Your deadline: 2 years from the treatmentRead the Texas law guide

Each step in more detail
  1. Initial review

Tell the lawyer the dates as you explain the care you received and your injury. Texas generally sets a 2-year deadline to file these claims; discovering the problem later doesn't trigger a general discovery rule. Ask how much time remains, even if you're still gathering records.

  2. Records and medical assessment

Ask how the firm plans to get your chart and a medical opinion before you go ahead. Does it take claims involving the error you suspect? The firms cover different medical topics on their sites, but none has published malpractice results you can use to compare them.

  3. Filing the complaint

The lawyer checks when you must file, then files the complaint. If a child is under 12, the deadline is the fourteenth birthday; otherwise, the 2-year rule applies regardless of age. There's also a 10-year outer limit in Texas. Your ordinary deadline isn't extended by it.

  4. Serving expert reports

Texas requires an expert report and CV for each defendant; they're due within 120 days after that defendant's answer is filed. Missing that requirement means dismissal with prejudice, and you'll face fees too. Ask who keeps track of the deadline for each defendant.

  5. Further case work and resolution

If your claim needs additional medical review or court work, discuss that with the lawyer, including how fees apply if it resolves. Alongside Texas's cap on non-economic damages, death cases carry a separate inflation-indexed cap on total damages.

What a malpractice lawyer costs in El Paso

  1. The first callOften free. Ask before you book.
  2. A written agreementThe share the lawyer takes, set out before work starts.
  3. If you recover moneyThe agreed share and the case costs come out of it.
  4. If the claim failsNo legal fee on a contingency agreement. Ask about costs.
Four firms on this list say they work on contingency: the lawyer takes a share of money recovered, with no legal fee owed if the claim fails. All seven offer a consultation you don't pay for. Expenses differ from fees. Records and medical opinions can cost money too, beyond what you pay in court fees. The firms don't list a single set of payment terms, so ask who covers expenses at first and whether you'll owe that money if the claim fails. Get the lawyer's share in writing before signing, with an explanation of how the firm deducts expenses from any money recovered. Ask the firm taking your claim whether it uses those payment terms.

All seven firms listed say their consultations are free, so that conversation won't cost you. Four say they take cases on contingency.

What to bring to your first call

  • Medical records you already have, including your chart and any discharge papers you received
  • The date you suspect the error happened, with treatment dates and hospitalization dates
  • The names of the doctors and hospitals involved
  • Your medical bills and records of other related expenses
  • Hospital or insurer letters, including any messages they've sent you
  • Photos that might show how you were hurt
  • A short timeline of what happened
  • Your child's birth date, if the claim concerns your child

Questions to ask a lawyer

  1. 1How many medical malpractice claims have you handled that were like mine?
  2. 2Who will review my records, and who else will work on my file?
  3. 3Given my treatment dates, when must I file?
  4. 4What's your plan for getting and serving the required expert reports?
  5. 5How do you work out your legal fee when a claim recovers money?
  6. 6Who covers case expenses when a claim doesn't succeed?
  7. 7How will I get updates, and who's my contact at the firm?
  8. 8How could Texas damage caps change my claim if they apply?

Choose for your medical concern

Think first about which treatment you believe harmed you. If you're considering birth injury or cerebral palsy, Zinda Law Group addresses both; Harmonson Law Firm covers surgical and medication errors. When choosing whom to call, you can use these topics. Because a website topic doesn't show how many comparable cases a lawyer has handled, you'll need to ask directly about that experience.

Although several firms appear on this list, they handle a broad range of accident claims. In their practice-area menus, Flores Mendez Law and Tawney, Acosta & Chaparro P.C. don't expressly list medical malpractice. Before sending a full chart, find out whether they accept health care liability claims that involve the kind of care your family received.

Put the filing clock ahead of reviews

When the defendant answers, the expert-report clock starts running. Within 120 days after each defendant answers, you must serve that defendant with a report and the expert's CV. If you fail, you'll face fees and dismissal with prejudice (you can't bring the claim again). Before proceeding, ask how the firm will get the required medical opinion.

Use the consultation to test the working relationship

  • Before proceeding, ask who will review your medical records and whom you'll contact regularly. Even with an attorney roster, you don't know who's assigned to your file.
  • Ask plainly how you'll get updates. Many clients say they get prompt replies, but you'll also find mixed reviews of communication at some firms here.
  • Ask how they've handled malpractice claims like yours. None of these firms has published malpractice results, so there's nothing there for you to compare.
  • Get the fee agreement before signing anything. The first conversation is free; you'll still need to ask what hiring the lawyer will cost, including how the firm will charge you for case expenses.

Don't trust a promise of payment. Texas caps non-economic damages; a death claim has another cap on total damages, which is adjusted for inflation. The lawyer should walk you through the caps for your claim, then explain what they haven't yet investigated. This page isn't legal advice, just general information. Ask a Texas lawyer how these rules apply to what's happened to you.

Questions people ask

Which El Paso firm leads this list?
Wayne Wright leads this ranking largely because it's been operating since 1996; client feedback about communication and the professional recognition listed also count toward its place. The firm won't suit every kind of medical claim. Malpractice makes up only a small part of its broad injury practice; it hasn't published malpractice results for you to assess. Ask which lawyer would take on your medical concern before you choose the firm.
How long do I have to file a Texas medical malpractice claim?
Texas generally gives you 2 years to file, counting from the breach or the end of treatment or hospitalization. These claims don't get a general discovery rule. The statute's 10-year outer limit doesn't extend your ordinary filing deadline, so you still need to meet that earlier deadline. If you need your dates reviewed, a Texas lawyer can check them under the Texas statute.
Does a child have more time to bring a claim?
If a child is under 12, Texas allows filing until the fourteenth birthday. Otherwise, age doesn't change the 2-year rule. Don't count on being able to wait until your child reaches adulthood. When you speak with a Texas lawyer, provide the child's birth date along with treatment dates and ask what the rule means for your family.
Can I speak with a lawyer without paying for the consultation?
According to all seven firms here, you can consult them for free. If you hire one of the four that say they work on contingency, the legal fee comes from a share of recovery; there's no legal fee if the claim fails. Expenses need their own discussion. Before proceeding, ask about charges for records and medical opinions, for example, and request written payment terms.
What does Texas require beyond filing the claim?
After each defendant's answer is filed, Texas gives you 120 days to provide an expert report and the expert's CV for that defendant. If you fail, dismissal with prejudice and fees follow. Even if you file on time, you haven't met this separate report requirement. Before proceeding, find out how the firm will arrange medical review and keep track of service for each defendant.
How long will my malpractice case take?
You won't find a total case duration to give for these listed firms. Texas deadlines tell you when to file and submit expert reports, not how long you'll wait for a claim to resolve. Ask what your case will need before going ahead. Ask how you'll hear from the firm if the medical review takes longer than expected or court proceedings drag on.
What should I do before contacting an El Paso lawyer?
Write down your treatment dates for the call and gather the records you have, including hospital letters and bills if you've got them. Don't put off calling to finish gathering paperwork if you think the filing deadline could be close. Check that the firm accepts claims about your kind of medical care before sending it your detailed records.
What changes if my loved one died after medical care?
Several firms on this list discuss wrongful death on their sites. Ask whether they've handled deaths linked to medical care; mentioning wrongful death doesn't tell you they've worked on deaths involving medical malpractice. Texas places a separate cap on total damages in death cases, with that cap adjusted for inflation. Ask a Texas lawyer to walk you through that cap and the filing rules as they apply to your family's circumstances.
Are there limits on compensation in Texas malpractice cases?
Correct, Texas caps non-economic damages in health care liability claims; death cases have another cap on total damages, which is adjusted for inflation. Those caps won't tell you what your own claim is worth. Ask the lawyer which caps could apply to your claim, and how they factor into assessing it, before you decide whether to hire the firm.
