Write down dates and names while they're fresh.

  7. 7.Settlement or trial

Many claims settle. Some go to a judge or jury.

Your deadline: 2 years from the treatmentRead the Idaho law guide

Each step in more detail
  1. Initial review

When you speak with an Idaho lawyer, describe the treatment and injury, including their dates. From the act or omission, the general filing deadline runs for 2 years. Before you wait for every medical record, ask about timing.

  2. Records and medical assessment

Before proceeding, ask who will review your chart and get any needed medical opinions. When you learned of the injury, tell the lawyer. Even if you discovered it later, Idaho generally doesn't push back the deadline.

  3. Prelitigation screening

Before litigation, Idaho requires a screening panel rather than an affidavit of merit. When discussing your claim's filing deadline, have the lawyer explain what happens at the panel and how it fits into that timing.

  4. Filing the complaint

To start the court case if your claim proceeds, the lawyer addresses filing a complaint, the document that begins it. Because the pause for minority cannot exceed 6 years, review a child's deadline separately.

  5. Working toward a resolution

If settlement or trial is possible, discuss those paths. Alongside verdicts, firms on this list publish settlements. Because Idaho's general non-economic damages cap covers malpractice, its adjustment each July 1 matters. How would that affect your claim?

What a malpractice lawyer costs in Boise

  1. The first callOften free. Ask before you book.
  2. A written agreementThe share the lawyer takes, set out before work starts.
  3. If you recover moneyThe agreed share and the case costs come out of it.
  4. If the claim failsNo legal fee on a contingency agreement. Ask about costs.
Along with Litster Frost, Mahoney Law, PLLC and Morgan & Morgan say they take cases on contingency. If money is recovered, the lawyer receives a share; if the claim fails, there's no lawyer's fee to pay. Expenses aren't included. When records and medical opinions are needed, ask who pays along the way and how the firm handles court fees. If the firm advances those costs, find out when it deducts them. If nothing is recovered, could you owe expenses? Because a free consultation doesn't make every later service free, ask the lawyer to walk you through the fee agreement and expense terms in plain language before signing.

For the first consultation, Six of the seven listed firms say there's no charge. Contingency is offered by Three.

What to bring to your first call

  • The treatment date, plus the date you first became aware of the injury
  • Records you already have, including any medical chart or notes from delivery
  • The doctors and hospitals involved in treatment
  • A brief timeline showing what happened
  • Bills and receipts showing what the injury cost in medical care
  • Any hospital or insurer letters you've received
  • Bring any photos you have of the injury
  • How old the patient was when treated

Questions to ask a lawyer

  1. 1Have you handled claims involving treatment or injuries like mine?
  2. 2Who handles my file, and who will review my medical records?
  3. 3When does my claim's filing deadline fall?
  4. 4For my case, what happens with Idaho's prelitigation screening panel?
  5. 5When I have questions or need updates, how do I reach you?
  6. 6If my claim recovers money, how are your fees calculated?
  7. 7If my claim succeeds or fails, who pays the case expenses?
  8. 8Before you decide whether to represent me, what must you know?

Choose for your medical claim, not just the rating

Start by naming the treatment you're worried about. If the stroke diagnosis was delayed, your questions will differ from those about an injury during delivery. Alongside Rossman Law Group, PLLC's published results in both areas, Mahoney Law, PLLC lists VA malpractice among its work. When asking about claims, focus on your treatment or injury. Even if a broad personal injury practice lists malpractice, it may not publish results for medical cases.

Look closely at what each result covers. Morgan & Morgan's published birth injury verdict was in Hillsborough County, not Boise; Siegfried & Jensen's listed result involved a motor vehicle injury. Neither predicts what your claim might recover. Ask what role the lawyer personally had in comparable cases and who would review your medical records.

Put the filing deadline ahead of the shopping process

Idaho uses a screening panel before litigation; it doesn't require an affidavit of merit. Ask how the panel affects timing when you discuss the deadline for filing your claim. Have the treatment date handy for your call, but don't wait until you've gathered the full medical chart.

Use the consultation to test the working relationship

  • Who takes responsibility for your file once intake is over? Ask how you can contact that person when you need them, including how they'll send updates.
  • Ask about case expenses separately from the lawyer's fees. Will the firm pay upfront for records and medical opinions? If the claim fails, ask whether you'd still owe expenses.
  • Before the firm decides, ask what information it still needs. Although a free consultation lets you talk about the claim, it doesn't promise the firm will represent you.

For clues about service, read reviews. Although Mahoney Law, PLLC gets praise for communication, some people say their inquiries went unanswered; communication complaints also appear for Morgan & Morgan. If you call, how do they respond? If someone promises a recovery or dismisses the filing deadline, be wary; a refusal to explain the fee agreement also deserves attention. Before signing, get the terms in writing and take time to read them without pressure. This gives general information, not legal advice.

Questions people ask

How soon should I contact a Boise malpractice lawyer?
Make the call soon. You generally have 2 years from the act or omission to file in Idaho, so call before you've gathered every medical record. Idaho's statute of limitations usually keeps the same start date even if you didn't discover the injury until later. Have an Idaho lawyer check your treatment dates and explain how the rule applies to you.
What if I only recently discovered the medical injury?
Even if you discovered the injury later, Idaho's filing deadline generally doesn't start later. Foreign objects and fraudulent concealment are exceptions to that rule. If a hospital didn't explain what happened, that alone doesn't establish either exception. When speaking with an Idaho lawyer, give the treatment date and say when you learned of the injury so they can assess your deadline.
Does a child have more time to bring a malpractice claim?
While a patient is a minor, Idaho pauses the filing deadline. Because that pause cannot exceed 6 years, though, not every child has the same date to file. To calculate your child's deadline, give an Idaho lawyer the child's age and treatment dates. For birth injury results, both Mahoney Law, PLLC and Rossman Law Group, PLLC publish cases.
Can I speak with a lawyer without paying for the first consultation?
For a free consultation, Six firms on this list say they offer one: Mahoney Law, PLLC, Hepworth Holzer, Morgan & Morgan, Siegfried & Jensen, Litster Frost and Craig Swapp & Associates. When scheduling, confirm what that meeting covers. Because Rossman Law Group, PLLC's consultation terms aren't stated here, check with the firm directly before you book.
What happens to legal fees if my claim fails?
If your claim fails under a contingency arrangement, there's no lawyer's fee; otherwise, the lawyer receives a share of any recovery. Along with Litster Frost, Mahoney Law, PLLC and Morgan & Morgan say they offer this arrangement. Discuss expenses apart from fees. Even if nothing is recovered, could you owe expenses for records or medical opinions, including court fees? Ask about that.
Does Idaho require an affidavit of merit?
Rather than an affidavit of merit, Idaho requires a prelitigation screening panel. Whether a firm will take your claim is a separate question. Find out who would review your medical records before going ahead, including what medical opinions the claim might need. Ask the lawyer how they'll track the filing deadline as they explain what they'll do for the panel.
How long will a Boise medical malpractice case take?
Neither Idaho's rules nor the firms' published results tell you exactly how long your own case will take. When you discuss the mandatory prelitigation screening panel, ask what other steps your claim needs and what could slow its progress. Even if you get an estimate of how long resolving the claim might take, the filing deadline remains separate.
Is there a limit on medical malpractice damages in Idaho?
Each July 1, Idaho adjusts its general non-economic damages cap, which applies to medical malpractice. When a harm has no direct bill, such as pain and suffering, this cap concerns it. To understand how it applies to you, ask an Idaho lawyer. Even if a firm publishes a verdict or settlement, don't treat it as an estimate of what another patient might recover.
Can these firms review a claim if my loved one died?
For wrongful death, Several listed firms offer help. Along with Hepworth Holzer, those firms include Rossman Law Group, PLLC and Mahoney Law, PLLC. If the death involved treatment, ask whether they handle that kind of claim. To learn who may bring a claim and when to file, talk with an Idaho lawyer. When calling, have any hospital correspondence and treatment dates ready.
