Pick a state

A cap limits what a jury or judge can award for pain and suffering, and sometimes in total. Economic losses such as medical bills and lost income are usually not capped.

What a cap does

In the United States a cap usually limits non-economic damages: pain, suffering and loss of enjoyment of life. Some states cap total damages. In Canada a national cap set by the Supreme Court in 1978 limits non-pecuniary damages and rises with inflation. Medical bills, lost income and the cost of future care are usually not capped anywhere.
