Choosing an HIE lawyer for a Brampton family

Start by asking which lawyer would actually handle your claim. A firm's HIE page can help, but you'll still need to ask who'll review the delivery notes or explain whether the care caused the injury. None of these firms has a listed office in Brampton. How would consultations and the later meetings work for your family?

Use the first conversation to test the fit
  1. Ask about related files

Ask about the lawyer's past HIE or birth-injury claims and what they're able to share about those cases. Neinstein Personal Injury Lawyers publishes birth-injury results, as does Paul Cahill - Medical Malpractice Lawyer. Talk about those results, rather than using them to forecast your child's recovery.

  2. Discuss the medical review

Ask which records (including delivery notes) the lawyer wants to examine, then how they'd obtain medical opinions. Starting an Ontario claim doesn't require an affidavit or certificate of merit. In practice, you must serve expert reports addressing the standard of care and causation under the court's rules.

  3. Agree on communication

Find out how you'll get updates, including who'll answer your questions. Several firms earn praise because clients get updates. Because some also face complaints about missed follow-up, ask what you'd hear if the firm declines your case, especially with a limitation period approaching.

Get the fee arrangement in writing

If the consultation's free, you can discuss the case without a consultation charge. That doesn't make later work free. If a firm offers contingency fees, have it explain the calculation and what payment depends on. Check for separately charged expenses. Ask the firm to write down what you could owe if the claim fails. Neinstein Personal Injury Lawyers has both options listed. You'll find both at Bogoroch & Associates LLP and Diamond & Diamond Lawyers LLP.

If someone promises a result or won't explain the fee agreement, be cautious. Before you sign, get clarification. The Ontario guide explains the regional rules; what's here is general information, not legal advice.

Questions people ask

Do these HIE lawyers have offices in Brampton?
You won't find a listed Brampton office for these firms. Neinstein Personal Injury Lawyers' Toronto office is 30 km away; Paul Cahill - Medical Malpractice Lawyer, Gluckstein Lawyers and Bogoroch & Associates LLP are in Toronto, 31 km away. You'll find Diamond & Diamond Lawyers LLP's office in North York, 36 km from Brampton. Before you retain a firm, ask how you'd meet.
How long do I have to start an HIE claim in Ontario?
Ontario's basic limitation period allows two years, starting at discovery. You know, or reasonably should know, that an injury occurred and a health care provider's act or omission caused it or contributed to it. You also need to know, or reasonably should know, that a lawsuit was appropriate. A 15-year ultimate limitation period also applies. An Ontario lawyer can check which dates and rules affect your child's claim.
Does the limitation period run while my child is under 18?
If the claimant is under 18 without a litigation guardian for the claim, the two-year period doesn't run. The 15-year ultimate period is also suspended if a claim arises while a minor has no litigation guardian, as addressed in Wong v. Lui, 2023 ONCA 272. Age alone doesn't tell you the deadline. Have an Ontario lawyer explain how the rule applies to your child.
Do I need a medical expert report before starting a claim?
Starting a medical-malpractice claim in Ontario doesn't require an affidavit or certificate of merit. In practice, the court's rules require service of expert reports on the standard of care and causation. Have the lawyer explain how they'd arrange that review. Even without a certificate, you'll need to address those medical issues, so ask what that work would cost.
Is there a cap on compensation for an HIE claim?
Economic losses such as future care or lost income aren't statutorily capped in Ontario. Non-pecuniary damages have a national judge-made trilogy cap. Another claim's value doesn't follow from published results. Even Neinstein Personal Injury Lawyers' $14 million birth-injury result and Paul Cahill - Medical Malpractice Lawyer's $11.5 million jury verdict don't set that value. Ask an Ontario lawyer how your child's circumstances fit the damages rules.
