Your deadline: 2 years from when you found outRead the Ontario law guide

Each step in more detail
  1. Check the deadline

When you speak with the lawyer, explain when you learned of the injury and its possible link to your care. Discovery determines Ontario's two-year limitation period, including when it was appropriate to sue. Until a minor has a litigation guardian, the clock doesn't run.

  2. Review the records

Bring a written timeline with your chart and test results. As you discuss what the provider did or missed, explain how it may have caused harm. To assess those issues, which medical opinions does the lawyer need?

  3. Start the claim

Talk about filing within the applicable limitation period if you decide to proceed. Before suing doctors, nurses or hospitals in Ontario, you don't need pre-suit notice. Neither an affidavit nor a certificate of merit is needed to start the claim.

  4. Serve expert reports

When the claim proceeds, the court's rules require you to serve expert reports addressing the standard of care and causation. Those reports explain what care was needed, then consider whether the alleged failure caused the injury. How will the lawyer get that work done?

What a malpractice lawyer costs in Mississauga

  1. The first callOften free. Ask before you book.
  2. A written agreementThe share the lawyer takes, set out before work starts.
  3. If you recover moneyThe agreed share and the case costs come out of it.
  4. If the claim failsNo legal fee on a contingency agreement. Ask about costs.
If you recover money, several listed firms take a share as their fee; if the claim fails, they charge no legal fee under their contingency arrangements. Case costs aren't included. Medical records and medical opinions may still cost you money, and court fees can apply too. Ask who advances those expenses before you sign, and who pays them if you recover nothing. You can't assume the firm pays. Ask how the lawyer's share is calculated and if you'll face any other charges. Although a free consultation lets you discuss the claim, you still need to check what the fee agreement says.

Six of the eight listed firms describe their consultations as free. Five offer contingency work, according to their listings.

What to bring to your first call

  • Test results and diagnostic reports, as part of your medical records
  • When your appointments and symptoms occurred, plus the date you received the eventual diagnosis
  • Which doctors and nurses were involved, with their names and the hospitals' names
  • What happened, set out in a written timeline with when you learned something had gone wrong
  • Records of income you lost after the injury, plus bills
  • What the hospital or insurer sent by letter or email
  • How the injury looks or affects you, shown in photos
  • The child's date of birth, with details of any litigation guardian if the claim is a child's

Questions to ask a lawyer

  1. 1When a diagnosis like this was missed, have you handled claims?
  2. 2Who would my family talk with, and who handles my file?
  3. 3How do you figure out which limitation period applies to my claim?
  4. 4Which medical opinions help you assess whether harm came from the missed diagnosis?
  5. 5Is a contingency agreement available, and what determines the share you take?
  6. 6If the claim fails, what would I owe, and who advances case expenses?
  7. 7As my claim moves forward, how will I hear from you?

Choosing a misdiagnosis lawyer in Mississauga

The missed diagnosis in your case is a better starting point than the firm's overall rating. What claims has the lawyer handled for your condition that involved a delay like yours? You can find published pregnancy-related missed diagnosis results at Sommers Roth & Elmaleh; other firms list neurological injuries or emergency room care among their areas. If a published result came from a different medical setting, it may tell you less about your own claim.

Find out who will assess the chart

  • Who would review your medical chart and explain whether the delay caused or contributed to your injury?
  • Who prepares the firm's expert reports on the standard of care and causation? Although you can start an Ontario claim without an affidavit or certificate of merit, the court's rules still require you to serve expert reports in practice.
  • When you have questions, find out who'll answer them and how you'll get updates. Find out what happens next if the firm declines your case.

The office's location is worth checking too. Several listed offices are in Toronto rather than Mississauga. Can the first discussion happen remotely, and would you still need to travel for later meetings? A broad-practice firm such as Nanda & Associate Lawyers may have reviews about unrelated work, so ask about the lawyer's diagnosis-claim experience instead of relying on those reviews.

Get the fee terms in writing

A free consultation means you won't pay for that first conversation with the firm. The firm still hasn't agreed to take your case. The listings for Sommers Roth & Elmaleh and Neinstein Medical Malpractice Lawyers include free consultations as well as contingency fees. Does the contingency agreement cover all your costs? Don't assume those expenses are all included: ask who pays for medical records or expert reports and how the fee is calculated. If fee details are missing, ask for them before booking a consultation.

If a firm promises you'll recover a particular amount, be wary. Your result isn't something published verdicts can predict. Ask the firm directly whether it's taking your case if your messages keep going unanswered and a deadline could be near. This is general information, not legal advice for you.

Questions people ask

How long do I have to start a misdiagnosis claim in Mississauga?
You generally have two years to start an Ontario claim after you've discovered it. You've discovered the claim when you know you were injured and a health care provider contributed to it, or when you reasonably ought to know. You'll also need to ask: was a lawsuit appropriate? There's also a 15-year ultimate period for claims under the Limitations Act. An Ontario lawyer can check whether a suspension applies to your dates.
Do I need an expert report before starting an Ontario malpractice claim?
You can start an Ontario claim without first getting an affidavit or certificate of merit. The court's rules still require you, in practice, to serve expert reports addressing the standard of care and causation. Even though you don't need an initial certificate, ask how the lawyer would review your medical chart and arrange those reports to check whether the provider's conduct caused your injury.
Which listed lawyers have offices in Mississauga?
You'll find offices for Sommers Roth & Elmaleh and Nanda & Associate Lawyers in Mississauga. The other offices listed are in Toronto, 23 or 24 km from Mississauga. You still need to find out who'll handle your file, whatever the office address. Before you book, ask who would assess the missed diagnosis and whether you'd still need to travel later if you meet remotely at first.
Does the deadline work differently for a child's missed diagnosis?
Yes. If someone under 18 has no litigation guardian for the claim, Ontario's two-year limitation period doesn't run. The 15-year ultimate period doesn't run either if a minor has no litigation guardian when the claim arises, as Wong v. Lui, 2023 ONCA 272 discusses. Your child's situation may change the deadline for starting a claim, so ask an Ontario lawyer.
Is there a cap on compensation for an Ontario misdiagnosis claim?
There's no statutory cap in Ontario on economic losses such as lost income or future care. The trilogy cap is the national limit judges have set for non-pecuniary damages. You can't swap them. A firm's published recovery doesn't tell you what another claim is worth. An Ontario lawyer can explain which category your losses belong in.
How much weight should I give Google reviews when choosing a lawyer?
Use the reviews to ask how the firm communicates with clients and treats them. Reviews don't prove a firm's malpractice results. Some of the many reviews for Nanda & Associate Lawyers come from clients discussing real estate work. Although clients praise communication at several other listed firms, some say they didn't get follow-up. When you ask about that lawyer's diagnosis-claim experience, ask how you'll get updates too.
Do I have to notify the doctor or hospital before starting a claim?
Before suing doctors, nurses or hospitals for malpractice in Ontario, you don't need pre-suit notice. You still have a filing deadline. Go over your treatment and discovery dates with an Ontario lawyer before deciding when you need to act. The lawyer can explain how these rules apply to you, but this general information isn't legal advice.
Which listed firms say they offer contingency fees?
Sommers Roth & Elmaleh, Howie, Sacks & Henry LLP, Neinstein Medical Malpractice Lawyers, Bogoroch & Associates LLP and Nanda & Associate Lawyers say you can pay their legal fees on contingency. Would each firm take your claim on those terms? Ask before proceeding. Check that the agreement explains how the lawyer's share is calculated, along with who pays the case expenses.
Does a free consultation mean the whole case is free?
You won't necessarily get later work free just because the consultation is free. Although Gluckstein Lawyers and Thomson Rogers LLP say consultations are free, their contingency terms haven't been confirmed. Sommers Roth & Elmaleh, Howie, Sacks & Henry LLP, Neinstein Medical Malpractice Lawyers and Bogoroch & Associates LLP say both free consultations and contingency fees are available. Ask for the proposed fee agreement before hiring a lawyer, and get them to explain what the case expenses cover.
