Because it focuses on malpractice and publishes diagnosis and prescribing results, Hastings Law Firm leads this list. You'll find its office in Phoenix, though, outside Houston. Before calling, find out who reviews the medical records and what you'll pay in fees and case costs. Can it meet Texas's filing and expert-report deadlines? Ask.

Best for: Diagnosis and prescribing claims
Among Hastings Law Firm's published results are a $19,750,000 failure-to-diagnose settlement and a $10,700,000 negligent-prescribing jury verdict. Because it focuses on malpractice and publishes those results, it earns a place on this list. The firm dates to 2005, when Tommy Hastings founded it.

An $18 million breast cancer misdiagnosis verdict is among Painter Law Firm's published results. Its site also describes a Dallas verdict exceeding $10 million involving emergency room care and a settlement exceeding $1 million for another ER patient. Robert Painter handles medical malpractice, and the Houston firm lists brain injury and wrongful death alongside that practice.

Best for: Nursing home abuse claims
Nursing home abuse is a distinct part of Brown, Christie & Green Law Firm's work. The firm's site cites VerdictSearch recognition for a Texas nursing home verdict, although it doesn't give a dollar amount for that result. Its malpractice focus and listed recognition in plaintiff medical malpractice law support its placement.

Best for: Birth injury and HIE claims
For birth injuries, Van Wey & Metzler's site describes cases involving hypoxic encephalopathy and cerebral palsy. Among its published cases are an anesthesia error involving profound brain damage and a jury verdict involving critically high blood glucose. When families read those cases, they learn more about its malpractice work than a general practice-area label tells them.

To whom it may concern,
I can’t recommend JD Davis highly enough! He fought hard for me, went to bat when it mattered most, and made sure the doctor and ER were held accountable for their mistakes. Thanks to his dedication, persistence, and hard work, I received a six-figure settlement, and it came much...”

Don't wait to bring a Texas lawyer the treatment dates. You usually have 2 years from the breach or when treatment or hospitalization ends to file. Although there's no general discovery rule, a separate age-based rule applies to children.
Review the medical chart
Before deciding whether to accept the claim, the lawyer reads the records and assesses the medical issues. Which records do they need, and how will they arrange medical opinions? Ask. Even after a free consultation, the firm hasn't necessarily agreed to represent you.
File the complaint
When the lawyer accepts the case and moves forward, the court claim begins with filing the complaint. Check how the filing deadline applies before you rely on a date. Under its statute of repose, Texas sets an outer limit of 10 years.
Serve the expert report
Within 120 days after each defendant files an answer, Texas requires an expert report and the expert's CV for that defendant. If you fail, dismissal with prejudice and fees follow. You can't refile a claim dismissed with prejudice.
Address resolution and damages
Ask the lawyer to walk you through settlement discussions and a possible trial. For health care liability claims, Texas puts a cap on non-economic damages. If the case involves a death, a separate inflation-indexed cap limits total damages and can change how a potential recovery is assessed.

A written agreementThe share the lawyer takes, set out before work starts.
If you recover moneyThe agreed share and the case costs come out of it.
If the claim failsNo legal fee on a contingency agreement. Ask about costs.
Contingency is how six listed firms say they work. If there's a recovery, the lawyer gets a share; if the claim fails, there's no lawyer's fee. Separate case costs can cover medical records and medical opinions, as well as the fees charged by the court. Who pays those expenses isn't clear from the fee arrangement alone. If the firm advances costs, ask when you'll have to repay them. And if there's no recovery, what happens? Before you sign, ask for a written explanation of the lawyer's share and how expenses come out of the recovery.
A free consultation is offered by six of the seven listed firms, according to their statements; six also say they work on contingency.

Questions to ask a lawyer
1When you've handled claims before, have any involved my treatment or injury?
2Before you decide whether to take my case, who reads my records?
3If I need to reach the lawyer handling my file, how would I?
4Given my treatment dates, when do I have to file?
5To get the expert report Texas requires, what would you arrange?
6If my claim fails, who covers case costs, and how are your fees calculated?
7If Texas damage caps apply, how could they affect my claim?
8When I need updates, how would I get them, and where would we meet?
Choosing a malpractice lawyer in Houston
Instead of starting with an advertised verdict's size, start with what happened during treatment. If the diagnosis was delayed, reviewing it takes different records than reviewing an injury during delivery. Before the lawyer assesses your claim, ask what they need and whether they've handled claims involving that same treatment. Although a published result can show relevant work, it won't tell you how much your claim is worth.
Find out who will review your records
Before intake, ask who decides whether to take the case and whether you can talk with the lawyer who would handle it. Reviewers praise supportive communication at several of the listed firms, but some also report trouble getting through intake. If the firm turns down your case, find out whether it read the medical chart or decided based on the first conversation. Being turned down doesn't explain what Texas law says.
Which parts of the chart does the lawyer need, including delivery notes for a birth injury claim? Ask.
Who arranges the medical review for the expert report, and how will you cover its cost? Ask.
Where would you meet? Ask, because Hastings Law Firm and Morgan & Morgan have offices in Phoenix, outside Houston.
After intake, who answers your questions, and how will you receive updates? Ask.
During a free consultation, you can talk about whether the firm might accept your case. That isn't a promise of representation. If you sign a contingency agreement, the lawyer gets a share of any recovery but no lawyer's fee if the claim fails. Ask separately about what you'll pay for records and medical opinions. Get written payment terms before you sign anything.
Look for clear answers, not promises
If someone promises an outcome or refuses to explain the fee agreement, be cautious. Who handles your file? You should know that, too. Before you rely on an advertised verdict, ask about Texas damage caps: the state caps non-economic damages, and death cases have a separate inflation-indexed total-damages cap. You're reading general information here, not legal advice. For your family, a Texas lawyer can explain which rules apply.
Questions people ask
How long do I have to file a medical malpractice claim in Houston?
Under Texas's general rule, you must file within 2 years of the breach or when treatment or hospitalization ended. You can't use a general discovery rule for these claims. Because the statute also sets a 10-year outer limit, don't count on discovering an injury later to restart the clock. Have a Texas lawyer look at the dates and explain the rule that applies.
Do Houston malpractice lawyers offer free consultations?
According to six firms on this list, their consultations are free. Whether Van Wey & Metzler charges for a consultation isn't stated. Before booking, check the charge and find out which records to send ahead. Although the consultation lets you discuss a possible claim, it doesn't mean the firm has said yes to representing you.
Will I owe a lawyer's fee if my claim fails?
With contingency, which six listed firms say they offer, the lawyer gets a share of any recovery but no lawyer's fee if the claim fails. You won't find Hastings Law Firm's contingency terms stated. Expenses remain separate. If there's no recovery, would you still owe charges for medical opinions and records? Ask about those costs.
What expert report does Texas require?
After each defendant files an answer, you have 120 days to provide that defendant's expert report and the expert's CV under Texas law. If you miss that requirement, dismissal with prejudice and fees follow. Who will prepare the report, and how will you cover the cost? Ask. Before signing a fee agreement, talk this requirement through with your lawyer.
Is the deadline different for a child's birth injury?
In Texas, a child under 12 can file until the fourteenth birthday. If that exception doesn't apply, the 2-year rule applies regardless of age. Among the listed firms showing birth injury work are Van Wey & Metzler and Davis & Davis, Attorneys at Law. When you speak with a Texas lawyer, ask how your child's age and treatment dates change the filing deadline.
What changes if my loved one died after medical treatment?
If a Texas case involves death, a separate inflation-indexed cap limits total damages. Among the listed firms handling wrongful death are Painter Law Firm and Brown, Christie & Green Law Firm. Have the treatment dates and available records with you when you call. With a Texas lawyer, you can discuss the filing deadline and how the death-case cap might affect your claim.
How long will a malpractice case take?
You can't count on one timetable for every case. After the lawyer reviews the records, what happens next, and what could slow or speed your claim? Ask. One requirement is fixed in Texas: each defendant's expert report is due 120 days after that defendant files an answer. How long your case would take isn't something a firm's past verdict or settlement tells you.
Should I choose the firm with the largest published verdict?
You can use published results to shape better questions, but they don't predict a payout. Among Hastings Law Firm's publications are diagnosis and prescribing results; Morgan & Morgan publishes a 2007 birth injury award from Hillsborough County. Before choosing, ask whether the assigned lawyer has handled a similar medical issue and talk about how Texas damage caps could affect a possible recovery.
What should I do before my first call?
As you gather the records you have, write down the treatment dates. Add any hospital letters and the doctors' names. If you're discussing a birth injury, delivery notes may help. Rather than delaying the call until the file is complete, ask what else the lawyer needs. Get advice about the filing deadline promptly, because Texas doesn't have a general discovery rule.
