Your deadline: 2 years from the treatmentRead the Alabama law guide

Each step in more detail
  1. Discuss the injury and dates

Start by telling the lawyer what happened and when. Before waiting for records or another medical appointment, ask an Alabama lawyer to assess your deadline, since Alabama generally allows 2 years from the act or omission that caused the injury.

  2. Review the care

As you review the chart, discuss the treatment you believe caused harm. What medical review would the lawyer seek, and what would it cost? Although Alabama doesn't require an affidavit or certificate of merit, that doesn't by itself show whether your claim has support.

  3. Decide whether to proceed

Whether to accept your claim is up to the firm. Read the fee agreement and discuss who pays case expenses if it offers representation. Settle who will handle the file and how you'll get updates before you sign.

  4. Prepare and file the complaint

Under Alabama's rules, each alleged act or omission must be described specifically and in detail in the complaint. When asking your lawyer about the filing deadline, include the discovery rule or the separate rule for children.

  5. Address the claim and possible resolution

After filing, how would the lawyer develop your claim, and how might it be resolved? Discuss that. Compensatory damages aren't capped in Alabama medical malpractice cases. If the case involves wrongful death, the jury awards only punitive damages.

What a malpractice lawyer costs in Birmingham

  1. The first callOften free. Ask before you book.
  2. A written agreementThe share the lawyer takes, set out before work starts.
  3. If you recover moneyThe agreed share and the case costs come out of it.
  4. If the claim failsNo legal fee on a contingency agreement. Ask about costs.
When the several listed firms that say they work on contingency recover money, the lawyer takes a share; if the claim fails, there's no lawyer's fee. You can consult every firm for free. Expenses aren't the lawyer's fee. Along with court fees, those expenses can include what it costs to obtain records and medical opinions. You can't tell who pays those expenses from the firms' stated terms. If there's no recovery, would you have to repay expenses the firm advances? Ask about both points. Get the fee share in writing before signing. What would expenses leave for you? Have the lawyer explain how that amount would change.

According to all seven firms on this list, their consultations are free. Contingency work is stated by four.

What to bring to your first call

  • When you received treatment and when you first learned of the injury
  • Which doctors and hospital were involved, along with the names of other providers
  • Any medical records you have (delivery notes too, if they're relevant)
  • What happened, written as a brief timeline
  • Bills for your medical care, with related payment records
  • Letters or messages you've received from the hospital or insurer
  • Photos showing the injury, if helpful
  • If a child is involved in the claim, your child's birth date

Questions to ask a lawyer

  1. 1When you've handled claims, have they involved the medical problem I'm facing?
  2. 2Who would be the attorney handling my file?
  3. 3For my case, what do you think the filing deadline is?
  4. 4To assess my claim, what records or medical opinions would you need?
  5. 5Who should I contact, and how would I get updates?
  6. 6If there's a recovery, how do you calculate your fee?
  7. 7If my claim fails, what might I owe, and who pays case expenses?
  8. 8On your published malpractice results, did the lawyer who would handle my file do any work?

Choose around your injury, not a headline result

What happened during your care is the starting point. If an injury happened during delivery, the conversation differs from one about a missed cancer diagnosis. While Morgan & Morgan describes a delayed C-section case, Heninger Garrison Davis, LLC publishes misdiagnosis results. Before discussing the lawyer's work on a similar claim, ask who actually handled it. You won't get that answer from a large traffic or grocery-store injury recovery.

Put the filing clock near the top of the conversation

Under Alabama's general rule, you must file within 2 years of the act or omission that caused the injury. You have 6 months from discovery if you couldn't reasonably have discovered the injury in that period, subject to a 4-year outer limit. Your diagnosis isn't necessarily what starts the clock. When you speak with the lawyer, give your treatment dates and explain when you first learned something might be wrong.

Get clear answers about the working relationship

  • Who will speak with you after reviewing your medical records? Find that out. Don't assume your file will go to the attorney featured in a published case.
  • How will the firm update you? Agree on that. Although several listed firms receive praise for communication, Morgan & Morgan and Alexander Shunnarah reviews include complaints about unanswered messages.
  • Before relying on a published result, check whether it involved medical treatment in Alabama. A case description still gives you something to discuss without a dollar amount, although you'll learn less about the outcome.

You can consult every listed firm for free. Although that gives you time to discuss fit and costs, it isn't a promise that the firm will accept your claim. Because several also say they work on contingency, their lawyer's fee depends on a recovery. Are records and medical opinions separate costs, along with court fees? Ask about that. If the claim fails, what could you owe, and who pays those costs initially?

If someone promises a recovery or won't explain the fee agreement, be wary. Before you sign, get readable terms. When filing in Alabama, the complaint (the document that starts the lawsuit) must describe each alleged act or omission specifically and in detail. What information does the lawyer still need from you? Ask them to explain.

Questions people ask

How long do I have to file a medical malpractice claim in Birmingham?
From the act or omission that caused the injury, Alabama generally allows you 2 years to file. You have 6 months from discovery if you couldn't reasonably have discovered the injury during that period, but no more than 4 years after the act. To find out how those rules fit your dates, ask an Alabama lawyer. Consult the Alabama guide.
Can I speak with a lawyer without paying for the consultation?
According to each of the seven listed firms, you can consult them for free. Without paying a consultation fee, you can ask about representation and discuss what happened during your care. They don't promise acceptance. Because a free consultation doesn't make every later expense free, ask separately what the lawyer charges and what you'll pay for the case's costs.
What does a contingency fee mean?
When there's a recovery, a contingency fee gives the lawyer a share. There's no lawyer's fee if the claim fails. Along with Morgan & Morgan and Alexander Shunnarah, Monge & Associates and Farris Riley Injury Law say they work on contingency. Before relying on that, get the exact terms in writing, including whether case expenses must be repaid if there's no recovery.
What does an Alabama malpractice complaint need to say?
In Alabama, an affidavit or certificate of merit isn't required. Even so, each alleged act or omission must be described specifically and in detail in the complaint. So the lawyer can discuss what happened, bring the records you already have and your treatment dates. Ask what further medical review would be needed before deciding whether to file.
Does my child have longer to file?
Your child's age when the injury happened determines the answer. Although tolling for minors cannot extend the deadline beyond 4 years after the act, a child injured before age 4 has until the eighth birthday to file. If you're assuming adulthood is the deadline, don't wait on that basis. To assess your child's filing deadline, speak with an Alabama lawyer.
What changes if a loved one died because of medical care?
When someone dies, Alabama differs from other states: juries can award only punitive damages in wrongful-death cases. Wrongful-death work appears on several listed firms' sites. While Heninger Garrison Davis, LLC lists a baby's wrongful death during delivery, Cory Watson Attorneys publishes a $9 million medical malpractice wrongful-death verdict. To understand how the rules fit your family's circumstances, talk with an Alabama lawyer.
Is there a cap on medical malpractice damages in Alabama?
In Alabama medical malpractice cases, compensatory damages aren't subject to a cap. If the claim involves wrongful death, only punitive damages are available. You can't estimate your claim's recovery from another family's verdict. Before putting a value on your claim based on a published result, ask a lawyer what damages could apply to your situation.
How long will a malpractice claim take?
You can't tell from Alabama's filing rules how long resolving a claim will take. Nor can you get a reliable timetable for your case from these firms' published results. What could slow progress, and what needs to happen next? Ask about that. While the firm evaluates or pursues your claim, how will the lawyer update you? Agree on that.
What should I do before calling a Birmingham malpractice lawyer?
When did treatment happen, and when did you discover the injury? Write that down. Along with your bills and hospital messages, gather the records you already have. When you meet for a free consultation, ask what else the firm needs. Ask early about the filing deadline. You don't need to assume every document must be collected before you speak with a lawyer.
