Questions about your own case?
How a malpractice claim usually moves in Ontario
  1. 1.Something went wrong

Write down dates and names while they're fresh.

  2. 2.Get your records

Ask for your full chart and test results.

  3. 3.Free case review

A lawyer looks at what happened, free.

  4. 4.Medical opinion

A doctor checks whether the care fell short.

  5. 5.Start the claim in time

Your lawyer starts the claim before the deadline.

  6. 6.Settlement or trial

Many claims settle. Some go to a judge or jury.

Your deadline: 2 years from when you found outRead the Ontario law guide

Each step in more detail
  1. Make the first call

When you tell the firm what happened, ask whether it handles claims like yours. You can call without an expert report. To start a claim in Ontario, you don't need an affidavit or certificate of merit.

  2. Check the limitation period

When you discover the claim, Ontario generally gives you two years to start it. You've discovered it when you know, or should reasonably know, about the injury and the provider's contribution, and whether a lawsuit was appropriate. Ask an Ontario lawyer to assess your dates.

  3. Address a child's deadline

If a child under 18 has no litigation guardian for the claim, the two-year period doesn't run. When a claim arises in those circumstances, the 15-year ultimate period is suspended too. Ask how the lawyer would apply these rules to your child.

  4. Start the claim

If you're claiming against a doctor, nurse or hospital in Ontario, you don't need to give pre-suit notice. To start a claim, you don't need an affidavit or certificate of merit in Ontario either. Ask what the lawyer says you must file before your limitation period runs out.

  5. Serve expert reports

You've started a claim, not proved it. When the case proceeds, expert reports must, in practice, be served under the court's rules. Those reports look at whether the care met the standard of care (the care expected), and whether it caused the injury (causation).

What a malpractice lawyer costs in Vaughan

  1. The first callOften free. Ask before you book.
  2. A written agreementThe share the lawyer takes, set out before work starts.
  3. If you recover moneyThe agreed share and the case costs come out of it.
  4. If the claim failsNo legal fee on a contingency agreement. Ask about costs.
If a claim succeeds, the lawyer takes a share of the recovery at Six firms on this list that say they work on contingency; otherwise, there's no lawyer's fee. There are separate costs. You may pay for medical records and medical opinions, along with court fees. Ask who advances those costs before you sign, and whether you'll owe them back if nothing is recovered. Even with a contingency arrangement, some expenses may fall outside it. Get the lawyer's share in writing, along with how case costs are handled and any payments you'd have to make.

Six of the seven firms offer a free consultation, and they say they work on contingency.

What to bring to your first call

  • Bring any medical records you already have, with your chart and delivery notes if they're relevant
  • Note when you had treatment and first learned about the injury
  • List the health care providers and hospitals involved by name
  • Write down what happened in a brief timeline
  • Gather your bills and records showing income you've lost
  • Bring any hospital or insurer letters or emails you have
  • Include photos you have if they're relevant to the injury

Questions to ask a lawyer

  1. 1If a claim involves an injury like our family's, do you handle it?
  2. 2Who would keep us updated while working on our claim?
  3. 3What's the limitation period for our situation?
  4. 4If we recover money, what share would your firm charge?
  5. 5While the claim is underway, who covers the records and medical opinions, as well as court fees?
  6. 6What would we owe if the claim fails?
  7. 7When you assess the care we received, how do you check whether it met the standard of care or caused the injury?

Choosing a malpractice lawyer for a Vaughan claim

Start with what happened medically. Then consider the firm. An alleged medication error calls for different questions than a birth injury claim. Let the care involved guide what you ask. Several firms listed here discuss those subjects on their sites. For other firms, medical malpractice is one part of a broader practice. Find out who'd read your medical chart. Ask that lawyer about past claims where the care was similar to yours.

Use the first conversation to test the fit
  1. Explain what happened

Write down what treatment you received. Add the date you first thought something had gone wrong. For records such as the chart or delivery notes, let the lawyer tell you what they want. You can get in touch before you've collected every document.

  2. Ask how the claim would be assessed

To start a claim in Ontario, you don't need an affidavit or certificate of merit. Court rules still require you to get expert reports. Those reports must address the standard of care. They also have to cover causation. Have the firm explain how it reviews the medical care. Have it explain any remaining uncertainty too.

  3. Separate results from promises

Neinstein Personal Injury Lawyers has published medical negligence results for you to read. The recoveries Campisi Law Injury Lawyers publishes concern accident claims. Check whether the care in that published result resembles yours. You can't treat an accident recovery as a malpractice result. A past recovery deserves caution when someone uses it to predict your case's outcome. That recovery isn't a prediction.

Get the fee terms before agreeing

You can have an initial discussion at a free consultation. Later work may cost you. Most firms here offer a free consultation; Hummingbird Lawyers LLP's arrangement isn't confirmed. Find out what the meeting covers before you attend, including any charge for further review. With a contingency arrangement, recovery determines the legal fee. Get the terms in writing. Discuss expenses separately, including what the expert reports would cost.

Look beyond the ratings alone. Updates often earn praise in client reviews. Other reviews describe poor intake or charges the clients didn't understand. Find out who'll answer your questions once the firm opens your file. Pressure to sign is a reason to pause and ask the firm to explain any agreement you don't understand. A prediction made before anyone reads the records deserves caution. Have them explain that certainty. This is general information, not legal advice.

Questions people ask

How long do I have to start a medical malpractice claim in Vaughan?
Discovery starts Ontario's basic limitation period: you have 2 years. The treatment day isn't necessarily when that clock starts. Discovery looks at your knowledge of the injury and the health care provider's contribution. It also asks what you could reasonably have been expected to know. Whether you knew a lawsuit was appropriate also matters to that assessment. There's also a 15-year ultimate period. Take your dates to an Ontario lawyer for an assessment of how the Limitations Act, 2002 applies to you.
Does the same deadline apply to a child's birth injury claim?
For a claimant under 18 who has no litigation guardian for the claim, the 2-year clock doesn't run. If the claim arises while the claimant is a minor without a litigation guardian, that also suspends the 15-year ultimate period. This issue is addressed in Wong v. Lui, 2023 ONCA 272. For your child's situation, an Ontario lawyer can explain whether those conditions apply.
Do I need an expert report before contacting a malpractice lawyer?
You can start an Ontario claim without an affidavit or certificate of merit. The court's rules still require you to serve expert reports. Those reports must cover causation as well as the standard of care. Have the lawyer explain their approach to the medical records at your first meeting. Ask how they'd arrange a review. Starting without a certificate doesn't remove the requirement for expert reports.
Are consultations with these firms free?
Free consultations and contingency fees are confirmed by every listed firm except Hummingbird Lawyers LLP. Neither arrangement is confirmed for Hummingbird. Find out what the free meeting covers before booking it. Concerns about fees and follow-up appear in some VC Lawyers reviews. Use those concerns to ask about the terms. Get the fee terms in writing. If the firm takes your claim, discuss the medical review expenses separately from the legal fee.
Which firms on this list cover birth injury claims?
Birth injuries appear on the sites of Neinstein Personal Injury Lawyers and Bergel Magence LLP ⚖️ Personal Injury Lawyers. VC Lawyers discusses birth injuries too. Among Neinstein's published results is a $14 million birth injury recovery. Cerebral palsy appears on all three sites. You'll also find Erb's palsy discussed on VC Lawyers' site. Ask who'd be responsible for your file. Have that lawyer describe past claims involving the specific injury.
Is there a cap on medical malpractice damages in Ontario?
Economic losses have no statutory cap. These include lost income or the cost of future care. For non-pecuniary damages, the rules differ. Across Canada, those damages are subject to the judge-made trilogy cap. It's tempting to compare your claim with a published total recovery. But that amount can't tell you what another claim is worth. An Ontario lawyer can explain how the damages rules apply to the losses you're alleging in your case.
Do I have to notify the hospital before starting a claim?
If you're bringing a medical malpractice claim against a hospital, doctor or nurse, Ontario doesn't require pre-suit notice. You still face a filing deadline. Speak with an Ontario lawyer about your treatment dates and when you discovered the claim before you decide when to act. This gives you general information, not legal advice about your situation.
Could I owe case costs if a contingency claim fails?
If a claim fails under a contingency arrangement, you won't owe a lawyer's fee. There are separate costs. Although Six firms on this list say they work on contingency, you can't tell who carries those costs from their listed fee information. Before anything is recovered, who pays for records and medical opinions, and would you have to repay those expenses if the claim recovers nothing? Before signing, make sure you have that answer in writing.
Which listed firms identify misdiagnosis or surgical error claims?
Among the practice areas Bergel Magence LLP lists, you'll find misdiagnosis and surgical error, along with medication error. You'll find broader medical malpractice listings from Campisi Law Injury Lawyers and Avanessy Giordano LLP, and from TMPI. You can use those descriptions to start a call. Whether a firm will take your case isn't confirmed there. When you explain the treatment involved, ask whether the firm handles claims like yours.
