But that case wasn't in Los Angeles. Although the firm lists medical malpractice within a broader practice, it has an office in the Los Angeles area.

Questions about your own case?
How a malpractice claim usually moves in California
  1. 1.Something went wrong

Write down dates and names while they're fresh.

  2. 2.Get your records

Ask for your full chart and test results.

  3. 3.Free case review

A lawyer looks at what happened, free.

  4. 4.Medical opinion

A doctor checks whether the care fell short.

  5. 5.Notice before suing

Some places need a notice before a claim.

  6. 6.File before the deadline

Your lawyer starts the claim before the deadline.

  7. 7.Settlement or trial

Many claims settle. Some go to a judge or jury.

Your deadline: 3 years from the injuryRead the California law guide

Each step in more detail
  1. First call and deadline check

When you speak to the lawyer, give your injury date and when you discovered the possible problem. Under California's general rule, you must file within 3 years of injury or 1 year of discovery, whichever comes first. Have them explain your situation's deadline.

  2. Records and case assessment

When asking what the lawyer needs to review the care, include the chart and relevant delivery notes. If medical opinions are needed, ask who would pay for them. Even after a consultation, the firm hasn't necessarily accepted your case.

  3. Preparing the complaint

Once the firm accepts your claim, ask about the document that starts the lawsuit, called the complaint. To sue for provider negligence in California, you don't need a certificate of merit. You need court permission under Cal. Civ. Proc. Code § 425.13 before claiming punitive damages.

  4. Developing the claim

When discussing your claim, ask how the lawyer will use the records and medical opinions to explain it. While checking what information is still missing, ask how you'll get updates. You can't tell from the filing deadline how long this work takes.

  5. Settlement or court outcome

When discussing a possible recovery, have the lawyer explain which losses are economic and which harm is non-economic. At judgment, award or settlement, MICRA caps only non-economic damages at the amount then in force. Economic damages don't have a cap.

What a malpractice lawyer costs in Los Angeles

  1. The first callOften free. Ask before you book.
  2. A written agreementThe share the lawyer takes, set out before work starts.
  3. If you recover moneyThe agreed share and the case costs come out of it.
  4. If the claim failsNo legal fee on a contingency agreement. Ask about costs.
According to each listed firm, it works on contingency. If the claim fails, there's no lawyer's fee; otherwise, the lawyer receives a share of the recovery. You'll also have separate case costs, including records and medical opinions as well as court fees. Who pays those bills isn't settled just by agreeing to a contingency fee. If the firm advances costs, ask whether you could still owe them if the claim fails. Have the lawyer explain how the fee is calculated before you sign, including when expenses come out of a recovery. You can also get a free consultation at every listed firm.

According to each of the seven listed firms, you can get a free consultation and contingency fees.

What to bring to your first call

  • When the injury happened, including the date you first suspected something was wrong
  • What happened, written down in a brief account
  • Names of the hospital and the providers who treated you
  • Any relevant delivery notes among the records you already have
  • If you suspect a medication error, information about the medications
  • Any notes on financial losses, along with your bills
  • Anything the hospital or insurer sent as letters or messages
  • What you'd like to ask about fees and communication

Questions to ask a lawyer

  1. 1For this medical issue, how many cases have you handled?
  2. 2When you review my records, who works on my file?
  3. 3In my situation, what's the filing deadline?
  4. 4To proceed, what additional records or medical opinions do you need?
  5. 5What's the calculation for your contingency fee?
  6. 6If the claim succeeds or fails, who pays the case expenses?
  7. 7When I need updates, how do I reach the person handling my case?
  8. 8Before I sign, will you walk me through the agreement?

Choose for your medical issue, then check the working relationship

Start by describing the care that went wrong. Because a delayed delivery isn't the same as a medication error, remember that these firms don't all focus on the same malpractice work. Unlike several others that also handle accident or employment claims, Bostwick & Associates devotes its practice to malpractice. Have the firm discuss cases involving your medical problem. If the published account doesn't identify a claim as malpractice, a large injury recovery doesn't establish the firm's malpractice record.

Use the first conversation to test the fit
  1. Describe the event plainly

When you describe what happened, explain when you first learned something might be wrong. Name the hospital or provider involved. When asking which records the lawyer needs, check whether they want delivery notes or medication records, including what questions remain unanswered.

  2. Identify the person handling your file

Before moving forward, ask who will assess your claim and answer your calls afterward. Reviews of several listed firms mention problems getting in touch. When you ask how you'll get updates, find out whom to contact if a question can't wait.

  3. Read the payment terms

According to every listed firm, consultations are free and fees are contingent on recovery. Although you can discuss your situation without paying for a consultation, the firm hasn't necessarily agreed to represent you. If the claim fails, there's no lawyer's fee under a contingency agreement; otherwise, the lawyer receives a share of a recovery. Separately, ask about case expenses.

Also check where the office is. While The Law Brothers is in Beverly Hills, Morgan & Morgan identifies an office in the Los Angeles area. Check whether you can meet where you expect to. If you'll need language support, make sure it's available with the people you'll speak to throughout the case.

  • Ask how the firm would obtain medical opinions when it reviews the chart. To sue a health care provider for negligence in California, you don't need a certificate of merit.
  • If you haven't read the agreement or received clear answers about costs, watch out for pressure to sign.
  • When reading past results, treat them as case histories rather than predictions. Although review patterns can help you frame questions, they don't show every client's experience.

You're reading general information, not legal advice. Before deciding about filing, ask a California lawyer which rules apply if your child was injured or someone died after medical care.

Questions people ask

How soon should I contact a Los Angeles malpractice lawyer?
Don't put off calling. Rather than assuming you have 3 years, remember California's rule: 3 years from injury or 1 year after you discovered, or reasonably should have discovered, the injury, whichever comes first. To assess your dates, speak with a California lawyer. Even if you don't have every medical record in hand, you can make that first call.
Which firm on this list focuses most closely on medical malpractice?
With published results involving birth injuries and neonatal surgical injuries, Bostwick & Associates devotes its practice to medical malpractice. For malpractice cases involving delayed delivery and misdiagnosis, you'll also find published accounts from Heimberg Barr, LLP. Within their broader practices, the other listed firms handle malpractice. When speaking with any firm, have them discuss the specific medical issue that your family experienced.
Can I speak with a lawyer without paying for the consultation?
According to each of the seven firms, you can get a free consultation. When you explain the injury in that conversation, ask whether the firm will assess your records. Representation doesn't follow automatically. Ask the lawyer to separate the contingency fee from what you may owe for case expenses before you sign an agreement.
What does a contingency fee mean if my claim fails?
If the claim fails, there's no lawyer's fee under a contingency agreement; otherwise, the lawyer gets a share of a recovery. According to every listed firm, it uses this arrangement. Expenses aren't included. Even without a recovery, could you still owe money for records or medical opinions, as well as court fees? Ask the lawyer to walk through those terms in the agreement.
Does California limit how much a malpractice claim can recover?
Under California's MICRA rule, non-economic damages are capped. Because economic damages aren't capped, ask the lawyer where each of the losses you're claiming belongs. At judgment, award or settlement, the cap is the amount in force at that time. You can't tell what your own claim might recover from the published results on this list.
Do I need a medical certificate before filing a lawsuit?
To sue a health care provider for negligence in California, you don't need a certificate of merit. To assess or present your case, though, a lawyer may still need medical opinions. When asking about that review, check what it costs. Before claiming punitive damages, you need court permission under Cal. Civ. Proc. Code § 425.13.
Is the deadline different when a child was injured?
It is. Within 3 years of the wrongful act, a child must file suit. For a child under 6, the deadline is whichever comes later: 3 years or the child's eighth birthday. Don't apply the adult discovery rule without a lawyer. When you give a California lawyer the treatment dates, include your child's age so they can explain which deadline applies.
How long will a medical malpractice claim take?
You can't tell how long a claim will take from its filing deadline. Once the lawyer has reviewed the records, ask what could affect progress and what work still remains. When reading reviews of several listed firms, you'll see concerns about delays or follow-up. Instead of counting on a promised completion date, agree on how you'll receive updates.
What should I do if a loved one died after medical care?
Have the treatment dates and any hospital correspondence ready to share with the lawyer when you decide to call. Among the listed firms addressing wrongful death, you'll find Bostwick & Associates and The Law Brothers. When speaking with a California lawyer, ask who can bring a claim and which deadline fits your circumstances. Even if a death followed treatment, that alone doesn't tell you whether a firm will accept the case.
Can I get help in a language other than English?
Among its languages, The Dominguez Firm lists Spanish and Portuguese. You'll also find Korean, Japanese, German, Italian and Catalan on its language list. Before the consultation, ask whether you can use your preferred language then and when discussing records or the fee agreement. Because the other firms don't identify languages here, check directly with them instead of assuming they don't offer language support.
