Questions about your own case?
How a malpractice claim usually moves in Texas
  1. 1.Something went wrong

Write down dates and names while they're fresh.

  2. 2.Get your records

Ask for your full chart and test results.

  3. 3.Free case review

A lawyer looks at what happened, free.

  4. 4.Medical opinion

A doctor checks whether the care fell short.

  5. 5.Notice before suing

Some places need a notice before a claim.

  6. 6.File before the deadline

Your lawyer starts the claim before the deadline.

  7. 7.Settlement or trial

Many claims settle. Some go to a judge or jury.

Your deadline: 2 years from the treatmentRead the Texas law guide

Each step in more detail
  1. Check the dates

The lawyer checks when you were treated against Texas's filing rules. Most claims have a 2-year deadline, and Texas has no general discovery rule. If the patient is a child, let the lawyer know promptly.

  2. Review the medical care

Give the firm your chart while explaining what happened. How does the firm judge the care you received, and where does it get medical opinions? The firm reviews what happened to decide whether it can take your case, including which providers' care it needs to examine.

  3. File the claim

Talk about the filing deadline with the firm before it goes ahead with your case. The breach usually starts Texas's 2-year period, though the period may run from completion of treatment or hospitalization. Which date would your lawyer choose, and why?

  4. Serve expert reports

Texas gives you 120 days from each defendant's answer to provide an expert report and CV for that defendant. Missing the required report means dismissal with prejudice, along with fees. That dismissal prevents you from filing the claim again.

  5. Consider resolution

The listed firms publish settlements too, not just jury verdicts. Ask the lawyer how paying fees and expenses figures into the decision about a proposed resolution. Texas limits non-economic damages, with a separate inflation-indexed cap that covers total damages in death cases.

What a malpractice lawyer costs in Dallas

  1. The first callOften free. Ask before you book.
  2. A written agreementThe share the lawyer takes, set out before work starts.
  3. If you recover moneyThe agreed share and the case costs come out of it.
  4. If the claim failsNo legal fee on a contingency agreement. Ask about costs.
Several listed firms describe taking their fee from any money recovered under a contingency arrangement, so you won't owe an attorney fee if the claim fails. Expenses cost extra. Medical records and medical opinions can cost you money, as can court fees. Clients paid back litigation expenses from their gross settlements in the cases that Miller Weisbrod Olesky, Attorneys At Law disclosed. Who advances those costs, and does the firm deduct them before taking its attorney fee or afterward, under the agreement you're considering? Would you still owe anything without a recovery? Get written answers before you sign. A free consultation alone doesn't settle the terms for hiring the firm.

Six of the seven firms say you can consult them for free; five describe working on contingency.

What to bring to your first call

  • When treatment occurred and the date hospitalization ended
  • Which doctors and nurses were involved, and the hospitals' names
  • Your existing records, including delivery notes if they apply
  • Your prescription records, with the medications' names
  • Records of related expenses, including your medical bills
  • Letters and messages from the hospital or insurer
  • Photos showing the injury, if you have any
  • Your main concerns and a short timeline in writing

Questions to ask a lawyer

  1. 1Does your case history include this treatment or injury?
  2. 2Before you decide whether to take my case, who reviews my records?
  3. 3Which lawyer would handle my file if I hire you?
  4. 4What do you do to obtain Texas's required expert reports?
  5. 5How much time do I have to file?
  6. 6How would I pay your attorney fee and the case expenses?
  7. 7If we recover nothing, will I still owe expenses?
  8. 8Who will answer when I ask for an update, and how will I hear back?

Choose for your medical issue, then check the working relationship

Begin by considering the treatment that worries you. If it's a delivery injury, the questions differ from those about a prescription error. While Hastings Law Firm and Van Wey & Metzler focus their practices on malpractice, several other firms here take these cases within broader injury practices. Instead of judging the firm's overall injury record, ask about cases that involved a medical issue like yours.

Use the first conversation to test the fit
  1. Describe what happened

When you explain the injury briefly, give the lawyer your treatment dates and the provider's name. Say which records you have. If the injury happened during delivery, point out any delivery notes you can share, then ask what other records the firm needs.

  2. Ask who reviews the case

When you share your account, ask whether an attorney reviews it and who examines your medical records. Also ask how medical opinions reach the firm. Before agreeing to representation, discuss how the firm meets Texas's requirement for an expert report for each defendant in your case.

  3. Agree on communication

Ask how you'll receive updates and who you'll regularly contact at the firm. Reviews for several listed firms describe calls that went unanswered. Even with a favorable rating, you won't know whether you'll talk to the lawyer handling your file or to an intake team.

Keep the consultation separate from the fee agreement. You won't pay a consultation charge to discuss a possible case if the firm offers that meeting for free. The firm still hasn't agreed to take your case. The lawyer's fee comes out of any money you recover under a contingency arrangement, with no attorney fee if the claim fails. Which expenses will you owe?

  • Who pays for records and medical opinions while your claim is pending, and will you have to cover court fees?
  • Will you owe expenses without a recovery, and can you get that in writing?
  • Is that published figure a verdict or settlement, an attorney fee or net client payment, and what does its label say?

Be wary of anyone promising a recovery, especially if they push you to sign before they've explained the fees. A large verdict in another case doesn't tell you what your claim might recover. Don't treat this as advice about your case. How would the filing rules and damage caps affect your case, according to a Texas lawyer?

Questions people ask

How soon should I contact a Dallas malpractice lawyer?
Don't put off calling. Call even without all your records. Under Texas's filing statute, most claims must be filed within 2 years of the breach or completion of treatment or hospitalization. No general discovery rule gives you extra time under Texas law. Have a Texas lawyer check your dates to work out which one applies.
Does Texas's 10-year outer limit give me more time to file?
You still face the usual deadline. Most malpractice claims have a 2-year filing deadline, even though the Texas statute also sets a 10-year outer limit known as a statute of repose. Have a Texas lawyer compare both deadlines with the dates of your treatment. Waiting for that outer limit could leave you too late to meet the ordinary deadline.
Can I speak to a lawyer without paying for the consultation?
You can consult Six listed firms for free. You won't pay for a consultation at Hastings Law Firm, Anderson Injury Lawyers, Frenkel Firm, Miller Weisbrod Olesky, Attorneys At Law, Morgan & Morgan, or Bailey & Galyen Attorneys at Law. What will that free consultation cover, when you call? A free meeting doesn't commit the firm to taking your case, nor does it mean the firm will pay the expenses your case incurs.
What does a contingency fee mean for my family?
The lawyer takes a share of any money you recover under a contingency arrangement, so a failed claim leaves you with no attorney fee. Five listed firms describe using this fee arrangement. Expenses are separate. Find out who'll pay for medical opinions and records before you agree, including whether you'd have to repay those costs without a recovery. Before signing, read the agreement.
What does Texas require from a medical expert?
Texas gives you 120 days from each defendant's answer to submit an expert report for that defendant, along with the expert's CV. You'll find the expert's professional background in the CV. Missing the required report brings dismissal with prejudice, as well as fees. How does the firm get those reports, and what does it do to track each defendant's deadline?
How long will a malpractice claim take?
One estimate can't tell every family how long they'll wait. The settlements and jury verdicts these firms publish don't tell you how long you'll wait for your own claim to reach a conclusion. Ask the firm about its next steps after it reviews your records and files your claim. Each defendant's answer starts the 120-day expert-report clock, not the day you first call.
Are the deadlines different when the patient is a child?
If a child is under 12, Texas states the deadline is the fourteenth birthday. The 2-year rule otherwise applies, whatever the patient's age. Don't assume you can wait until your child becomes an adult. When you give a Texas lawyer the child's birth date and treatment dates, ask how those rules apply to the child's claim.
What if my loved one died after medical treatment?
Give the lawyer the treatment dates and any records you have when you explain that your loved one died. Texas limits total damages in death cases through a separate cap that's indexed for inflation. Several listed firms handle wrongful-death cases, and you can read a fatal malpractice result published by Bailey & Galyen Attorneys at Law. How do those rules affect your family's case, and can a Texas lawyer walk you through them?
Can a firm's published recovery tell me what my case is worth?
Published results don't tell you what you might recover. Some figures published by Miller Weisbrod Olesky, Attorneys At Law represent attorney fees or reimbursed expenses, so read the labels carefully. Bailey & Galyen Attorneys at Law labels its published fatal malpractice result as the amount net to the client. Texas also limits what you can recover in non-economic damages for health care liability claims. Have a lawyer explain what those rules would mean for your possible claim.
