The short answer

Because of its published cerebral palsy and birth injury results, The Brad Hendricks Law Firm comes first on this list. When you call, ask who would handle your claim. You'll also want to ask how the firm charges for medical opinions and other case costs. Before you wait, read the Arkansas malpractice rules: the filing clock generally starts with the wrongful act, rather than your discovery of the injury.

Questions about your own case?
How a malpractice claim usually moves in Arkansas
  1. 1.Something went wrong

Write down dates and names while they're fresh.

  2. 2.Get your records

Ask for your full chart and test results.

  3. 3.Free case review

  5. 5.File before the deadline

Your lawyer starts the claim before the deadline.

  6. 6.Settlement or trial

Many claims settle. Some go to a judge or jury.

Your deadline: 2 years from the treatmentRead the Arkansas law guide

Each step in more detail
  1. Check the deadline

When you contact the lawyer, give the date of the care you believe harmed you. Rather than discovery, Arkansas generally counts 2 years from the wrongful act. If a child was hurt, different rules apply, with a separate deadline for childbirth injuries.

  2. Review the records

Before deciding whether to take your claim, the lawyer reviews your chart and your account of what happened. When you're asked to agree to proceed, find out which medical opinions are needed and who would pay for them.

  3. Prepare and file the complaint

To start your lawsuit, you file a court document called the complaint. Because the Arkansas Supreme Court struck down the former 30-day affidavit requirement in Summerville v. Thrower in 2007, Arkansas doesn't require an affidavit of merit.

  4. Develop the case

Once the complaint is filed, the lawyer gathers records and medical opinions to support its allegations. Find out what you're still missing and how updates will reach you. Even after a complaint is filed, that alone doesn't establish that malpractice occurred.

  5. Consider resolution

Whether through settlement discussions or trial, your claim may move toward a resolution. If a resolution is proposed, ask the lawyer to explain it, including what remains after fees and costs. In Arkansas medical malpractice cases, damages aren't subject to caps.

What a malpractice lawyer costs in Little Rock

  1. The first callOften free. Ask before you book.
  2. A written agreementThe share the lawyer takes, set out before work starts.
  3. If you recover moneyThe agreed share and the case costs come out of it.
  4. If the claim failsNo legal fee on a contingency agreement. Ask about costs.
Among the listed firms, five say they work on contingency. If there's a recovery, the lawyer takes a share; if the claim fails, you don't owe a lawyer's fee. For a consultation, all listed firms charge nothing. Although case costs are separate from the lawyer's fee, they can include medical records and medical opinions, plus fees charged by the court. When you read the firms' stated terms, you won't learn who advances those expenses or ultimately pays them. Before you sign anything, find out what you might owe if the claim fails. When the lawyer's share is calculated, do expenses come out first or afterward?

For a consultation, all seven listed firms say there's no charge. On contingency, five say they'll work.

What to bring to your first call

  • A timeline you've written with treatment dates and the date you first noticed the injury
  • Any medical records you have (delivery notes, too, if they're relevant)
  • Names of the hospitals and clinicians who treated you
  • Bills for your medical care, plus receipts for related expenses
  • Letters or messages you've received from the hospital or insurer
  • Photos showing your injury or how your condition changed
  • If a child is involved, your child's birth date
  • Correspondence or a fee agreement from any lawyer you've already contacted

Questions to ask a lawyer

  1. 1With this kind of medical injury, how many claims have you handled?
  2. 2Who would take responsibility for my file as the lawyer?
  3. 3Given these treatment dates, what's my filing deadline?
  4. 4To evaluate my claim, what medical records or opinions do you need?
  5. 5When calculating your contingency fee, what method do you use?
  6. 6If the claim fails, what expenses might I owe, and who pays case costs?
  7. 7When I need updates, how do I reach whoever handles my case?
  8. 8If you decide not to continue after taking my case, what happens then?

Choose around the care that went wrong

Don't start with the biggest advertised result; start with your injury. If your diagnosis was delayed, you may need different experience than a nursing home neglect claim requires. When you describe what happened in Little Rock, tell the lawyer where you received care and what changed afterward. Find out about cases with the same medical problem.

When you see published results, look closely. Although The Brad Hendricks Law Firm reports cerebral palsy recoveries, Taylor King Law's reported nursing home neglect settlement doesn't include an amount. In Alexander Shunnarah's published account, the injury came from a grocery store fall. Because that injury is different, the result doesn't show whether the firm has handled a claim like yours.

Ask who will answer your calls

  • Before hiring, find out which lawyer would review your chart and decide about your claim.
  • When you need updates, who sends them and how can you reach them? Find out what happens if that person isn't available.
  • Before the firm takes your case, ask which medical opinions it may need and how it evaluates medical issues.

Rather than relying just on the star rating, read reviews for patterns in clients' experiences. Although several firms here get praise for keeping clients informed, others receive complaints about calls going unanswered. They don't establish anything about your own case. When you speak with the office, use those comments to ask how it handles calls and updates.

Get the payment terms in writing

If you contact a listed firm, each says the consultation is free. During that conversation, ask about fees; the offer doesn't mean the firm has agreed to take your case. If you recover money under a contingency arrangement, the lawyer receives a share; if the claim fails, there's no lawyer's fee. Find out about case expenses separately.

Before signing, find out who pays for records and medical opinions, and what you could owe if you don't recover anything. If someone promises an outcome or pressures you to sign an agreement you don't understand, be wary. This isn't legal advice; it's general information. To understand how the rules apply to you, speak with an Arkansas lawyer.

Questions people ask

How long do I have to file a medical malpractice claim in Little Rock?
From the wrongful act, Arkansas generally gives you 2 years to file your claim. Even if the harm only becomes clear much later, the clock generally doesn't wait until you discover the injury. When you give an Arkansas lawyer your treatment dates, ask how that rule works in your situation.
What deadline applies if my child was injured?
If a child is aged 9 or younger, the deadline is generally the eleventh birthday or 2 years from the act, whichever comes later. When the injury couldn't have been discovered before age 11, the rule gives 2 years from discovery, though it can't extend beyond the nineteenth birthday. For injuries during childbirth, a rule in place since August 2025 requires filing a lawsuit by the child's fifth birthday. To find out which rule applies to your child, ask an Arkansas lawyer.
Can I speak to a Little Rock malpractice lawyer for free?
If you contact any of the seven listed firms, each says the consultation is free; five also say they work on contingency. Even after a free conversation, the firm hasn't necessarily agreed to represent you. Before relying on that conversation, ask what it covers and whether the firm must review records to decide if it'll take your claim.
Will I owe anything if a contingency claim fails?
If a claim fails under a contingency arrangement, there's no lawyer's fee for the lawyer. Expenses are different. After an unsuccessful claim, who must pay those costs isn't clear from the listed firms' terms. Before you sign anything, ask for a written explanation of charges for records and medical opinions, plus the court fees.
Do I need an affidavit of merit to file in Arkansas?
You don't need an affidavit of merit in Arkansas. In Summerville v. Thrower in 2007, the Arkansas Supreme Court struck down the state's former 30-day affidavit requirement. Even so, find out how the lawyer will assess your medical care. To evaluate your claim, which records and medical opinions does the firm need?
Does Arkansas limit medical malpractice damages?
In Arkansas medical malpractice cases, there's no cap on damages. Even without a cap, that doesn't establish your claim's value or promise that you'll recover money. When you see published results, including The Brad Hendricks Law Firm's cerebral palsy recoveries, remember they're other cases. To understand the damages you may seek, ask a lawyer how the facts of your injury affect them.
How long will my malpractice case take?
We can't give you a fixed duration for your case. Although Arkansas sets a filing deadline, that isn't the time it takes for a claim to be resolved. When you talk with your lawyer, ask what records still need review and what might delay the next step. Even with a 2-year filing period, there's no promise that your case will be finished within that time.
What should I do if I think medical negligence caused a loved one's death?
Once you've written down the treatment dates, gather whatever records and hospital correspondence you have. Among several listed firms handling wrongful death, Reed Firm publishes a medical malpractice wrongful death settlement of $300,000. If you speak with an Arkansas lawyer, they can explain who may bring the claim and which deadline applies. Before collecting every document, you can still make the call.
