Questions about your own case?

Many claims settle. Some go to a judge or jury.

Your deadline: 2 years from when you found outRead the Ontario law guide

Each step in more detail
  1. Check the limitation period

Before anything else, review the dates with an Ontario lawyer. Once discovery occurs, the basic limitation period is two years. To discover a claim, you must know that a provider's act or omission contributed to the injury and that a lawsuit was appropriate.

  2. Gather the records

When you bring your records, include a written account of what happened. Which delivery notes or other hospital records does the lawyer need to review? If there are gaps, flag them rather than guessing what happened.

  3. Agree on fees

Before hiring the firm, ask it to put its fee terms in writing. If you're considering one of the several firms here offering contingency arrangements, clarify who pays for records and medical opinions. If the claim fails, what would you owe?

  4. Start the claim

If you're claiming against doctors, nurses or hospitals in Ontario, you don't need to give pre-suit notice. You can start without a certificate of merit. If the injured child has no litigation guardian, ask a lawyer about that when discussing how the limitation rules apply.

  5. Serve medical reports

In practice, the court's rules require parties to serve expert reports. Those reports examine whether the care met the standard of care (the care expected), and whether it caused the injury, which is causation. How will the lawyer arrange those reports?

What a malpractice lawyer costs in Brampton

  1. The first callOften free. Ask before you book.
  2. A written agreementThe share the lawyer takes, set out before work starts.
  3. If you recover moneyThe agreed share and the case costs come out of it.
  4. If the claim failsNo legal fee on a contingency agreement. Ask about costs.
If you recover money, several firms on this list offer contingency fees that give the lawyer a share; there's no legal fee if the claim fails. Case costs aren't included. You may still have to pay for records and medical opinions, plus court fees. Before signing, ask who puts up that money and whether you'd owe those costs if you recover nothing. A contingency arrangement doesn't necessarily cover those costs. Ask what calculation sets the firm's share, including any other charges you'd pay. Will they review your records during the free consultation? Ask for written answers, too.

You can get a free first consultation at Seven of the eight firms, they say. Contingency fees are available at Five, they say.

What to bring to your first call

  • Delivery notes and any other medical records you have
  • Dates of treatment, plus when you first learned about the injury
  • Names of the hospitals involved, along with the doctors and nurses
  • What happened, set out in a brief timeline
  • Care-related bills, along with your receipts
  • Letters you've received from the hospital or insurer
  • Photos for the lawyer to look over
  • Documents naming someone as a litigation guardian for your child

Questions to ask a lawyer

  1. 1Who would take on our child's claim at your firm?
  2. 2Have you handled claims involving birth injuries?
  3. 3Does the first consultation cost anything? What's included in it?
  4. 4What calculation sets your contingency fee?
  5. 5If we recover nothing, who pays the case costs?
  6. 6What records of the care would you need to review?
  7. 7How would you get the medical reports needed for our claim?
  8. 8How do Ontario's limitation rules affect our child, and what about any litigation guardian?

Choosing a birth injury lawyer in Brampton

Who would actually handle your claim at the firm? A firm's birth injury page is only a starting point; ask the lawyer how they'd work out what happened during delivery in your case. When they explain how they'd arrange expert review, ask which records they'd need, including the chart and delivery notes. You don't have to decide whether there was negligence before calling the firm.

  • Ask about claims involving your child's injury, not just whether the lawyer does general personal injury work. HIE or cerebral palsy comes up on several listed firms' sites.
  • Check that the published result concerns a birth injury. The birth injury outcomes come from Neinstein Personal Injury Lawyers and Paul Cahill - Medical Malpractice Lawyer, not Campisi Law Injury Lawyers, whose listed results concern other injuries.
  • When you ask who'll answer your questions, also check how often you'll hear from them. Some reviewers of listed firms report waiting for intake or not getting follow-up.
  • Could you meet them nearby? Hillier & Hillier Personal Injury Lawyers has an office in Brampton, whereas you'll need to look outside the city for the other listed offices.

Get the fee terms in writing

You can get free consultations and contingency fees from several firms listed here. Find out what that free meeting covers, including whether record reviews or an expert opinion would cost you anything. Ask whether the lawyer is paid only if you recover money before you agree to a contingency arrangement. If the claim doesn't succeed, who pays expenses, and how would the firm calculate the fee? Don't assume another firm's fee arrangement applies when you can't find its fee details.

Starting an Ontario claim doesn't require an affidavit or certificate of merit. The court's rules still require you to serve expert reports addressing the standard of care and causation. How would the firm arrange for those reports to be prepared? Be wary of anyone who promises you a particular payout. Request clear answers if the firm won't explain its fees or say who's responsible for updates. This is general information, not legal advice for you.

Questions people ask

Do I need a birth injury lawyer with an office in Brampton?
Birth injury experience doesn't follow from a lawyer's office address alone. You'll find Hillier & Hillier Personal Injury Lawyers' office in Brampton, whereas Campisi Law Injury Lawyers has its office in Woodbridge. You'll find the remaining listed offices in Toronto or North York. Before you choose by distance alone, ask where you could meet and who would handle your claim, then compare the lawyer's work on relevant files.
How long do we have to start a birth injury claim in Ontario?
Discovery starts the basic limitation period, which runs for two years. The period doesn't run for a minor under 18 without a litigation guardian for that claim. Wong v. Lui, 2023 ONCA 272 addresses the 15-year ultimate period; that clock also doesn't run for a claim arising while the claimant is a minor without a litigation guardian. When an Ontario lawyer reviews your family's dates, ask them to consider what happened too.
Which firms on this list publish birth injury results?
The published $14 million result from Neinstein Personal Injury Lawyers involves medical negligence that caused a birth injury. Paul Cahill - Medical Malpractice Lawyer's published results include an $11.5 million jury verdict for a child born with cerebral palsy. Neither outcome tells you what another family's claim might be worth. When you speak with a prospective lawyer, ask what makes that case similar to or different from your child's.
Do we need an expert report before starting an Ontario claim?
Starting a medical malpractice claim in Ontario doesn't require an affidavit or a certificate of merit. You'll have to serve expert reports on the standard of care and causation, though, because the court's rules require them. When the lawyer explains how they'd review the delivery records, ask how they'd arrange expert review. An Ontario lawyer can explain what you'd need for your particular claim.
Is there a cap on compensation for a child's future care?
Ontario doesn't set a statutory cap on economic losses, which include future care costs or lost income. Non-pecuniary damages fall under the judge-made trilogy's nationwide cap. Don't lump them together. A published total doesn't show you how much of the result covered care costs. An Ontario lawyer can explain how the damages rules apply to your child's circumstances; you aren't asking them to promise a recovery.
Do we have to notify the hospital before starting a claim?
If you're bringing a malpractice claim against doctors, nurses or hospitals, Ontario doesn't require pre-suit notice. You still face a filing deadline. When you have your first call, bring any hospital correspondence and ask an Ontario lawyer which steps you need to take in your situation. Treat this as general information, not legal advice.
Can we ask for Punjabi support when discussing a birth injury claim?
For birth injury claims with Punjabi support, this list includes Neinstein Personal Injury Lawyers. If you'd like to discuss the delivery notes in Punjabi, ask what that support covers before you book a consultation. You can also ask about the free consultation and contingency fees the firm says it offers. What are the terms?
How should we use the Google ratings on this list?
When you look at the ratings, treat them as information, not predictions about your child's claim. You can't tell which reviews concern birth injuries from the ratings and review counts here. Who would handle your file, and what claims have they handled involving the care at issue? A rating can't answer those questions; you'll need to ask the lawyer.
Which firms list cerebral palsy among their practice areas?
If you're looking for cerebral palsy practice areas, Neinstein Personal Injury Lawyers and Thomson Rogers LLP list them. Birth injury appears on both firms' lists; each also says the first consultation is free. Use that to start a call, not to assess your child's claim. How would they review the medical records to work out whether the care caused or contributed to the injury? Ask them.
