Choose around the operation and the deadline

Start with your surgery. Tell the lawyer which procedure you had, then explain when you first began to suspect that something had gone wrong. Ask whether they'd want the operative report or anaesthesia chart, for example, before they begin reviewing your records. Although a firm lists surgical errors, that's only a starting point; you'll need to ask what work it's done involving an operation like yours.

Ask about the work, not only the result

  • Before proceeding, ask who would assess your claim and remain responsible for it. If you meet a lawyer, would they handle your file?
  • Find out whether that lawyer has handled your procedure. Although birth-injury verdicts show medical-negligence work, they won't answer every question you have when your injury involves a different operation.
  • Before proceeding, ask how the firm would get expert reports addressing the standard of care and causation. To start a claim in Ontario, you don't need an affidavit or certificate of merit. Under the court's rules, you must still serve expert reports.
  • Find out how often the firm would contact you. If your main contact isn't available, ask what happens and who would answer your calls.

Location deserves a look, too. While Sommers Roth & Elmaleh and Gluckstein Lawyers have offices in Mississauga, the other offices listed here are in Toronto. Ask where you'd meet before you decide whether travelling there would work for you.

Get the payment terms in writing

For free consultations and contingency fees, Sommers Roth & Elmaleh and Bogoroch & Associates LLP list both options. You can also get free consultations at Thomson Rogers LLP and Gluckstein Lawyers. Although the first discussion is free, representation isn't. If you're considering contingency fees, ask what percentage applies and how the outcome affects what you pay. Expenses need a separate question, too. Before committing, ask for the agreement in writing.

Questions people ask

How long do I have to start a surgical-error claim in Mississauga?
Once discovery occurs, Ontario generally gives you two years. Discovery happens when you know, or reasonably ought to know, that you're injured, that the health care provider contributed to the injury, and that a lawsuit would be appropriate. There's also a 15-year ultimate period under the Limitations Act, 2002. Knowing the surgery date isn't enough to establish the deadline. To assess your circumstances, speak with an Ontario lawyer.
Do I need an expert report before starting an Ontario malpractice claim?
To start the claim in Ontario, you don't need an affidavit or certificate of merit. Under the court's rules, you'll still need to serve expert reports addressing the standard of care and causation. Before proceeding, ask how the firm would review your surgical care and get those reports prepared. To learn what that process requires in your case, speak with a lawyer.
Which listed firms have offices in Mississauga?
You'll find Mississauga offices for Sommers Roth & Elmaleh and Gluckstein Lawyers. From Mississauga, the Toronto offices listed by Paul Cahill - Medical Malpractice Lawyer and Thomson Rogers LLP are 24 km away. At 23 km away, Bogoroch & Associates LLP's office is in Toronto. Before deciding whether that works for you, find out where you'd meet the lawyer who would be responsible for your claim.
Does Ontario limit compensation in a surgical-error claim?
For economic losses such as lost income or future care, Ontario doesn't set a statutory cap. Nationally, non-pecuniary damages are limited by a judge-made trilogy cap. You can't work out your claim's worth from either rule. Nor can the firms' published awards forecast it. To understand which losses may matter in your circumstances, speak with an Ontario lawyer.
Is the deadline different if a child was injured during surgery?
While the claimant is under 18 and has no litigation guardian for the claim, Ontario's two-year period doesn't run. If a claim arises while a minor has no litigation guardian, the 15-year ultimate period is also suspended, as addressed in Wong v. Lui, 2023 ONCA 272. Age alone isn't enough to rely on. To assess the child's circumstances, speak with a lawyer.
