Questions about your own case?
How a malpractice claim usually moves in Louisiana
  1. 1.Something went wrong

Write down dates and names while they're fresh.

  2. 2.Get your records

Ask for your full chart and test results.

  3. 3.Free case review

A lawyer looks at what happened, free.

  4. 4.Medical opinion

A doctor checks whether the care fell short.

  5. 5.Notice before suing

Some places need a notice before a claim.

  6. 6.File before the deadline

Your lawyer starts the claim before the deadline.

  7. 7.Settlement or trial

Many claims settle. Some go to a judge or jury.

Your deadline: 1 year from the treatmentRead the Louisiana law guide

Each step in more detail
  1. Initial review and deadline check

Tell the lawyer when you discovered the possible error as you explain what happened. Louisiana generally allows 1 year from the act or discovery to file, but you can't go beyond 3 years after the act. Have the lawyer check where your dates fall within those limits.

  2. Records and medical assessment

Which records will help the lawyer assess what happened during your care and the injury? Bring any relevant delivery notes or surgical records you already have with you. Ask who will get any missing records, then find out how you'd pay for the medical opinions.

  3. Medical review panel

Louisiana uses a medical review panel, so you don't need an affidavit of merit. The filing period pauses when you request a panel. Ask your lawyer what you'll need before requesting the panel, including how that request changes the deadline for filing your claim.

  4. Complaint and case preparation

If your claim goes to court, ask the lawyer to explain the complaint (the document that starts the court case). Ask who will keep you updated as the case moves along, including what other medical information the lawyer will need.

  5. Resolution and recovery questions

Discuss any proposed settlement with your lawyer, including what it would mean to go to trial. Louisiana's cap on total damages applies to qualified health care providers, but it doesn't include future medical care. Ask whether the cap covers your claim before estimating a recovery, then discuss what fees and expenses would take out of it.

What a malpractice lawyer costs in Baton Rouge

  1. The first callOften free. Ask before you book.
  2. A written agreementThe share the lawyer takes, set out before work starts.
  3. If you recover moneyThe agreed share and the case costs come out of it.
  4. If the claim failsNo legal fee on a contingency agreement. Ask about costs.
Several listed firms offer contingency fees: the lawyer takes a share of any recovery, with no lawyer's fee charged if your claim fails. Case expenses are still separate. You may still have expenses even without a lawyer's fee, since obtaining medical records and medical opinions can cost money, as can court fees. Ask whether the firm advances those costs and when it deducts them before you hire it. Could you owe those costs even if there's no recovery? All listed firms offer a consultation at no charge. Don't sign anything with the firm until you have a written explanation of its fee and who pays expenses.

Your first consultation won't cost anything, according to each of the seven firms listed here. Five also say they offer contingency fees.

What to bring to your first call

  • Your treatment dates and when you discovered the possible error, in a written timeline
  • Whatever medical records you have, with any delivery notes or surgical notes
  • Which doctors and nurses were involved, by name, and which hospitals provided care
  • Discharge instructions and information about the medications involved
  • Bills for medical care, plus details of expenses the injury caused
  • Letters you've received from the hospital or insurer
  • Photos related to the injury, if you have any
  • How the injury changed your daily life, described in notes

Questions to ask a lawyer

  1. 1For this kind of care, have you handled malpractice claims?
  2. 2Which lawyer would you assign to work on my file?
  3. 3When must I file, given the dates I've provided?
  4. 4How would my claim be affected by the medical review panel?
  5. 5Which person would review the medical records I provide?
  6. 6What would paying your fee and case expenses involve for me?
  7. 7Would I still have expenses to pay if my claim brings no recovery?
  8. 8Who would I contact to find out what's happening?

Choose around your medical problem

Rather than starting with the firm's overall rating, begin with what happened during your care. If a diagnosis was missed, your questions will differ from those about a surgical injury or delivery problem. On several firms' sites, you'll find these subjects discussed. When asking about similar care, find out who would review your chart.

If a result is published, you have a specific case to discuss. Among Laborde Earles' results are a guide wire case and a medical negligence death. In Locke Meredith, Sean Fagan & Associates' account of a child's amputation case, no recovery amount is given. Rather than malpractice, Mansfield Melancon's listed settlement concerns an injury suffered by a plant worker. Your recovery can't be predicted from any.

Put the filing clock ahead of comparison shopping

Even with a later diagnosis, your time isn't unlimited. When speaking with the lawyer, give your treatment dates and explain when you first learned something might be wrong, then ask what must be filed and when. Instead of an affidavit of merit (the preliminary medical statement required in some other states), Louisiana uses a medical review panel.

Use the consultation to test the working relationship

  • Ask who will answer routine questions while handling your file. Even if the intake call feels reassuring, it doesn't show how later communication will work.
  • When discussing costs, separate case expenses from the lawyer's fees. If the claim fails, what happens to record and medical opinion costs, and who pays for them?
  • When reading reviews, watch for communication patterns. Rozas Injury Law and Dudley DeBosier both have some negative comments about follow-up, but general injury reviews don't tell you about their malpractice experience.
  • Ask what happened in any published case. The dollar amount won't tell you how much that case has in common with yours unless you know the medical issue.

Every firm on this list offers a free consultation. A firm hasn't agreed to take your case just because you've spoken with someone there for an initial review without a consultation charge. Several firms say they charge contingency fees, which means the lawyer gets paid if there's a recovery. Ask for written terms before you sign anything.

Be cautious about anyone who promises a payout or a definite finish date. You should get clear answers to your questions about the deadline and fee agreement. This is general information, not legal advice. A Louisiana lawyer can explain which rules apply to what happened to your family.

Questions people ask

How long do I have to file a malpractice claim in Baton Rouge?
To meet Louisiana's deadline, file within 1 year of the act or neglect, or within 1 year of discovery. Once 3 years have passed after the act, you can't file. If you request a medical review panel, the period is suspended. Rather than calculating the deadline from memory, ask a Louisiana lawyer to review when you received treatment and discovered the possible error.
Does my child have more time to bring a claim?
Being a child doesn't give someone a longer deadline. Louisiana's 1-year and 3-year limits apply to children's malpractice claims, too. If you're worried about care during delivery or a later injury, get in touch with a Louisiana lawyer promptly. Bring the lawyer your relevant dates and whatever records you have now, without waiting until you've gathered everything else.
Can I speak with a lawyer without paying for the first consultation?
All seven firms listed here say they won't charge you for a consultation. Five also say they offer contingency fees: the lawyer gets a share of any recovery, with no lawyer's fee charged if your claim fails. Ask about expenses separately, though. Before you hire the firm, ask what the consultation covers and have it put the fee terms in writing.
Do I need an affidavit of merit in Louisiana?
Louisiana doesn't require you to get an affidavit of merit. You'll use the state's medical review panel process instead. Some other states require an affidavit of merit, which is a preliminary medical statement. Ask a Louisiana lawyer to explain what the panel process would involve for your claim. Find out what records you'll need before requesting a panel, including how the request affects your filing deadline.
How long will a malpractice case take?
You can't count on knowing exactly when the case will finish. Louisiana's filing deadlines set the time you have to act, not the date when your case will be over. Ask your lawyer what might happen after the medical review panel as you discuss how that process works. Be wary of a promised finish date when you talk with the firm about how it'll keep you updated.
What should I do before calling a Baton Rouge malpractice lawyer?
Write down when you learned about the possible error as you list your treatment dates. Gather the names of the people involved in your care to go with the records and bills you have. The file doesn't need to look polished. Have the lawyer check your filing deadline promptly and tell you what else you'll need to give them.
Does Louisiana limit malpractice compensation?
Louisiana's cap on total damages applies to qualified health care providers, with economic and non-economic losses both counting toward the limit. The cap doesn't cover future medical care. Economic losses mean financial harm; suffering is one kind of harm that counts as a non-economic loss. Ask a Louisiana lawyer whether the provider qualifies for the cap so you can understand what it means for the losses you're claiming.
Which listed firms discuss birth injury cases?
On their sites, Laborde Earles and Rozas Injury Law list birth injury; Dudley DeBosier covers birth injury along with HIE. That's somewhere to start. A website's mention of birth injury doesn't tell you whether the firm has handled your child's particular condition. Ask who would read the delivery notes as you discuss comparable cases. Being a minor doesn't extend a child's filing deadline.
What if my loved one died after medical treatment?
Several firms on this list say their practices include wrongful death claims. Laborde Earles publishes a $500,000 result for a death from medical negligence, but that amount doesn't tell you what another family might recover in its own case. Ask a Louisiana lawyer who can bring a claim after a death, including how long they have to file it. Bring any hospital correspondence you already have to that conversation, along with the dates of treatment.
