    Paul Cahill

Best for: Families seeking malpractice trial experience

Paul Cahill - Medical Malpractice Lawyer has published an $11.5 million jury verdict for a child born with cerebral palsy, plus a trial it won against an emergency room physician over a mother's death. Those results put the firm at the top of this list, but they don't tell you what your misdiagnosis claim might achieve. The practice handles a lot of medical negligence work, with delayed diagnosis and emergency care covered on its site.

Questions about your own case?
How a malpractice claim usually moves in Ontario
  1. 1.Something went wrong

Write down dates and names while they're fresh.

  2. 2.Get your records

Ask for your full chart and test results.

  3. 3.Free case review

A lawyer looks at what happened, free.

  4. 4.Medical opinion

A doctor checks whether the care fell short.

  5. 5.Start the claim in time

Your lawyer starts the claim before the deadline.

  6. 6.Settlement or trial

Many claims settle. Some go to a judge or jury.

Your deadline: 2 years from when you found outRead the Ontario law guide

Each step in more detail
  1. First call and deadline check

When you explain what happened, tell the lawyer when you learned about the injury. If a claimant is under 18 and has no litigation guardian for the claim, Ontario's two-year limitation period pauses. Ask an Ontario lawyer how those rules apply to your family's situation.

  2. Review the medical records

When you meet, bring your records and a written timeline. To assess the alleged diagnostic error, which records does the lawyer need? Ask whether the information available shows how the provider cared for you and how that care connects to the injury.

  3. Start the claim

Once you discover a claim, Ontario generally gives you two years to start it. You discover it when you know, or reasonably should know, about the injury and the provider's contribution, and that a lawsuit is appropriate. For claims against doctors, nurses or hospitals, pre-suit notice isn't needed. You don't need a certificate of merit either.

  4. Serve medical reports

When a claim proceeds, the court's rules require you to serve expert reports on the standard of care and causation. These reports explain what care the provider should have given, then address whether something they did or didn't do caused or contributed to the injury. Who arranges those reports, and who pays?

  5. Assess the claimed losses

Your claim's value depends on the losses you're claiming. If you've lost income or need future care, Ontario has no statutory cap on those economic losses. When losses aren't financial, non-pecuniary damages cover them, subject to a national cap set by judges.

What a malpractice lawyer costs in Brampton

  1. The first callOften free. Ask before you book.
  2. A written agreementThe share the lawyer takes, set out before work starts.
  3. If you recover moneyThe agreed share and the case costs come out of it.
  4. If the claim failsNo legal fee on a contingency agreement. Ask about costs.
If you recover money, several firms on this list take a share as their contingency fee; there's no legal fee if your claim fails. Expenses come separately. You may need to pay for medical records and opinions, plus court fees. If your claim fails, don't assume the firm will cover those costs or waive them. Ask who pays upfront and when repayment is due before you sign. When there's a recovery, how does the firm deduct expenses? Before signing, get the fee calculation in writing, including what you'd owe if your claim fails. Even with a free consultation, representation isn't free.

Six of the eight firms, they say, offer a free consultation. Contingency fees are available at Five, they say.

What to bring to your first call

  • Any medical records already in your hands, with test results and notes about the diagnosis
  • When your appointments took place and when you learned about the possible diagnostic error
  • Which doctors and nurses were involved, with the names of their hospitals
  • What happened, written as a brief timeline
  • Bills you've received and records of lost income
  • Letters you've received from the hospital or insurer
  • If you have photos relating to the injury, those too

Questions to ask a lawyer

  1. 1How would you work out whether my injury was caused or worsened by the diagnostic error?
  2. 2In my situation, what's the applicable limitation period?
  3. 3With misdiagnosis claims like mine, what experience have you had?
  4. 4If you take my file, who handles it and updates me?
  5. 5If you offer contingency fees, how do you work out the fee?
  6. 6When records and medical opinions are needed, who pays upfront, including for court fees?
  7. 7If my claim fails or I end our agreement, what would I owe?
  8. 8For my claim, which medical reports are needed?

Choosing a misdiagnosis lawyer in Brampton

Begin by describing the missed diagnosis. Tell the lawyer your diagnosis, including which symptoms brought you to seek care. Then describe the point when you realised something was wrong. Find out who would assess the claim. If you use general injury work or strong reviews to judge a firm's service, still ask separately which delayed-diagnosis files it has handled.

Use the first conversation well
  1. Prepare a short chronology

Note when your diagnosis changed, along with your appointments. Find out which records the lawyer needs (the chart or test reports, for example). Stick to what happened. Whether the care was negligent isn't something you have to decide for yourself.

  2. Ask about the medical assessment

You can start an Ontario claim without an affidavit or certificate of merit. You'll still need to serve expert reports on the standard of care and causation under the court's rules, which means asking how the firm would obtain those opinions. Also ask how the firm would decide whether the delay played a part in your injury.

  3. Set communication expectations

Once the file opens, find out who'll answer your questions and how the office will share developments. Because several firms here have communication complaints alongside positive feedback, it's worth asking more closely about follow-up. If the office declines a case, ask how it's handled.

Get the fee terms in writing

You can get a free consultation at several firms here. Check what's covered in the meeting. If the firm offers contingency fees, find out when you'd owe a fee and how the lawyer calculates it, then check whether reviewing your records would cost extra. Get written terms for expenses, making sure they include the cost of expert reports. If your claim doesn't succeed or you end the retainer, ask what you could owe.

A birth injury verdict can't predict what your delayed-diagnosis claim is worth, so be wary when someone promises an outcome based on another client's result. Before you sign, ask again if you haven't understood an explanation. Most offices here are outside Brampton, but Anushika Anthony Prof. Corp. (AAPC Lawyers) has a Brampton office, so confirm where you'd meet.

Questions people ask

How long do I have to start a misdiagnosis claim in Brampton?
You generally have two years from discovery in Ontario. Your appointment date doesn't automatically set the clock running. Discovery includes knowing, or reasonably being expected to know, that you were injured and the provider contributed to it, as well as that a lawsuit was appropriate. A 15-year ultimate period also applies under the Limitations Act, 2002. Ask an Ontario lawyer to review your dates, including any exceptions that may apply.
Do I need a medical expert's report before starting a claim?
You don't need an affidavit or certificate of merit before starting an Ontario medical negligence claim. You'll still have to serve expert reports under the court's rules, with opinions on the standard of care and causation. Because filing without a certificate doesn't remove the need to address those medical issues, ask how the lawyer would review the missed diagnosis and get the necessary opinions.
Are there misdiagnosis lawyers with an office in Brampton?
Anushika Anthony Prof. Corp. (AAPC Lawyers) has a Brampton office and lists misdiagnosis on its site. Nanda & Associate Lawyers is in Mississauga, 10 km from Brampton. Most other firms on this list have Toronto offices; Diamond & Diamond Lawyers LLP's listed office is in North York. Ask where your meetings would take place and who would handle the file.
Does the two-year deadline apply to a child's delayed diagnosis?
If a claimant is under 18 with no litigation guardian for the claim, the two-year period doesn't run. When a claim arises while the claimant is a minor without a litigation guardian, the 15-year ultimate period is suspended too. Wong v. Lui, 2023 ONCA 272 deals with that rule. Ask an Ontario lawyer what your child's circumstances mean for the date you must file.
Is compensation for a misdiagnosis claim capped in Ontario?
Ontario doesn't put a statutory cap on economic losses, which include lost income or future care. Although the judge-made trilogy cap limits non-pecuniary damages nationally, it can't tell you what any particular claim is worth. Rather than using a published verdict on this list to predict your claim, ask an Ontario lawyer how they'd assess your injury and its financial effects.
Do I have to notify the hospital before starting a claim?
If you're starting this kind of claim against doctors, nurses or hospitals in Ontario, you don't have to notify them first because Ontario doesn't require pre-suit notice. You still face a filing deadline. This gives general information, not legal advice. Ask an Ontario lawyer how the notice and limitation rules apply when your claim involves the particular people or institutions in your situation.
Does a free consultation mean the firm will take my case on contingency?
No. Even if a consultation is free, contingency fees are a separate arrangement. If you contact Gluckstein Lawyers or Thomson Rogers LLP for their free consultations, ask about each firm's fee terms. You can get both free consultations and contingency fees from Neinstein Medical Malpractice Lawyers, Bogoroch & Associates LLP, Diamond & Diamond Lawyers LLP and AAPC Lawyers. Ask whether those terms apply to your claim before hiring a firm, including which expenses you'd have to pay yourself.
How can I compare the firms' practice areas?
When you check this list, you'll find every firm names misdiagnosis as a practice area. Other listed practice areas aren't identical. Alongside stroke and hypoglycemic injury at Neinstein Medical Malpractice Lawyers, you'll find dental malpractice listed at AAPC Lawyers. Real estate and immigration also appear among Nanda & Associate Lawyers' listed areas. When you make your first call, use those differences as a starting point and ask how much experience the lawyer handling your file has with that injury.
How much weight should I give Google ratings?
When comparing firms, give ratings only part of the weight. With 168 and 300 reviews respectively, Gluckstein Lawyers and Thomson Rogers LLP each have a Google rating of 4.8. You can't tell from those numbers how either firm would assess your claim. Ask who would handle your file before deciding, including what work that lawyer has done on misdiagnosis cases. What's in the fee agreement?
