Choosing a Toronto lawyer for an HIE claim

First, find out which lawyer would handle your child's file. You can begin by reading the firm's HIE webpage. Have the lawyer explain their work on birth-injury claims. Ask how they'd assess the medical records. Published results can give you questions to ask. Your child's claim may differ; those results can't establish its strength or value.

Use the first conversation well
  1. Ask about the medical assessment

Who would review the delivery notes? Ask that, along with how the firm assesses standard of care and causation. You'll also want to ask about timing for expert reports. To start a claim in Ontario, you don't need an affidavit or certificate of merit. The court's rules do require service of expert reports on those issues.

  2. Set communication expectations

Find out who you'd usually contact. Ask how you'd receive updates as well. Clients praise clear communication at several firms on this list. Slow responses draw complaints at some firms, too. If intake stalls, ask directly whether the firm is still assessing your file or has declined it.

  3. Get the fee terms in writing

A free consultation may be offered; ask the firm what that meeting covers. Ask whether you'll pay for a later record review. Ask the firm how it calculates its contingency fee. You'll also need to know what payment depends on. Who pays for expert reports and other expenses if the claim doesn't succeed? Ask the lawyer to explain those costs.

The 2-year period doesn't run for a minor under 18 without a litigation guardian for the claim. The 15-year ultimate period is also suspended for a claim arising while the claimant is a minor without a litigation guardian, as addressed in Wong v. Lui, 2023 ONCA 272. This is general information, not legal advice. For your family's circumstances, ask a lawyer in Ontario how these rules apply.

  • Your child's outcome can't be predicted by a published settlement or verdict. Be cautious if someone presents a result that way.
  • You should know who's responsible for your file. If that or the fee agreement hasn't been clearly explained, ask for clarification.

Questions people ask

Which Toronto firm leads this HIE lawyer list?
Neinstein Personal Injury Lawyers ranks first. Its site covers HIE and publishes a $14 million birth-injury result alongside medical-negligence brain-injury results. Accessible lawyers and regular updates come up frequently in reviews. The firm handles many other injury matters, too. Ask who would lead your child's HIE file and how that lawyer would assess it.
How long do we have to start an HIE claim in Ontario?
Discovery starts the basic limitation period of 2 years. That includes knowledge of the injury and the provider's contribution, as well as whether a lawsuit was appropriate. For a claimant under 18, the period doesn't run if there's no litigation guardian for the claim. For minors in those circumstances, the ultimate period is suspended too. An Ontario lawyer can assess which dates apply to your family's situation.
Do we need an expert report before starting a claim?
Starting a medical-negligence claim in Ontario doesn't require you to file an affidavit or certificate of merit. In practice, you'll still need expert reports. The court's rules require service of reports that address standard of care and causation. The lawyer should explain how they'd review the delivery notes. Ask when they'd obtain those reports, too. Have them explain how the related expenses would be handled.
Which listed firms offer free consultations and contingency fees?
Neinstein Personal Injury Lawyers and Howie, Sacks & Henry LLP list both, as do Bogoroch & Associates LLP and VC Lawyers. Gluckstein Lawyers lists a free consultation; its contingency terms remain unconfirmed. Neither offering is confirmed for Paul Cahill - Medical Malpractice Lawyer. Before you agree to representation, get each firm's fee terms. You should also ask the firm what its consultation will cover.
Is there a cap on compensation for an HIE claim?
Economic losses aren't subject to a statutory cap in Ontario. These include future care costs or lost income. Non-pecuniary damages follow different rules. Nationally, these damages fall under a judge-made trilogy cap. You can't work out what another child's claim is worth from the other case results published on this list. For your child's needs, you can ask an Ontario lawyer how the damages rules apply.
