Choosing an HIE lawyer in Mississauga

Start by asking who would take on your child's file. You may see HIE listed on a firm's site. The listing alone doesn't tell you how often the firm handles these claims. Have the lawyer describe birth-injury cases they've handled. Have the lawyer explain how they'd assess whether the care caused or contributed to your child's injury. A published award gives you a specific case to discuss with the lawyer. Your family's outcome can't be predicted from that award.

Use the first conversation well
  1. Discuss the records

When discussing records, ask about the delivery notes and your child's chart. Those records may not suffice. Find out which additional records the firm needs, then ask how it would get them. Before the lawyer gives a view on the claim, have them explain what they still don't know.

  2. Identify the person responsible

Find out who makes decisions about your file. Reviews about slow intake responses or case-handling concerns give you a reason to ask who'll answer your questions. If the firm declined your case, what happened next would matter; ask it to explain.

  3. Ask about expert reports

You don't need an affidavit or certificate of merit to start an Ontario claim. The court's rules still require you to serve expert reports in practice. Those reports address the standard of care and causation. You'll want to know how the firm arranges those reports. Have it explain the costs, too.

Neinstein Personal Injury Lawyers, Sommers Roth & Elmaleh and Howie, Sacks & Henry LLP offer free consultations and contingency fees. At Gluckstein Lawyers, the consultation is free, but you'll need to check the contingency arrangement. You'll need to check both with Davidson Cahill Morrison LLP. The firm may decline your case even after a free consultation. You'll want to read the proposed fee agreement. Have the lawyer explain when payment is due and how it's calculated, then ask who pays expenses if the claim doesn't succeed.

Treat pressure to sign as a warning sign if fees haven't been explained. Another family's settlement isn't a sound basis for promises about yours. Reviews can tell you about the firm's communication. They can't tell you whether negligence caused the HIE. This is general information. It isn't legal advice. The Ontario law guide sets out the framework. For your child, ask an Ontario lawyer how the limitation rules apply.

Questions people ask

Which firm leads this Mississauga HIE lawyer list?
Neinstein Personal Injury Lawyers comes first on this list. The firm publishes a $14 million birth-injury result on its site. Several medical-negligence brain-injury results appear there, too. HIE appears on the site, too. Clients frequently praise communication and responsiveness in reviews. Next comes Sommers Roth & Elmaleh. Its practice is limited to malpractice. A published award concerns severe hypoxic ischemic injury during birth. Ask each firm which lawyer would assess the claim involving your child.
How long do we have to start an HIE claim in Ontario?
In Ontario, discovery starts the basic limitation period of 2 years. Treatment isn't always what starts that clock. Discovery depends on what you knew, or reasonably should have known: that you were injured and that a provider caused or contributed to the injury. You must also know that a lawsuit was appropriate. There's also a 15-year ultimate limitation period. Ask an Ontario lawyer to check your dates. The rules for minors may matter; that lawyer can explain whether they apply.
Does the limitation period run while my child is under 18?
The 2-year clock pauses for a claimant under 18 who doesn't have a litigation guardian for the claim. The 15-year ultimate period is likewise suspended for a claim arising while the claimant is a minor without a litigation guardian, as addressed in Wong v. Lui, 2023 ONCA 272. Another child's deadline may differ from yours, so don't use it to calculate when to file. An Ontario lawyer can tell you how those conditions affect your child's claim.
Can we speak to one of these firms without paying for a consultation?
Free consultations are offered by Neinstein Personal Injury Lawyers, Sommers Roth & Elmaleh, Howie, Sacks & Henry LLP and Gluckstein Lawyers. You'll need to check consultation charges at Davidson Cahill Morrison LLP. Contingency fees are also offered by the first three. At the other two, you'll need to check the arrangements. You'll want to know what's covered. Get the lawyer's explanation of fees and expenses before you agree to representation.
Do we need an expert report before starting an Ontario HIE lawsuit?
To start a claim in Ontario, you don't need an affidavit or certificate of merit. Expert evidence is still needed. In practice, reports on the standard of care and causation must be served under the court's rules. Have the lawyer explain how they'd assess those issues for your child. Then discuss who would cover the report costs. Being able to file without a certificate doesn't tell you whether the claim might succeed.
Is compensation for an HIE injury capped in Ontario?
Economic losses have no statutory cap. These include lost income or the cost of future care. Nationally, non-pecuniary damages are limited by the judge-made trilogy cap. The results on this list won't tell you what your child's claim might be worth. Each belongs to a particular case. Ask an Ontario lawyer which losses may be claimed and how the cap applies to your circumstances.
