Your deadline: 2 years from when you found outRead the Ontario law guide

Each step in more detail
  1. Check the limitation period

First, check your deadline. You generally have two years from discovery to bring a claim in Ontario. When you know about the injury and its connection to the provider's conduct, discovery also depends on knowing whether a lawsuit was appropriate. After a death, a lawyer can assess how this rule applies.

  2. Review the care

For the lawyer's review, bring the hospital chart with a timeline you've written. When you explain which treatment you believe contributed to the death, ask whether the firm handles claims about that kind of care. A missed diagnosis or surgical error would be examples.

  3. Start the claim

If your Ontario claim is against a doctor, nurse or hospital, you don't need to give pre-suit notice. Starting a claim doesn't require you to provide an affidavit or certificate of merit, either. Because the statement of claim sets out the allegations, ask the lawyer to explain what goes in it.

  4. Serve medical opinions

Under the court's rules, expert reports have to be served. To address the standard of care, these reports explain what care was expected in the circumstances. In addressing causation, they consider whether the alleged failure caused the injury or contributed to it. How will the lawyer assess those issues? Ask.

What a malpractice lawyer costs in Oakville

  1. The first callOften free. Ask before you book.
  2. A written agreementThe share the lawyer takes, set out before work starts.
  3. If you recover moneyThe agreed share and the case costs come out of it.
  4. If the claim failsNo legal fee on a contingency agreement. Ask about costs.
Six firms on this list say they work on contingency, so the lawyer takes a share of any recovery but isn't paid if the claim fails. Insist on written terms. When you discuss case costs separately, cover medical records and medical opinions as well as the court fees. Those expenses aren't necessarily covered by the fee agreement. While the claim proceeds, will the firm carry the costs, and when would you have to pay them back? If the claim fails, what would you owe? Ask the lawyer before you sign how they'd take their fee and expenses out of any money recovered.

According to all nine firms, consultations don't cost anything. Six also offer contingency work, they say.

What to bring to your first call

  • Any medical records you already have, plus the hospital chart
  • The date of death, plus treatment dates
  • The hospitals involved and the names of the doctors and nurses
  • What happened, set out in a brief written timeline
  • Care-related bills, along with any receipts
  • Letters you've received from the hospital or insurer
  • Photos, if you think they'd help explain what happened

Questions to ask a lawyer

  1. 1Does your work include wrongful death claims about this kind of care?
  2. 2Whose job would reviewing the hospital chart and medical opinions be?
  3. 3If I contact the firm, who would I speak with?
  4. 4For our family, how would you work out the limitation period?
  5. 5Under your contingency agreement, how would your fee work?
  6. 6While the claim proceeds, who covers the case costs? If it fails, what would we owe?
  7. 7To assess whether the care contributed to the death, what would you need?

Choosing a wrongful death lawyer serving Oakville

Rather than the firm's overall rating, start with what happened. If medical negligence concerns you, ask whether the firm has handled claims involving that treatment or care setting. What a surgical injury result tells you differs from what a fatal hospital negligence claim would show. Although a published award records a past result, it can't predict what your family might recover.

Ask who will do the work

  • Which person would review the medical records? Who's the lawyer responsible for keeping your file on track?
  • If you suspect a particular error, has that lawyer handled wrongful death claims involving it? Without disclosing confidential details, what examples can they discuss with you?
  • When it needs expert opinions on the standard of care and causation, how will the firm obtain them? To start an Ontario claim, you don't need an affidavit or certificate of merit. The court's rules still require the parties to serve expert reports.
  • Would you meet locally? Because most firms listed here have offices outside Oakville, check where they'd do the work. Meetings aren't necessarily going to be local.

When you bring any medical records you already have, include a clear account of what happened. Point out which dates concern you. If your family heard an explanation that differs from the chart, show the lawyer the mismatch and ask what other records they need to look at.

Get the fee arrangement in writing

You can get a free consultation at every firm listed here. If the firm would consider your claim, ask how it would charge you should you retain it. Although several firms list contingency fees, that arrangement hasn't been confirmed for the other firms. Which payments depend on a recovery is worth checking. Because a free first discussion doesn't reveal every later cost, ask how the firm calculates its fee, then who pays expenses such as expert reports.

If someone promises a particular recovery or pushes you to sign before you understand the fees, be wary. Communication problems may show up in reviews. Because reviews don't show how a lawyer will handle your case, ask what happens if intake takes longer than expected, then check whether the firm has agreed to act. Treat this as general information, not legal advice.

Questions people ask

How long do I have to start a medical negligence claim after a death in Oakville?
Once a claim is discovered, Ontario's basic limitation period runs for two years. The date of death isn't necessarily when it starts. Discovery occurs when you know, or could reasonably be expected to know, about the injury and the health care provider's contribution, and that a lawsuit would be an appropriate way to proceed. There's also a 15-year ultimate period under the Limitations Act. To assess the dates that matter for your claim, ask an Ontario lawyer.
Do I need an expert report before contacting a lawyer?
To start an Ontario claim, you don't need an affidavit or certificate of merit. When the claim proceeds, though, the court's rules require expert reports on the standard of care and causation to be served. Before proceeding, ask how the lawyer would get those opinions, then who would pay. Although there's no filing certificate, someone still needs to assess the medical evidence to determine whether it supports the claim you want to bring.
Can I meet a wrongful death lawyer in Oakville?
The office Kanevsky Law Office lists is in Oakville. Outside the city, you'll find Ross & McBride - Personal Injury Lawyers in Hamilton; Martin & Hillyer Associates is in Burlington, and other firms here also have offices outside Oakville. Where does the lawyer assigned to you work? Because an office address doesn't tell you who would handle your claim, check where you'd actually meet the lawyer too.
Are consultations free, and do these firms offer contingency fees?
You can get a free consultation at every firm on this list. Although several list contingency fees, including Neinstein Personal Injury Lawyers and Kanevsky Law Office, that kind of fee arrangement hasn't been confirmed for every firm. When you consult the firm, ask whether it's interested in your case and clarify what you'd pay. Before you retain anyone, ask for written terms explaining how the firm calculates its fees and deals with expenses.
Is there a cap on damages in Ontario?
For economic losses, such as lost income or future care, Ontario doesn't impose a statutory cap. Nationally, non-pecuniary damages are limited by a judge-made trilogy cap. You can't use either rule to determine what a particular wrongful death claim is worth or which losses your family can claim. Because the firms' published injury results aren't estimates for your case, ask an Ontario lawyer how the damages rules would apply.
Does the two-year limitation period apply if a claimant is a child?
While a claimant is under 18 and has no litigation guardian for the claim, the two-year period doesn't run. If a claim arises while the claimant is a minor without a litigation guardian, the 15-year ultimate period is also suspended, as addressed in Wong v. Lui, 2023 ONCA 272. You shouldn't take that to mean every family member has more time to claim. To assess each claimant's position, speak with an Ontario lawyer.
Do we have to notify the hospital before starting a claim?
If you're bringing a medical negligence claim against a hospital, doctor or nurse, Ontario doesn't require pre-suit notice. Starting the lawsuit doesn't require you to send the provider a formal notice beforehand. You still face a limitation period. Given the circumstances of the death, an Ontario lawyer can explain to your family which filing rules apply and how they work.
How can we compare firms for the type of care involved?
When you ask a firm about similar claims, start with the treatment involved. Among the practice areas listed by Bogoroch & Associates LLP are misdiagnosis and surgical error. Nursing home neglect appears on Howie, Sacks & Henry LLP's list; medication error appears on Gluckstein Lawyers' list. When you call, those practice areas give you somewhere to start. How a firm would assess your family's claim isn't something those lists tell you.
