How a malpractice claim usually moves in Nevada

  6. 6.Settlement or trial

Many claims settle. Some go to a judge or jury.

Your deadline: 3 years from the injuryRead the Nevada law guide

Each step in more detail
  1. Discuss the injury and dates

When explaining what happened, include when you learned about the injury. Nevada requires filing by the earlier of 3 years from injury or 2 years from actual or expected discovery if the injury occurred on or after October 1, 2023.

  2. Review the medical records

With your chart and treatment dates, the lawyer has something concrete to assess. Beyond those records, what does the firm need, and how does it arrange medical review? When a child is involved, discuss Nevada's limited deadline exceptions and how the child's age affects the claim.

  3. Prepare the expert affidavit

To meet Nevada's requirement, the medical expert's affidavit must come from someone in a substantially similar practice area. Besides naming each provider, it must describe the specific negligent acts. Ask what the medical review supports before the lawyer files a complaint.

  4. File the complaint

Filing the complaint starts the lawsuit. If it doesn't include the required expert affidavit, Nevada dismisses the case without prejudice, which means the dismissal itself doesn't prevent you from refiling. You shouldn't assume there's still enough time to file before the deadline.

  5. Assess the claim and possible resolution

When discussing a possible resolution, ask how medical findings and claimed losses affect it. No matter how many defendants are involved, Nevada caps non-economic damages, including compensation for pain and suffering. Although economic damages aren't capped, you can't use a firm's published results to predict your recovery.

What a malpractice lawyer costs in Las Vegas

  1. The first callOften free. Ask before you book.
  2. A written agreementThe share the lawyer takes, set out before work starts.
  3. If you recover moneyThe agreed share and the case costs come out of it.
  4. If the claim failsNo legal fee on a contingency agreement. Ask about costs.
Under the contingency arrangement most firms here say they use, the lawyer receives part of a recovery, but you pay no attorney fee if the claim fails. That doesn't include case costs. Beyond court fees, those expenses can include the cost of medical records and medical opinions. If the firm advances those costs, ask when it deducts them. Without a recovery, would you owe them? You can't establish the usual arrangement for those expenses from the listed firms. Although all offer a free consultation, the work that follows isn't necessarily free. Before signing, get a written explanation of the fee calculation and the costs you're responsible for.

If you contact any of these ten firms, each says it offers a free consultation. Contingency is how nine say they work.

What to bring to your first call

  • Your chart and other records you already have, with delivery notes if relevant
  • When you received treatment, plus when you first noticed or learned about the injury
  • Names of the hospitals and providers involved
  • Details of other financial losses, along with your medical bills
  • Letters or messages you've received from the hospital or insurer
  • Photos related to the injury that you already have
  • What happened, written as a brief timeline
  • What you want to ask about fees and medical review, including staying in touch

Questions to ask a lawyer

  1. 1When you've handled cases involving treatment like mine, how many were there?
  2. 2Who handles my file, including reading my records?
  3. 3Given when I was injured and discovered it, what's my filing deadline?
  4. 4To meet Nevada's requirement, how will you obtain the medical expert affidavit?
  5. 5What's your method for calculating the contingency fee?
  6. 6Whose responsibility are case costs? If the claim fails, could I owe them?
  7. 7When I need updates, who answers?
  8. 8Before you decide whether to take my case, what do you need to know?

Choosing a malpractice lawyer in Las Vegas

Rather than the biggest advertised recovery, start with your medical problem. If you're calling about delivery care, a published birth injury result may make a firm worth considering. Who would handle your file isn't clear from that result. Because most firms here handle other injury work too, ask about cases involving the same treatment.

Ask who will review the medicine

When you file a complaint (the document that starts the lawsuit), Nevada requires a medical expert's affidavit. To provide it, the expert must practice in a substantially similar area. Besides naming each provider, the affidavit must describe the specific negligent acts. Bring any chart or delivery notes you already have, and ask who pays for the medical review and how the lawyer arranges it.

Even when the claim involves a child, act promptly. Although Nevada allows limited exceptions for brain damage, birth defects and sterility, it generally requires a parent or guardian to sue within the normal period. Growing up doesn't mean your child can then sue. When you speak to the lawyer, provide your child's age and when the injury became apparent.

  • Who decides whether the firm accepts your case? When reviewers complain about intake, some describe long waits or rejection with little discussion.
  • Before you agree, settle who answers questions and how you'll receive updates. If your usual contact isn't available, who takes over?
  • Keep the lawyer's fee separate when discussing case costs. If the claim fails, what might you owe, and who pays for medical records and expert opinions, along with the court fees?
  • Before you sign, get the fee agreement. Even if the consultation is free, you still need to know the financial terms of hiring the firm.

To get clues about service, read reviews. Although several firms get praise for keeping clients informed, others draw complaints about delays. A lawyer's experience with your medical issue isn't something either kind of review tells you. To understand published recoveries, check their context. Rather than Las Vegas, Hillsborough County was where Morgan & Morgan's listed birth injury verdict came from.

Questions people ask

Which Las Vegas firm leads this list?
With birth injury claims among its practice areas, Gina Corena & Associates leads this ranked list. You can't predict yours from its results. Because the firm handles malpractice within a broader injury practice, ask who would take on your medical issue.
How long do I have to file a Nevada malpractice claim?
You must file within 3 years from injury or 2 years from actual or expected discovery, whichever comes first, if the injury occurred on or after October 1, 2023. If injured earlier, you have 3 years or 1 year from discovery. Don't count on the longer period. Have a Nevada lawyer look at your dates.
Can I speak with a lawyer without paying for the consultation?
If you call any of the ten listed firms, each says consultations are free. Under the contingency arrangement nine say they use, the attorney fee comes from a recovery, but you pay no attorney fee if the claim fails. That doesn't cover case expenses. Ask what the consultation covers before signing, and find out how the firm would handle those costs.
What medical support does a Nevada malpractice case need?
Nevada requires an affidavit from a medical expert in a substantially similar practice area when you file the complaint. Besides naming each provider, the affidavit must describe the specific negligent acts. If it's missing, the court dismisses the case without prejudice. What do your records need to show, and how does the firm arrange the medical review?
Do children have longer to bring a malpractice claim?
Don't assume so. Within the normal period, a parent or guardian generally must sue. The child can't sue later if they don't. For brain damage or birth defects, Nevada extends claims until age 10; for sterility, it's until 2 years after discovery by the child. To find out whether an exception applies, ask a Nevada lawyer.
Does Nevada limit compensation in malpractice cases?
Regardless of the number of defendants, Nevada caps non-economic damages in cases involving professional negligence. That category covers pain and suffering. There's no cap on economic damages, including financial losses. When you discuss each loss with the lawyer, ask which category it belongs in and how the rule affects your claim. You can't forecast yours from a firm's past recovery.
How long will my malpractice case take?
You can't learn from this list how long your case will take. Although Nevada's filing deadline sets when you can start a lawsuit, it doesn't determine when the case ends. What record review and expert work does your claim need? When discussing possible delays, also ask how the lawyer will keep you informed about the case.
What should I do before calling a Las Vegas malpractice lawyer?
When noting your treatment dates, include when you learned something had gone wrong. Alongside your records, gather the bills and messages you've received from the hospital. What else does the firm need from you? If the injury happened some time ago or the claim involves a child, make sure you discuss the filing deadline early in the conversation.
What if my loved one died after medical treatment?
Among the firms listing wrongful death alongside medical malpractice are Breeden Malpractice & Injury Law and De Castroverde Law. In a published case description, Richard Harris Law Firm discusses an infant given a fatal hospital medication dose. To find out who may bring a claim and which deadline applies, ask a Nevada lawyer. Because the answers depend on your circumstances, you'll also need to talk about the required medical review.
Are Spanish-speaking malpractice firms available in Las Vegas?
Alongside Lerner and Rowe, Ladah Injury & Car Accident Lawyers Las Vegas and De Castroverde Law list Spanish-language availability. With offices in Las Vegas, all three list medical malpractice among the cases they handle. Before proceeding, confirm that the attorney assigned to you speaks Spanish. For written explanations and updates, ask how the firm will handle those too.
