Your deadline: 2 years from when you found outRead the Ontario law guide

Each step in more detail
  1. First call

When you tell the lawyer what happened, explain when you first suspected the care caused harm. Ontario's basic limitation period runs for two years from discovery, including knowing that a lawsuit was appropriate. To understand how that rule applies, ask an Ontario lawyer.

  2. Review the records

If you have delivery or surgical notes, bring them with the chart. To help the lawyer assess the care, ask what else they need. Because appointing a litigation guardian affects whether the limitation periods run for a child, discuss whether one has been appointed if the claim involves a child.

  3. Start the claim

Before suing doctors, nurses or hospitals in Ontario, you don't need to give them pre-suit notice. To start the claim, you don't need an affidavit or certificate of merit. Ask what the statement of claim says about the allegations; the lawyer can explain that document.

  4. Serve medical reports

To meet the court's rules, expert reports on the standard of care and causation must be served. By explaining the expected care, those reports address whether a departure from it caused the injury. Before the lawyer gets those reports, ask how and who pays.

What a malpractice lawyer costs in Markham

  1. The first callOften free. Ask before you book.
  2. A written agreementThe share the lawyer takes, set out before work starts.
  3. If you recover moneyThe agreed share and the case costs come out of it.
  4. If the claim failsNo legal fee on a contingency agreement. Ask about costs.
Several firms on this list charge a contingency fee, taking a share of what's recovered; you won't pay a legal fee if the claim fails. Case costs aren't included. Those costs can cover medical records and medical opinions; court fees may be included too. Before signing, find out who advances those costs, including whether you'll owe them if nothing is recovered. Don't count on that coverage. Ask the lawyer to show you how they'd calculate the final bill, including their share and any other deductions. Ask for those terms in writing.

Seven of the eight firms describe their consultations as free. Six say their fees are contingency-based.

What to bring to your first call

  • Your chart and test results, with any other medical records you already have
  • Delivery or surgical notes, if they're relevant
  • When you received treatment, with dates, and when you first suspected something was wrong
  • Which hospitals were involved, along with the names of the doctors and nurses
  • Injury-related expenses shown in your bills and receipts
  • Letters you've received from the hospital or insurer
  • The injury shown in photos, including changes to it over time
  • What happened, briefly set out in your own words

Questions to ask a lawyer

  1. 1When you've handled claims, have any involved the kind of care that harmed my family member?
  2. 2If we hire you, who handles our file and talks with us?
  3. 3For our claim, what is the applicable limitation period?
  4. 4Before you decide whether to take the case, what records should we provide?
  5. 5To get the medical opinions this claim needs, what will you do?
  6. 6When calculating your contingency fee, what method do you use?
  7. 7If we recover nothing, who pays case costs?
  8. 8Before you advise us to proceed, what would you need to find out?

Choosing a malpractice lawyer for a Markham claim

When choosing a firm, start with the medical error you suspect, not its overall reputation. Discussing birth injury isn't the same as discussing delayed diagnosis. Ask what the lawyer would need to assess your claim, then how they've handled work involving the same kind of treatment. Don't count a published accident recovery as a malpractice result.

Use the first conversation well
  1. Ask who will handle the file

Find out which lawyer would review your chart, then ask their name and how they'd talk through the claim with you. Ask how often you'd hear from the firm, including who would answer your questions between meetings. People praise several firms here for their communication. Missed replies or delays also appear in some reviews.

  2. Discuss the medical review

Ontario doesn't require an affidavit or certificate of merit before you start a claim. In practice, the court's rules require you to serve expert reports on the standard of care and causation. Find out how the firm would assess both issues. Ask which records the firm wants, including delivery notes if you're making a birth injury enquiry.

  3. Clarify costs before signing

You'll find free consultations and contingency fees at several listed firms. Before anything else, ask what that free consultation covers. If a contingency arrangement interests you, ask the lawyer what payment depends on and how they'll work out the fee. Find out whether you'd owe other expenses, too. Not every firm uses the same terms, so check.

If the claim is a child's, look separately at its deadline. Until the child reaches 18, the two-year period doesn't run if there's no litigation guardian for the claim. If the claim arises while the claimant is a minor without a litigation guardian, the ultimate period is also suspended. Wong v. Lui, 2023 ONCA 272 explains how that works.

Treat any promise of a particular recovery as a red flag. If nobody can explain who'd be responsible for your file, ask for clarification, just as you should if the fees are still vague. You won't find most listed offices inside Markham. Ask about meeting arrangements. An Ontario lawyer can assess your situation; what's here is general information, not legal advice.

Questions people ask

Do I need a lawyer with an office in Markham?
You'll find a Markham office at Reyes Tam Law. You'll find other listed offices in Toronto or North York, with another office in Woodbridge. Before choosing, ask who'd handle your claim and how meetings would work, since listed distances from Markham range from 12 to 26 km. An office's location alone won't show whether they've handled the medical issue involved.
How long do I have to start a medical malpractice claim in Ontario?
Discovery starts the basic limitation period of two years. Don't count a fixed two years from treatment. Discovery requires that you know, or reasonably be expected to know, about the injury and the provider's contribution. You must meet that same test for knowing whether a lawsuit was appropriate. Because Ontario also has a 15-year ultimate period, ask an Ontario lawyer how both periods apply to your circumstances.
Does the same deadline apply to a child's birth injury claim?
If the claimant is under 18 without a litigation guardian for the claim, Ontario's two-year clock doesn't run. If a claim arises while the claimant is a minor without a litigation guardian, the 15-year ultimate period is also suspended. Wong v. Lui, 2023 ONCA 272 explains how that works. An Ontario lawyer can explain how it applies to the child's circumstances.
Do I need an expert report before starting a claim?
In Ontario, starting a medical malpractice claim doesn't require an affidavit or certificate of merit. But expert reports work differently. In practice, the court's rules require you to serve reports on the standard of care and causation. Have the firm explain how it'd review your chart and arrange that assessment; ask an Ontario lawyer what your claim requires.
Is there a cap on medical malpractice compensation in Ontario?
If you're claiming economic losses, such as lost income or future care, Ontario has no statutory cap. The national judge-made trilogy cap does limit non-pecuniary damages, so those work differently. Don't use published results from Neinstein Personal Injury Lawyers or Paul Cahill - Medical Malpractice Lawyer to predict what another claim is worth. Have an Ontario lawyer explain how the damages rules fit your losses.
Can I have a free consultation before deciding whether to hire a lawyer?
Seven firms on this list say they offer a free consultation, including Neinstein Personal Injury Lawyers and Campisi Law Injury Lawyers. Paul Cahill's consultation terms haven't been confirmed, so ask before booking. Later work is a separate matter. Request the proposed fee agreement before you decide; a free consultation doesn't tell you what that work will cost.
Do all the firms on this list offer contingency fees?
Six firms describe their fees as contingency-based. Because fee arrangements haven't been confirmed for Thomson Rogers LLP or Paul Cahill, ask them directly; don't assume they work on contingency or rule it out. If the claim fails under a contingency arrangement, you won't pay a legal fee; the lawyer's fee is a share of what's recovered. Ask who pays case costs, since those aren't included.
Must I notify the hospital before starting a lawsuit?
If you're bringing a medical malpractice claim against a hospital, doctor or nurse, Ontario doesn't require pre-suit notice. For those claims, you can sue without first sending a formal notice. You'll still have a filing deadline. To find out what you must file and how the rules apply to you, ask an Ontario lawyer. Don't treat this general information as legal advice.
Which firms list misdiagnosis among the claims they handle?
If you're looking at misdiagnosis claims, Paul Cahill and Thomson Rogers LLP list them among their practice areas; Bergel Magence LLP and Bogoroch & Associates LLP do too. You'll also find misdiagnosis listed by Reyes Tam Law and Diamond & Diamond Lawyers LLP. Use those listings to start your call. When you call, ask about claims involving the diagnosis and treatment that your family member's care involved.
