The short answer

Our featured firm in London is Diamond & Diamond Lawyers LLP, where Jeremy Syrtash leads the medical malpractice group. Among the firms we reviewed, Brown Beattie O'Donovan LLP stands out because of its long history and client feedback. That position isn't backed by published malpractice results. Before you call, check which lawyer handles the firm's medical negligence claims. Whether the firm can act in Ontario needs checking too. Discuss fees first. You can then read the Ontario claim rules.

Choosing a malpractice lawyer in London

Your claim comes first. A property transaction review tells you nothing about how the lawyer handles a disputed diagnosis, whatever rating the reviewer gives. On this list, the sole firm with a published malpractice result is Lemer & Company. Medical malpractice isn't the only work several of these firms do. You'll want to ask about claims the lawyer has handled involving that treatment.

Use the first conversation to check fit
  1. Describe the treatment and timing

You'll need your treatment dates. The lawyer needs to know when you first connected the care with your injury. You'll also need to ask which records to bring (for example, the chart or delivery notes). The treatment date alone doesn't necessarily settle your deadline.

  2. Identify the lawyer doing the work

You'll need to know who assesses your claim. Who answers your calls is another point to clarify. You'll need to confirm that Lemer & Company's Vancouver office can act on an Ontario claim before approaching it about representation. Diamond & Diamond Lawyers LLP also lists its offices outside London. Ask how you'd meet and arrange representation.

  3. Discuss proof before expectations

You don't need an affidavit or certificate of merit to start an Ontario claim. Expert reports must still be served under the court's rules. They must address the standard of care and causation. For your case, have the lawyer explain how they'd address those issues.

Get the fee terms in writing

At a free consultation, you're having an initial discussion. The firm may still decide not to take your case. Free consultations and contingency fees are listed by Brown Beattie O'Donovan LLP and Fosters Law LLP. Diamond & Diamond Lawyers LLP and MD Lawyers - London Office list those arrangements too. Cohen Highley LLP lists a free consultation. You'll need to confirm Lemer & Company's consultation and fee arrangements.

With a contingency arrangement, you'll want to know how the outcome affects payment. Ask for the fee calculation in writing, including expenses such as expert reports. If the claim doesn't succeed, you'll need the lawyer to explain what you could owe. A free meeting doesn't establish what those terms are.

Treat any promise of a particular recovery as a warning. A firm should clearly identify who handles the file. Be wary if it won't do that or say when it'll respond. This gives you general information; it isn't legal advice. Mention a possibly approaching deadline when you first contact the firm.

Questions people ask

Which firm leads this London malpractice lawyer list?
Brown Beattie O'Donovan LLP ranks first on the strength of its history since 1950 and client feedback that often praises communication. First place doesn't establish that its malpractice results are strongest. It handles several areas. There's no published malpractice result behind that position. Before choosing the firm, find out who handles medical negligence and whether they've handled claims involving the treatment that concerns you.
How long do I have to start a medical malpractice claim in Ontario?
From discovery, you generally have two years under the basic limitation period. It doesn't automatically start at treatment. For discovery, what matters includes when you knew, or reasonably should have known, about your injury and that a health care provider contributed to it. Knowing that a lawsuit was appropriate also forms part of discovery. Ontario has a 15-year ultimate period, too. Don't wait for certainty before asking an Ontario lawyer. They can assess the dates and whether any suspension applies.
Does the two-year deadline apply to an injured child?
The two-year period doesn't run for a claimant under 18 who has no litigation guardian for the claim. For a claim arising while the claimant is a minor without a litigation guardian, the 15-year ultimate period is also suspended, a point addressed in Wong v. Lui, 2023 ONCA 272. Age alone won't tell you the deadline. Ask an Ontario lawyer how the child's circumstances affect it.
Do I need an expert report before starting an Ontario claim?
Starting a medical malpractice claim in Ontario doesn't require you to have an affidavit or certificate of merit. The court's rules do require service of expert reports. Those reports must address the standard of care and causation. Ask at a consultation how the lawyer would assess those questions, and what obtaining the reports would cost. For the steps your claim requires, speak with a lawyer in Ontario.
Are medical malpractice damages capped in Ontario?
There's no statutory cap on economic losses (lost income or future care, for example). Non-pecuniary damages have a judge-made national trilogy cap. Your claim's value can't be determined from these rules alone. Nor can you predict your outcome from a firm's past verdict. For the injuries you're describing, ask an Ontario lawyer how economic losses differ from non-pecuniary losses and how that distinction applies.
