they also receive communication complaints. Before signing, talk through how you'll stay in touch.

  2. Discuss the medical review

Before proceeding, ask how the lawyer will obtain medical opinions and which records they need. To sue a health care provider for negligence in California, you don't need a certificate of merit. Even so, that doesn't answer whether the lawyer considers your records enough to pursue a claim.

  3. Read the payment terms

Although a free consultation costs nothing for the initial conversation, it doesn't mean the firm will accept your case. If the lawyer works on contingency, they receive a share of a recovery but no lawyer's fee when the claim fails. That excludes expenses. What would those cost?

  • Don't trust promises of a payout. Because past settlements and verdicts involved other cases, they aren't results for yours.
  • Before you sign, have the firm explain case costs clearly, including who pays if there's no recovery.
  • Don't stop at the star rating. Because reviews may concern car crashes or other claims, they don't necessarily describe medical cases.
  • When a firm declines your case, find out whether it checked the deadline. The consultation doesn't mean your filing clock stopped.

Questions people ask

How long do I have to file a medical malpractice claim in San Diego?
Under California's general rule, you must file within 3 years of the injury or 1 year after discovering, or reasonably being expected to discover, it, whichever comes first. Don't overlook the discovery date. When you give a California lawyer that date and the treatment date, ask how the statute of limitations applies to your case.
Do San Diego malpractice lawyers offer free consultations?
According to Six of the seven listed firms, consultations are free. Because Terrado Esq's terms aren't stated, check directly with the firm. When you call, discuss the injury and filing deadline, then ask who would be handling your case. Even if the conversation is free, the firm hasn't necessarily agreed to represent you or pay your case expenses.
Will I owe attorney fees if my claim fails?
According to Six listed firms, they charge contingency fees, meaning the lawyer gets a share of a recovery but no lawyer's fee when the claim fails. That doesn't include expenses. Before hiring, check whether you'd still owe for records and medical opinions, along with fees charged by the court, if you recover nothing. Have them put the answer in writing.
Does California require a medical certificate before I can sue?
To sue a health care provider for negligence in California, you don't need a certificate of merit. Someone still needs to assess your records. How would the lawyer assess the care and the injury that resulted? If you want to claim punitive damages, a separate rule applies: under Cal. Civ. Proc. Code § 425.13, you must first get court permission.
Are medical malpractice damages capped in California?
Only non-economic damages fall under California's MICRA cap, including compensation for pain and suffering. Economic damages aren't subject to it. When judgment, award or settlement occurs, the amount in force determines the applicable cap. When speaking with a California lawyer, ask how each loss is categorized and what the cap could mean for your claim. Your case's value isn't established by a firm's past recovery.
What deadline applies if my child was injured?
From the wrongful act, a child generally has 3 years to sue. For a child under 6, the deadline falls on the later of 3 years or the eighth birthday. When you talk to the lawyer, give your child's birth date and treatment dates. Rather than calculating it alone, you can have a California lawyer explain how that rule applies to your child's claim.
How long will a malpractice claim take?
No fixed case duration is stated by the firms listed here. Before filing, what needs to happen, and what might delay the medical review or the claim's resolution? Although some firms receive positive reviews, complaints about delays also appear. When you agree on how updates will reach you, you'll be better able to distinguish ongoing work from a question that hasn't been answered.
What should I do before contacting a malpractice lawyer?
Start by writing down what went wrong and the treatment dates. As you gather the records and bills you have, include when you first suspected that the care caused an injury. Rather than waiting for a complete file, ask the lawyer which other records they need. If the injury or your discovery of it wasn't recent, it's especially important to discuss the deadline early.
Which firms handle claims involving a loved one's death?
Among the listed firms addressing wrongful death are Singleton Schreiber and Morgan & Morgan, with Terrado Esq also covering those claims. For deaths in elder care settings, Senior Justice Law Firm has published results. Even with those practice areas and results, you can't tell whether your family's claim can proceed. When you ask a California lawyer who may bring the claim, also check which filing deadline applies.
